I signed for a hire car from a claims assist company on a hand held electronic device that was delivered to my home

I was told at the time that this was for me checking over the car and taking delivery at my home.

I was sent documents that told me i am responsible for the CREDIT HIRE of this car and not my insurance company.

It is obvious that they have lifted my signature from the hand held device and transposed it onto other documents.

Is this legal ?

They now cannot get the 21000.00 !!! from the other party so they are coming after me with their solicitors.

This whole mess from a non fault accident in Feb 2011.

I want to fight them but need some help.

Make a complaint with the claims assistance company and whoever introduced you to them.

 

As to the legality of using your signature from the electronic handheld device and placing this onto the various documents, I would think this would be highly dubious. It is dubious if they did not also provide you with the relevant paperwork at the same time and explained to you about the consequences of providing your signature.

 

If you had comprehensive cover on your own policy, but chose instead to go directly to the third parties Insurers using the claims assistance company, I would also suggest that you speak to your own Insurers about this. They may not wish to get involved, if the claim was not reported to them after the accident.

 

Do this first and see what happens.

Did you sign for the credit hire on the premises belonging to the company or at your house? If it was at your house, would you be able to scan me the agreement forms you have and I can chat to on PM about it.

Hello there. I'm not sure why you're looking to advise by PM? Documents could be posted up here without personal details and then any advice can be subject to public scrutiny.

 

Davidmalia, you've probably been here long enough to know that advice by PM is hardly ever recommended.

Hello there.

 

So you have nothing in writing? I agree with Uncle Bulgaria that it sounds highly dubious and should be taken further. Please keep posting and I'll also let the site team know about this in case anyone has experience of similar problems.

I can't believe that DriveAssist think that they can make very charges for hire cars and then expect Insurers to pay.

I agree with unclebulgaria that you should contact your insurance company, and that the link from dacouc is useful.

 

Also do you have legal protection with your motor insurance? If so get in touch with them.
