  1. Update and Good News I had my day at the Court of Appeal yesterday and the application to have the judgment set aside was successful. Thanks to PT and his team.
  2. have they supplied you with terms and conditions
  3. do you still have the original mailer that came with the application form
  4. I used to frequent the site until they upgraded(or downgraded) and now I just can't find my way around. without being modest i know a thing or two about forums and there was no need for such a transition, it would have been better to modify the script
  5. My OH has had exactly the same from Capquest, and I know that she was never given any T& C's when she applied for a CC.

  9. Extremely worrying, when judge's start off like this, instead of sticking to the law and facts of the matter. In any case very well done Fluffy.
  10. Would you guys be kind enough to look at the attached agreement to see if all seems in order. Looks like they have stated the VAT amount incorrectly.
  11. Not sure if this has been mentioned before, HFC was merged/taken over in late 1998 by HSBC and they are still passing off HSBC terms as HFC.
  12. Fluffy Can you remind me the month and year of this agreement.
  13. The problem has been that the Judge's are allowing random bits of paper attached to anything with your signature and accept that as an agreement. It has always been clear that any agreement regulated by CCA 1974 should have all the prescribed terms within the four corners of the signature, but the judge's seem to have rewritten this part of the Act.
  14. would he be within his right to sell the furniture to the value of his wages, and keeping the same
  15. The delivery is supposed to be organised by the HO, but none has been done so far. This was supposed to be a company with a factory in China, head office in Birmingham, branches all over etc. Having done some research, it's like a one man band operating from home and somehow managed to get a pitch in shopping mall.
  16. How do you know I am sitting back and doing nothing. I know all about LBA and court action , look at the date I joined, so if you haven't got anything constructive KEEP OFF
  17. How did he find the job? If it was through job centre plus they must be told. dropped his CV this must be reported to the police and trading standards asap apart from your nephews problem members of the public could be paying for goods they will never see. Fortunately the customers would pay cash on delivery The only other method is a personal call at the owners address but great care would be needed take witnesses. He lives about 50 miles away
  18. In the letter they say they are trying to retrieve your original agreement, how did they mange to send a copy of the signature from that agreement if they are still trying to retrieve it.
  19. poor guy was going to use the wages towards his 2nd year at Uni. He's like £600 out of pocket.
  20. Do you know the trading title of the business? I have now got the home address of the owner How are payments for goods made and to whom ? Don't know You may be able to trace/ contact by sending or taking a letter addressed to them in to their bank and ask for it to be posted to them. Also where does the stock come from are their suppliers delivery notes/invoices on premises. There is nothing in the shop, no stationary, no phone in the shop, just a blank order pad to take customer name and number for deliveries.
