Given that this site has, at the last count, 64,162 members, the likelyhood is that a large number of these will belong to a trade union. A lot of the trade unions will assist members in things that don't involve the workplace, especially if it affects a large proportion of their members. I have set this poll up to find out how many members we have for each union so we could at least get them to advertise us in their magazines and publications. If we have enough members from one union we may be able to get them to fund a test case to lay down some case law for others to follow and turn the tide against the bank.

The Unions operate on a Collective Conditional Fee Agreemant (CCFA). They have specialist multi office firms such as Rowley Ashorth & Thompsons who undertake their legal work on behalf of them & their members free of charge. (Costs are recovered from the losing defendants)

 

Whilst its doubtfull that they have lawyers who are consumer law savy they could still take on such cases as they would simply instruct a counsel specialising in consumer affairs for either opinion and/or court.

 

Also the unions through their lawyers are probably responsible for more case law than any other body

 

I suspect that with the might of the unions against them the banks would capitulate wholesale because they know that any threats such as individual members suffer would lead to further very expensive well publicised litigation & probably not in the local County Court but in the High Court.

 

I've seen companies issue veiled threats against employee litigants & the response of the law firms has been a sight to behold. Its my opinion that the banks would have to stark raving mad to try & pull any of the stunts they do now

 

What I'm saying in a nutshell is that its a great Idea. So if your not already a member nows the time to join. After all even if they don't take up the cause there are other benefits

I am a UNISON steward at my work...have been so for several years (7 at last count)......if you wish to contact them, let me know...i have been asking the local branch about taking matters further with regards to this....will let you know how it goes

Is anyone going to or has access to the TUC this month.

 

If so how easy is it to raise a floor question regarding the efforts the Banking Unions are taking to ensure that their members are not in anyway risking prosecution by supporting the Unlawful/Illegal bank charges.

 

I would hope that as a minimum they have saught legal advice on the issue on behalf of their members and if they have not that they would commit to do so.

Amicus. Big in the finance sector... possibly has more reason than most unions to dislike the banks... General Secretary (Derek Simpson) at present is a left-leaning guy who'd probably view the banks fairly negatively.

Would this be the guy that attempted to resolve a gender discrimination complaint by firing 5 male staff and offering to re-hire them at the same (lower) salary as the woman who had made the complaint, rather than actually raising her salary to match?

Thats right blueskies all NEC's look after the interest of all local branches at a National level. Im the branch secretary of a local branch and have been granted permision to let my branch and non union members know of this site and how to claim back their charges. I will be in contact with the National Chairman within the next couple of days to see if we can get details published in the monthly magazine so that all members up and down the country are aware also.
