Police arrest customer to allow Buy As You View to seize goods

well ive been told by a close friend that even if the police are proven they acted wrongly they will never admit to it,( dont know how true it is)

 

just spoken to lind\a davies at bayv, shes thinks that if ive paid under !/3 of the agrement they have not broken any laws? they have a lagal right to get there stuff back with or without a court order.

 

is that true?

No. Not true. Only if the goods were in a public place, or you had given your consent. Linda Davies knows this. I am surprised at her. You should keep everything in writing from now on. DO NOT SPEAK TO BAYV ON THE TELEPHONE.

 

This is a perfect example of how BAYV take away your basic consumer rights by RE-FINANCING agreements. Essentially, you had items repossessed that you had been making payments on for over a year!!

yep they need a court order to enter premises to recover goods, and I am sure they know that.

And the surprising thing is Police should know that too!

I am very disappointed that BAYV have not replied to my message. This is absolutely NOT how we expect company reps to behave when contributing to this site.

 

OP: Can you confirm exactly WHAT items were repossessed please? You mentioned you had been with BAYV for over a year, but added a new item in February. Did BAYV just repossess the NEW item, or did they also reposses the item(s) you had had previously?

 

Had you received an official default notice (in writing) from the company?

 

I would like to help, but I need more information.

This story is truly shocking, at the very least i sense a full refund here as clearly stated within the agreement.

 

A couple of months ago i sat waiting patiently for a perfect home rep to slip up. She did after 2 weeks of pestering, posted a card through the door demanding monies or criminal proceedings will be made against me.

 

I sent her a text message explaining the Administration of Justice Act 1970

and how i was sending a letter to head office notify them of her breach. Also explained that all further doorstep calls will be by appointment only and communications to be in writing.

 

I have not heard a peep since, but i still have the card and text message for proof.

 

Moral of the story? Know your rights and fight back.

I have been assured by a senior director at BAYV that a full and thorough investigation will take place concerning this. I have every faith in BAYV keeping to their word on this, and I look forward to a satisfactory conclusion.

All this is yet more evidence that BAYV are little more than loan sharks praying on vulnerable people and taking the law into their own hands.Just goes to show we have to have this site as for too long these companies have thought that they are above the law and dont like it when people fight back..

Had a phone call from paul bell the regional manager, basically he saying the police allowed them into my home, also there trying to say i have removed the coin meter from the tv. wich is a complete pack of lies, i asked him if he had any photo proof as they bayv guy was in the flat alone, he replied "its not standard practice, also wich i forgot to mention why was the conset form left blank, should this not have benn mentioned. i passed him the officer who was dealing with police complaint, and he said he would speak with him and also the caller that day.

 

then friday i was back at the police station to show them documents lefft by bayv, arfter he seen the blank consent form he said "theyve had no right to enter or allow anyone to enter my property, hes took a copy of the contract, the consent form and also some cards he left, he will now contact bayv to get there side of the story, he asked what i would like as an outcome, so ive asked to be compensated for unlawful arrest, false imprisoment, unlawful entry and allowing unlawful entry.

 

when i got home i phoned linda davies who told me to ring paul bell, she give me his mobile number, so phoned guess what call is ended after about 6 rings

Please use your approved status as an official CAG BAYV Customer Service Rep, and let's see a proper, correct and speedy solution to this. Because, believe me, THIS case is absolutely not going to go away....

This thread has been here now for 12 days. During this time, BAYV has requested (and been given) official customer service rep status at CAG, and I have been assured by a senior director of the company that a "full and thorough investigation" will take place. This was almost a week ago. From what the OP has told me (privately) this does not appear to be the case.

 

Will BAYV please respond to this thread immediately, and reassure CAG that the company is taking steps to resolve this VERY SERIOUS complaint.

You should let the police know you are definitely looking at suing them for wrongful arrest and unlawful detention, as their action was based on a falsehood that may even constitute a fraud by Bayv, and write to your MP. imho

 

They should then pressure Bayview, as they now look stupid and inept, as they appeared to flount the very law they are supposed to uphold. Also Watchdog would be worth a go imho, for their rogue traders

I am waiting for the OP to post some scans - namely the contract, the blank consent form (left by BAYV) and - most importantly - a calling card left through the door a day or so earlier warning the OP of repossession with police attendance...

 

Why is this last item so important?

 

If this is true, then it looks to me like the BAYV employee used the term "police attendance" as a THREAT, in an attempt to frighten the OP. If the OP wasn't at home when the note was left, how on earth would the BAYV employee fear for a "breach of the peace" on a later visit?

 

We are to assume it was the BAYV employee who called the police, and requested their assistance. For the police to then attend meant they had, in effect, been hoodwinked, and tricked into appearing as if they were ENFORCING the repossession - which of course, they were not, or at least they weren't SUPPOSED to be!!!!

 

I really believe that BAYV have over-stepped the mark by a mile on this one, and their absence from this thread (and CAG in general) only strengthens this view. (Which, I would stress is only my PERSONAL opinion at this time, and not necessarily that of CAG, it's administrators or site owners).

 

Still, as I have said, this thread is absolutely NOT going to go away.

Although The OP cannot post the scans on here yet due to his post count, he has sent me a copy of them. I can confirm the note left by the Buy As You View collector said:

 

"..I shall give you until noon today to return goods or pay cash, then police will come.."

 

Now then, that is NOT giving notice to the OP that the goods will be REPOSSESSED. That is a THREAT warning that the POLICE will come and THEY will deal with the matter!

...and it has now been a FULL WEEK since I made Buy As You View aware of this case (although the thread has been up for almost TWO WEEKS). And it has been a FULL WEEK since Buy As You View were given official company representative status at the Consumer Action Group.

 

During that time the OP has received just one telephone call from a Buy As You View regional manager, and Buy As You View's silence on this forum has been DEAFENING!

 

THIS, QUITE SIMPLY, IS NOT GOOD ENOUGH!

It is not only disappointing,but also demonstrates a breach of trust that we have placed in BAYV in agreeing to their request to be given the chance to respond on the site.

That decision was not agreed lightly,given that some 8 requests had been made to them to make the formal requests to Admin,which they failed to respond to earlier over the course of many months.

 

The CAG expects any company given this sanction,to be responding to and addressing ALL our members complaints,however trivial or serious,and not to cherry pick those which it sees fit to deal with.

 

If BAYV are reluctant,unwilling,or incapable of observing this,then it is pointless them being here at all.

 

Therefore,we ask that BAYV make it known which is it to be ?

If we do not see these recent threads getting answers to the questions being posed pretty soon,we will assume that they are not in any position to remain on the site as an invited Official Customer Reps,and will remove the status.
