  5. I sued First Direct PLC. They are the company you bank with, not their parent company, HSBC. Good luck. James,
  6. I notice a lot of people here sending letters and making lots of phone calls and generaly argueing with the banks before sending an LBA. I can't really see the point to be honest, and just wondered if any one had had any success getting their money back without starting small claims court proceedings? All I did was sent an LBA. When they failed to meet my 14 day dealine I filed at moneyclaim online. Within a few days I had my money back. This seems to be a stress free method as I didn't have any conversations or letters to and forth with my banlk/ I really couldn't see the point.

  8. Did you read the FAQ? You can only claim back 6 years, so there is no point asking for 10 years worth. If you point the bank to the relavent parts of the data protection act you will find they respond very quickly after that. FD delayed with me until i sent them a stinking letter pointing out that they are in breech of the DPA. Send it to Linda Young. It's all in the FAQ's.

    Wow busy tonight. Thought the show was great. Glad more people will know. Hope fully this will lead to thenks re-visiting their policies on this. Could lead to a back lash though. Just accepted my offer from the bank, but deleted the confidentiality part. Hope they don't change their minds now! ;-)

  13. Thanks for that. Money claim filed just now. £1479.50 including the interest. The Money claim form doesn't really lend itself to claiming interest which has occurred at different dates does it. Should be ok though. I made myself clear enough. Wish me kuck ;-) James,
  14. Hi all. Just trying to work out the 8% interest for my claim on monday. I guess I need to enter every charge individually into the on line calculator and sum the interest on each to get my result. In the interests of laxyness, Is there a spreadsheet anyone has done so that i can jsut fill in the columns and dates to get a quick answer? Sorry to be lazy, I suppose I should knock one up myself but I hate to re-invent the wheel. Thanks, James.
  15. Ok, thanks for the info. I will be back here tonight working out the claim details and calculating interest. Shame really, but I can see why they do it. THey want there solicitors invloved to persuade you to sign a non disclosure agreement.
  16. Got my "thanks for your letter, we will get back to you within 10 days" letter from them. How amusing. They can't even count. If they don't respond within 7 days of them sending that letter they will have court proceedings against them as promised in my original letter. Lets see if it gets that far. It probably will I think. They have until Friday to pay me back the money they stole. Next Monday morning I will be off to court. Will I have to pay some fees up front on Monday BTW?
  17. The talking to your mate thing is very true, and the person that answers the phone deals with your call from beginning to end. Very good IMO. Lloyds were embarrasingly bad and although I still have an account (parachute) with them I would never recoomend them to any one. I reccomend FD all the time.

  20. Haha! If I was related to paypal, do you think I would be over drawn. lol. Thanks guys. I run a forum of my own in my spare time, it's incredibly laid back, apart from when threads go "off topic". This one works differently and having read a lot more of it I can see why now. So no worries. ;-) I tell you what, I find this so dissapointing as in all other respects i have found First Direct to be the best bank i have ever used. Letter sent thus not 5 minutes ago by recorded delivery.: First Direct 40 Wakefield Road Leeds LS98 1FD LETTER BEFORE ACTION Dear Sir/Madam, ACCOUNT NUMBER: xxxxxx I now understand that the regime of ‘fees’, which you have been applying to my account in relation to exceeding overdraft limits and so forth, are unlawful at Common Law, Statute and recent Consumer regulations. I would draw your attention to the terms of the contract, which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner that complies with UK law. I am frankly shocked that you have operated my account in this way as I always had confidence in your integrity and expertise as my fiduciary. I calculate that you have taken £1228.00. I require repayment in full of this money within 14 days. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest and my costs and without further notice. Yours faithfully, James Palmer

    To be honest I don't see why you bother entering into correspondance with them. They are only trying to stall you. I find the line "no further correspondance will be entered into" to be most effective. It leaves them in no doubt that you are prepared to go to court and will not fall for any "bluff". Just my 2d.
