  1. Nothing to do with overstaying, that would have been Code30:Parking for longer than permitted Two [possible scenarios: 1. The parking place is divided into 2 parts, one permit holders/P&D and one permitholderrs/2hr limit and you mistakenly parked in the wrong section 2. CEO mistakenly thought the restrictions opposite applied to your side of the road. But this is all guesswork until we know the exact location. Have you looked at the council pics on their website.
  2. The sign means permit holders can park there for as long as they want, whilst non-permit holders are limited to 2 hours. What is the contravention on the pcn and what's the exact location.

The truck was legitimately allowed to park there to unload at 14.59 Since you work there and have parked there many times, ie you are no stranger to the area, you can hardly claim that you were unaware of the waiting and loading restrictions. You could argue that because of the 'gap' caused by the resurfacing at the pedestrian croosing, that there are two separate lengths of single yellow line and each section requires it's own separate timeplate, which your section didn't have. Good luck with that!! I'd take the discount and find somewhere else to park in future

  7. What manxman is saying is that the claims management company might lease the vehicle and that the RK is a finance company and they would have received the original pcn. They would have transferred liability to the claims management company, who in turn have transferred liability to you. That would explain the extended timescale and the council would legitimatey be able to serve beyond the 28 day deadline.
  8. No. Where a hire car co. transfers liability to the hirer the council are allowed to serve a second pcn to the hirer beyond 28days, but there is no excuse for the council not to have served the original pcn to the hire co. within 28 days
  9. Wait for the pcn in your name, then make representations that the original pcn (enclosing copy) was served out of time.
  10. It would make life a lot simpler if you just tell us the exact location where you parked. Yes you have to wait for the NtO to make formal representations. If that is made within 14 days of receipt of the NtO and the council still reject, although not required to do so, many councils will re-offer the discount (in the hope that the motorist will throw in the towel and pay up) If your council doesn't and demands the full penalty, then it's a no brainer to appeal to the adjudicator since it won't cost you anymore than the full penalty

  12. Dear Sir/Madam, PCN No: XXXXX I am writing to challenge the Penalty Charge Notice (PCN) issued on dd/mm/yyyy at hh:mm on XX Road. The alleged contravention is for parking in a residents' or shared used parking space or zone without a valid virtual permit or clearly displaying a valid physical permit or voucher or pay and display ticket. I would like to bring to your attention that the signage in the area is misleading. The timeplate for that bay clearly states " Mon-Sun 9am-9pm Pay at Machine or Pay by Phone". I read the sign about restrictions and tried to find a parking meter in order to pay as per the sign. I walked for a while trying to locate a parking meter to pay but could not locate one on XX Road or any of the parallel streets - AA Road, BB Road, CC Street, which are several hundred meters in length. I also double checked on Google Maps and did not find any parking meters in the area. By the time I returned to my vehicle, the PCN had already been issued just 15 minutes before the end of the parking regulation period. It is not reasonable to expect me, arriving in the area for the first time on a dark cold winter's night, to know that the parking meters had been removed and that the sign is misleading. I respectfully request that you consider my appeal and cancel the Penalty Charge Notice. Thank you for taking the time to review my case. Forget disproportionate point, penalty is stipulated in the legislation and councils have no discretion (or desire!!) to charge lower amounts. Otherwise good to go. I would be very surprised if the council cancel at this stage You could add a paragraph that if the council reject your challenge an they give the exact location of the ticket machine applicable to that bay.
  13. How sure are you that there is no pay macine? If so, I'd say you have a good case for misleading signage. Council won't agree so you'd have to take it as far as adjudication. What's the exact location.?

There seems no logical reason why threre should be any transverse bay markings when there are no others elsewhere in the street until you look at GSV 2012 :https://goo.gl/maps/zom54V1nrpBUJFiB9 where you can see that prior to the resent houses there was a road there, thus there were end bay markings before and after the junction of Gorefield PLace. I would argue that these transverse bay markings are historical and no longer have any relevance.

  16. Where there are SYL/DYL's between parking bays, it is usually a Controlled Parking Zone(CPZ). Sounds like your son may live in a Permit Parking Area (PPA). The entry signs will read something like 'Permit Holders only beyond this point' PPA's do not need SYL's and you can park anywhere within the area.. But some PPA' s will have marked bays and you can only parked in the marked bays . Where exactly is this?
  17. If you display the BB on SYL/DYL which is limited to 3 hrs, why don't you think it's needed for a 4hr time limited Disablled bay? As Bazooka Boo says, by not displaying the clock as a matter of habit, your just creating aggravation for yourself unnecessarily.
