To keep everyone informed, a few days after I recieved acknowledgment of service I recieved a letter from DG Solicitors. They offered me the full £2620 on condition I would keep it confidential.

 

In meantime I realised i'd made a cockup on the claim form and not included the interest in amount claimed. The interest was £501.

 

I wrote back and said thanks for the offer however as you know i'm entitled to claim 8% APR, county court act 1984 s69 etc etc

 

They wrote back saying full offer of £3121 on condition of confidentiality, there was a form to sign and return.

 

I have not signed the form, I wrote back saying I accept £3121 as full and final settlement of claim number X. However, confidentiality is seperate commercial agreement between us and I would sign the form for a consideration of £5,000

 

Nothing back yet and the court clocks still ticking

Make sure if you sign the confidentiality agreement, that you get a good price for keeping your gob shut (obviously it'd be better if you didn't)!

Do you honestly think they'll pay you extra?! Or are you just trying it on?!

 

I dont for one minute think they will pay extra for the silence, I think they just put that on all the offers and hope the majority sign them to get the money, the ones that dont they will just refund anyway. I think if I asked for £50 to sign it the result would be the same.

 

However - you never know !

Well I was right,

 

Letter this morning from DG Solicitors

 

"Thank-you for your letter of 20 April 2006, The amount of £3126.21 will be credited to your account shortly"

 

So it seems confidentiality is not so important to them, I might as well shout it from the rooftops now !

Is this okay to send to DG Solicitors regarding my additional accounts

 

Thank-you for your letter of 24th April 2006, and for the subsequent payment of £3126.21 in full and final settlement of the above claim.

I must now turn to additional accounts held with First Direct, which over the years have unfortunately attracted unlawful penalty charges.

I have attached schedules of these charges amounting to £905.00.

It is my preferred option to settle this matter between ourselves without it becoming necessary to issue proceedings.

Please let me know as soon as possible if you wish to proceed along these lines. If I do not hear from you within 14 days I will issue a letter before action to First Direct plc advising of my intentions.
