the cretins are at it again.

 

I have today received a letter (FORMAL DEMAND FOR PAYMENT)

 

The account that it refers to has been ongoing since May last year.

 

The last letter from them re the same account was in November last year.

 

The latest letter starts:

 

As we have now purchsed the above debt we are authorised to recover the full amount due, quoted above.

 

This is a formal notice of intended court action we intend to take unless you pay,

or agree an arrangement to pay, the sum you owe.And so the letter goes on,do I answer or do I just ignore the cretins.

 

Oh they have already had a CCA letter back in May last year and nothing was forthcoming.:-x

Ignore the fools.

 

I intend to ignore all there letters,it would be a lot of fun in court with these cretins if it ever got that far.All the past letters from them I have got filed.:-D

Besides it only encourages them if they get some sort of response.....

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Hi all,

 

I am being pestered by these people over a so called debt that is Staute barred

as I have not had any contact with the creditor for over 7 years.

 

I am also being harrassed by phone.

 

I have recently sent a letter RD to these muppets stating that the said account in question is Statute barred.

 

What is the best thing to do next?I have not responded to any of there calls

and I have no intention of making any contact with them over the phone.

 

Any help would be appreciated.:-x

As you've already told them the alleged debt is Stat Barred follow it up with this letter . .

yo, tell them to Foxtrot Oscar in whatever way you wish. Statue barred is Statue Barred however they dress it up.

 

Sit back, relax and then send a letter with your fee's on it in respect to your time and money spent in answering there empty threats...

:-xAfter sending these people 2 statute barred letters for 2 different accounts

I have had the following replies today and would like to know from anybody on the forum what to do next.

 

First letter reads as follows:

 

Further to your recent query, our client received a payment of £2 in May 2005.

The limitations Act does not apply.

Please send your payment within the next 14 days.

 

I or my wife have no recollection of paying anything in May 2005.

 

Second letter reads as follows:

Further to your recent communication, we do not accept that the above account is time barred under the Limitations Act.

 

Even were you to demonstrate that this debt is time barred,

the debt still legally exists and may be reported accordingly to the credit reference bureaux, as appropriate.

 

We are prepared, however, to offer you etc,etc.

 

I know for a fact that neither of the accounts in question show on my credit files.

Help please.

The first one should be prepared to provide proof that you did in fact pay monies into the account.

 

The 2nd should be reminded of the OFT guidelines

really on that 2nd letter

 

can you scan it up please

 

scan the required letters/agreements/sheets

remove all pers info inc barcodes etc but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

the hit reply button

 

 

as for the £2

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I've recently had the same issue. After me telling them the alleged debt is state barred, they told me I had made a payment of £1 within the 5 years (Scotland). They were duly sent off with a request to pull the statements from the bank and two months later seem to have forgotten and phoned me again, to wit I told them in the politest of terms to take a run and jump.

Robinson way, they really are desperate, I have an alledged debt with them, which every year they reel out the same old template letters, and every year I ignore them, at which point every year they threaten court at which point I reply and say yes please, then they go away for another year - Bless

With regard to the so called £2 payment alledgedly made in May 2005,would you advise that I send a prove it letter or do I just ignore for the time being as we will soon be in June.

 

At the end of the day, that's your decision.

 

I know Scots law affords the alleged debtor slightly more protection than English law, having said that when they'd claimed I had made payment - which I definitely hasd not done - I did ask them on the phone to pull the bank statements. They haven't done so, and I think the next time they hassle me it will be a subject access request to them and the bank, upon which I will seriously consider taking legal action.
