  1. I have my MCOL details and can access the a/c, i think it has been shredded by accident!!!
  2. I have lost my claim form in respect of a Wescot claim (halifax CC assigned to them) doesnt appear to be a copy on MCOL to file, can anybody post a POC from wescot in respect of a halifax CC - I would imagine they are all similar? Cheers
  3. Assuming you do ( i.e. you borrowed monies) would it not be cheaper to satifsy the part claim in full and then defend claim no2 on the basis they shouldnt issue another claim on the same agreement?
  4. Just a thought on these split claims - if you are in a position to pay the claim as they tend to be £200/£300 are you wiser to do this and then defend a second claim which may come along as an abuse of process?

  6. Thank you for this, wont be able to scan items up until the weekend. Yep on the agreement front not sure what to expect. In terms of the set aside/draft defence at this stage was looking @ Failure to disclose Unable to file defence due to non disclosure NOD/NOT Chances of success?
  7. Surely the TN point is a good one? This contradicted the NOD and insufficent time to settle Invalid/no agreement in the 31.14
  8. Thank you I entered defend all. Should the two pronged attacked be built into my witness statement (i do retain original copies of the NOD/NOT) with the set aside application

As stated in #2 should I mention what I believes invalidates the agreement in support of my application or rely on the fact they havent provided the information as per my request and wait for them to do that (if the set aside is granted) and defend it then or shall I chuck everything at it at this stage?

  12. Thank you for this. Although I am a little confused - So i can apply for a set aside (this is a default judgment) although no hearing has previously taken place
  13. just checked with MCOL they have registered judgment the day after the 28 days lapsed. What are my relalistic chances (if any) of getting this set aside with the invalid NOD and no CCA?
