  4. an absolutely shameless bump to my thread from a year ago just a little up date. I am currently helping a friend claim £3800 back from Halifax and I was interviewed for a womens magazine last week about reclaiming bank charges. The magazine will not be out for another few weeks but I will let you all know when it is. I have also reclaimed mis selling on my endowment, overcharge on mortgage exit fees and am currently reclaiming an overpay on my council tax because I was in an incorrect banding. Good luck with your claims ps - mentioned this site and moneysavingexpert in my interview
  5. A friend of mine is claiming about £3800 in unfair bank charges from the Halifax. She has sent off the second letter giving 14 days for Halifax to reply however they have written back to say that it will take between 14 and 28 days for them to look into her complaint. The letter also states that they may not be able to get it sorted in 28 days and in which case will write back to her requesting more time. What should she do ? should she stick to her original time limits and let them know that she is going to stick to her time limits or is it in her best interests to give them 28 days ? Unfortunately her laptop has died and she can not come on line which is why she has asked me to look into this for her. Thanks for reading and any advice is welcome.
  6. WOW POCA that sounds really good - wish I knew all that stuff. Right I will read up on the sections that you have listed of the sale of goods act and put another e mail to them. Thankyou very much for your reply.
  7. Hi, I wonder if anybody can give me some guidance on a problem that I am having with an order placed with a internet company. I ordered a made to measure evening gown from a company with a matching stole. The dress arrived but when I tried it on it was not fitted to the waist and was far too long - I had supplied all of my exact measurements to the company when I placed the order. The stole did not arrive with the dress so I waited till the stole arrived to try it again to see if the bump at the back caused by the dress not fitting correctly at the waist could be covered by the stole. I was also going to look into having the dress taken up but that would have only cost me more and I think it would have ruined the line of the dress. When the stole arrived and I tried it on again I decided that it really was not going to look very good and for the money I should get a perfectly fitted dress, so I wrote to the company and requested a return code so that I could get a refund. The company have sent a letter back to me from their legal department, refusing to give me a refund and saying that the dress should have been returned within 5 days ( as stated on their website ) and that they are covering themselves because of people wearing dresses and then returning them for refund. The company that I bought the dress from is Formal Gowns Direct/home of high quality wedding , prom , evening and prom dresses and I can copy the e mails onto here if required. Thankyou for reading and any advice would be appreciated.
  8. I got another letter today from D & G - asking me to sign their letter of acceptance which includes the gagging agreement. I actually wrote a letter to them last week accepting the compensation ( obviously I did not include the gagging agreement ). As far as I am concerned - the bank have paid up, I have cancelled the court claim and I have written to accept the arrangement. I dont see how they can make me sign their letter when everything has already gone through. It is a bit late now to ask me to keep my mouth shut - perhaps if they were going to be pedantic about it they shouldnt have paid me out before I accepted. Im not even going to bother replying to it - as far as I am concerned the matter is finished. They paid - I accepted - end of.
  9. Went to the court today and cancelled my claim against First Direct and I have made a donation to this site too via Paypal So thats it for that account - might get started on my other account with FD - only a couple of charges on there though so hopefully wont have to go as far as court next time and they may remember me and just pay up :o
  10. go for it Seylectric - mine was only 1 payment too but as you say they could be doing this to loads of people and making a lot of money off it. In the past I would have just let it go, but I fight for every penny of my hard earned cash from those who try to take it from me. Think this site is going to my head
  11. lol thats the funny thing - they have paid me before I have actually accepted it I actually did my claim direct with the court so will I have to call in and cancel it ? can you still do a donation by amazon voucher ? I seem to remember reading about it somewhere on here but cant find it
  12. Hi Monkey - survey already done just a quick question - do I need to contact the court to let them know that the claim is now settled ?
  13. Id like to see them try - card will be cancelled in 2 days
  14. This is sooo funny. I got home tonight to another offer from D & G today for the full amount including interest and court fees - Brilliant I thought. I checked my account online and the money has already gone into my account I havent even replied to accept the offer to D & G yet. I am not going to sign the pre printed reply letter as it may tie me down to no more claims against HSBC and I have another account with FD with a couple of charges on that I havent claimed for yet. WOOOOOHOOOOO Im a happy bunny
