Sent letter to Nationwide accepting amount paid as part settlement and informing them of my intention to pursue the remaining balance of my claim.

Kizzyella - They will send you a letter back saying "we've completed a thorough investigation and are satisfied blah, blah" - they will then ask you to prove where the extra 'bank charges' come from - I just pointed them back to the POC on N1 Form ;)

 

Well done, keep going there are a few of us in the same boat here - I'm trying to get a copy of their defence which is at my local court so I'll let you know as soon as I found out.

 

Benforlini - they paid me the 7.75% contractual rate but when I spoke to them they told me they had paid me 8% contractual - but then she did say she didn't know what 'compounded' meant :-| from the lady who is the customer care manager

 

BTW we are closing our accounts this afternoon - c'ya nationwide:D

Hi, I haven't been able to post on here for a while as my partner has been ill since December with pneumonia, and my Dad has been hospitalised with a collapsed lung (He has since caught the new superbug C-Diff).

 

Anyway, Nationwide closed my 18 year account with them on December 15th. I was devastated! I had opened a parachute account with HSBC just in case, but I had hoped I may slip through the closure net. NO CHANCE.

I have since been able to open a new FLEXAccount with Nationwide. Oh how stupid it all is.

I also had to file my AQ at my local court by December 28th, so I am awaiting the outcome of that.

Hiya all.

I have received a letter from the court saying that they have "made an order under of its own initiative without a hearing".

Nationwide, if they object, must make an application to have it set aside, varied or stayed within 5 days of receiving it. Dated 03 Feb.

The letter goes on to say: IT IS ORDERED THAT Unless the Defendant's AQ is filed within 5 days of service of this order, the defence will be struck out.

Does this mean that my claim against Nationwide will soon be concluded?

It simply means that unless NW file their AQ by today (8th) the claim will be struck out and yes you will have won. However, NW filed their AQ in my case 30 days late so the saga continues...
