My bf had to pay civil recovery to a store cos he changed tags , the cost was paid but now he has to fill a form which requires you to reveal any civil judgements made against you ,

 

What we would like to know is that does civil recovery come under civil judgement? should he write yes or no on the form?

I would think you can tell them to get lost, no legal right to ask for anything, the civil recovery process is like a parking fine, so you dont go to court.

 

Actually it's not like a parking fine, it's just a [problem] by private companies.

The keyword is "judgement" - that ordered by a (judge of a) court. If it has not been ordered by a court, there is no judgement.

 

So far in this case, your BF has been accused by a third party of something, to which he has agreed and decided to recompense. That is not the same and not what is being asked.

I find this absolutely amazing.

Its a pity you did not come here first.Over the last few weeks there has been a few cases on Cag.

I took a personal interest a few months ago after a friend of mine became a victim of their practices.

I dealt with it for him and they soon backed off.

When I can find some time I would like to do a stickie here with temp letters and advice.

No one can condone those who are genuinely deserving of being penalised for breaking the law but from what I have seen these operate as a law unto themselves often frightening people to pay 250.00.

We have a legal system in place which is there to decide on fairness and justice-I would be more trusting of that process than I am of RLP who are very eager to take peoples money-but rather shy when it comes to answering questions-specifically to justify their fees when making demands.

Just out of interest how much did you pay them ?

 

Has the request for you to sign been made in writing ?

I would be very interested to see it.Perhaps you could pm me.

More to the point I am curious to know WHY they should want you to do this-and for what purpose it will be used for.

Thinking about this my initial thoughts are that you would be giving them your permission to further process your data.

I am looking into the options as to whether there would be a requirement for them to comply with a Section 10 notice under the data protection act.

 

I have not heard of anyone sending RLP a SAR.

It could probably throw some light on the questions of which third parties they are dealing with-this would be useful to know.(I mean organisations as opposed to their clients)

Their entry shows them to be registered for 6 areas of Data processing-one of which is credit reference agencies.

This is a little disturbing since it begs the question as to whether they could be registering details of those who chose not to pay their demands for fees as defaults.

There is no hard evidence of this happening as I am aware-but it needs looking into I think.
