      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I work most nearly every weekend matey, sometimes at very last minute :) I hope this clarifies the point you're trying to raise :)

 

As an aside I was en-route until I had the text that you were there so I decided to abort and have root canal surgery instead.

 

Oh u would also rather have root canel than MTM at a cag meet.

Thing is i suppose that goes for other peeps too that have to come from all over :confused:

I know that iam just saying there are more direct routes from london to everywhere. tho if we were to hold a london meet it would be easier maybe for everyone.

Can we please make it more Southern this time? Bearing in mind that even by "more southern", I don't actually mean the deep South, but more South than the Midlands.

 

Datewise, GM, I understand that you have family commitments, but if everyone else is happy with a date in December, it might be that majority will have to rule. Speaking for myself, November is really not a good choice, and October for a xmas do is just silly! :lol:

Just reiterating for me... I like the idea of Oxford...

 

Brum is about as far north as I could go bearing in mind I would have to fit travelling around my work commitments... any further North than that and I may just as well turn 180deg and nip over to France...:D

Bookie i understand that but i would like to make at least one cag do this year as previous dates have been wrong for me.

 

O was also going to ignore mtms comment re a oct due but as u commented bookie i will as i agree that idea was stupid.

 

Tho spams idea of france is good passport will be needed tho.

NO...for the following reason:-

So that is London out of the equation. :razz:

 

You spurned the chance of a pleasant time in St Albans + with your FREE travel reaching as far north as Crewe you don't really have a financial prob reaching most of the better parts of England, that others may have in travelling to the Big Smoke.

...Unless chez vouz has zillions of vacancies por favor? ;)

I didn't "spurn" anything, oh great windupmeister, I had to choose between dos and don'ts, so to speak, as my finances didn't stretch to ALL of them, and Chez Caro offered free accomodation whilst St A didn't.... The maths was easy. Likewise, Brum etc...

 

Zillions of vacancies Chez Bookie, no, ze chien crazy and the enfant difficile make it an unlikely proposal, sadly, otherwise, my casa would be su casa, so to speak. :-D

...Especially when it comes to attending CAG meets. ;)

Peeps come from all corners of the land, some at great expense, both in time + cost.

Some have even been known to use up some of their much valued Annual Leave so as to be able attend a meet with like-minded peeps, with whom they hope that that affinity they feel for a fellow poster, is just a friend that they haven't met yet.

Xmas is an extra special time for peace & goodwill to all men + men-esses.

...Make it so.
