      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok, so apparently, we need a date and location, and a first headcount might be useful too.

 

There's been a few Midland-ish meets, so the Southerners amongst us would like summat a bit more close to home this time.

 

Suggestions so far, as far as I can make it:

 

London

Oxford

 

... and I forget what else, so make your wishes and availability known, and we'll take it from there. I'll make a pretty banner once we have settled on date and place (by which time it probably will be justified to put up xmas trees and lights, if experience has taught me anything, lol).

Sounds good to me if it's within an hours travel from London... I'll be working til 7 both days so don't wanna be too late, but it's right on top of Payday for me too...:D

Got a wedding to go to on 5th & poss work do on the 12th but after last years work do:eek::eek: I think that was enough entertainment from me to last them a lifetime:eek::eek::eek:!

london would be good for me but would struggle on the tube due to easily getting lost but could be a adventure b4 the party i would be down day b4 and there sould be plenty of staff to ask stupid questions to.

Dads last op this year is 26th Nov. He gets discharges 1st dec with my OH caring for him till the 14th as he will only need 14 days care. The for the 16th -18 we in norwich visitng family having christmas number 1 and booze up for sisters birthday (19th dec) 19th -21st christmas 2 in croydon at OHs nans house. then the 4 further christmases fitting somewhere between 22nd and 31st.

 

6 christmas and numerous booze filled sessions.

I would like to stay as far away from oxford as possible due to family reasons. I could really go as far as peterborough or the whole of norfolk/ north suffolk, lowestoft, or london area.

For thr record guys, although I live in Birmingham now I'm not a Brummie. I was actually brought in up Oxford so know the place VERY well.

 

Transport links are brilliant.

 

For those who live in or near london you can get a bus every 5-10 minutes from Victoria, it's often much cheaper than getting a train.

 

Alternatively, London would be nice although accomodation prices in December will be £££££

if travelling from north to south (or from South of Oxford) you can get a train direct from most big cities via Cross Country Trains. If Oxford has been chosen and a date set you will be able to take advantage of reasonably cheap fares direct from their website. For those who live in the South West you can get a train from places like Bristol, Bath or Swindon etc with Great Western.

 

If any of you live near Cambridge I think Stagecoach do a really good bus called the x5 which also picks up in places such as Bedford and Milton Keynes.

They have usually gone home for Christmas by the end of November.

What about one of my earlier suggestions - Huntingdon? it's on good rail links (although I still prefer the idea of Oxford - only ever been there for a day and liked it).

 

I'd prefer not to do London (too expensive to travel and stay in December). Leicester & Peterborough are supposed to be a bit "wild" at weekends aren't they?

I think MTM's memory seems somewhat more pickled by the alcohol consumed at those meets, Seq. ;-)Caro will vouch that the London meets have usually a dozen people turning up, which is no more or no less than most CAGmeets elsewhere. So don't dismiss it just yet. ;-)
