Just spoke to the court, they have had 'notice of discontinuance' from the other side today.

Fantastic news

 

Just goes to show, they may claim youve been misinformed by an internet site, but if that were true and they were sooooo sure, why drop the case?????;)

 

Ive posted on your other thread, i think that you should look at costs now , do not let them get away with it as it will just mean that they will carry on causing others misery, the more times they get spanked for costs , the more times they will think about a case before litigating without merit

Thanks Paul, still breathing sighs of relief. I never doubted the advice, just my ability to argue it in court. Massive nerves!!!!

 

Will now have to look at how to claim costs, will do some reading on here and come back for help if need be but a massive thank you.

Just finished reading the thread – fantastic result. I bet your other half can’t believe it.

As has already been said – make sure you go for costs and hopefully they will get the message.

Today the postie arrived with a huge file and a letter saying 'please find enclosed by way of service the court bundle'

 

Is this usual?

No it is not normal,

 

are you 100% sure the court have recieved a NoD on this case? what was the date which the file was posted to you? is it possible that the NoD was sent to the court at the same time the bundle was sent?

 

i really do not like the sound of this

Hi, just got in and seen the replies to my post.

I think I may have confused the issue. I have had a copy of the notice of discontinuance from Drydens. The file was posted out on Dec 31st and the court date would have been 6th Jan, the court told me it was disontinued on 2nd Jan and I recieved the written confirmation a couple of days later.

 

The file would have been posted out before the discontinuation notice. So I assume that we would have been sent the bundle if it had gone to the court, is that correct?.

For goodness sakes, they sent out important documents required in a court case by normal post.. during the christmas and new year when the postal system would have been buried !!!.. Thank goodness you have notification from teh court that it was discontinued.

 

NOte.. you would not have been in receipt of those documents for the court case on the 6th had it gone ahead !!
