They did that with Monty in Scotland, I think, and his thread was discontinued.

 

Personally, I would like to think that I would refuse any such offer on a point of principle, but I wouldn't. My life is absolute hell financially, and if they offered me a generous settlement I would take it.

 

Sorry, everyone, I'm just being honest. Would I lose my house on a point of principle? No. I think anyone who would do that would be an absolute saint and I would have nothing but total respect for them, but I couldn't do it.

 

However, I'm a bit confused about why it would necessarily stop others from challenging them in the same way if they tried it again. They are so arrogant I believe that even if they did apologize they wouldn't be able to resist trying it again. Not everyone is on CAG. They'd just probably stop proceedings immediately as soon as this forensic expert issue is raised, and say a mistake had been made.

 

The problem is that the very best thing would be publicity for what they have done and public shame. It would be nice if a judge could see that.

That's correct DD. I asked for my CAG thread to be removed. However ........ can brief Shakespere62 directly on any of my case if it is useful to his fight, I will also help anyone who has a Scottish case and have been working with Ida on some of these. However it is good to see there are now more Scottish cases and consequently more help on CAG.

 

In Scotland, Arsemex had (in my case) a less capable firm representing them and it made it easy to get a result up here. Also, the Scottish OCR system is undoubtedly more fair (I moved from England to Scotland just as Brachers were sending me silly offers before litigation) and the process more in favour of a party litigant (LIP) and strike-outs do not happen (or rarely compared with English jurisdiction). I have been busy, behind the scenes, helping a few cases in scotland and it is evident that they fold much quicker once the correct legal arguments are presented. It seems that the typical Scottish Sheriff has no problem in giving the banks/DCA's a sharp slap without much problem.

 

I hope Shakespere62 gets a result, it is an incredible thread........

First, best of luck to Shakey for today.

 

Second, noting Monty's comments about Scotland, I can say that having gone through much the same nonsense with Arsemex, Pishcon backed off after one letter when I was in NI. I suspect that this is because they are not authorised to act in NI courts, and the courts, as well as being quite LiP-friendly, are also strict about documentation.

Hadituptohere V RBS, default removal x 2, case dismissed, judge used Balance of Probabilities against hard Evidence.

Hadituptohere OH v Santander, Santander issue claim in court, settled out of court via Tomlin, less solicitors fees and interest.

On a positive note, to start things off and totally hijack, Howard Cohen settled their case against me today with £183.48 of costs for their discontinuance. Kept it close to my chest as they were thread hunting and it was a relatively straightforward matter... another tick in the CAG box.

 

So come on shakey!!! Let's hope you secured a result :)
