I thought and hoped that was the case as it was listed as Elliott v Lloyds TSB

and not LLoydstsb v Elliott

Looking forward to seeing the background;)

OK. We've tried calling Uxbridge County Court and also the Mercantile Court. Uxbridge confirmed that the case had been transferred to the London Mercantile Court and that Elliot did not have a solcitor. The Mercantile Court curiously doesn't seem to have any record of the case but I expect that this is just an oversight. Unfortunately we've not been able to get any more information yet but we'll rethink our strategy and have another go next week.

 

Please don't all start ringing the courts and asking the same questions!

Don't know if this is any use but court listings can be found online I'm not too certain about the Mercantile court and the lists are usually only published the day before. Has anybody tried HMCS?

Sorry to be a pain. Usually when a case is passed up to a higher court the court sending the case will already have a date for the hearing. It may be worth trying the listings department again.

This may be an outragouse suggestion but it seems it may be worth teh task.

 

Dave has been on TV and on the Radio.

Contact those people again and explain the banks plan and the seriouse situation this case holds, and see if you can put a call out for this person.

 

This person must have no ideal how important they are.

 

Also a sticky saying Elliot in uxbridge court on such a date please contact CAG, and blast it over the net. time is of the essence. this person could actually be a member! in the shadows and have no ideal about this thread...

It's a real shame the test case isn't someone from this forum. I hope this Elliot has a good understanding of what's going on or has people that do know helping him/her!

 

We really need to find out who it is, and Dave, BF and the rest can help prepare a case that should it go all the way will leave the banks crying into their £50 notes.

 

Has anyone thought that this Elliot person may have something to do with the banks( either directly or indirectly) and this case might be a set up so the banks can take it all the way knowing that they'll win because they've deliberatly messed up the claim and thats why both parties agreed to the case being moved to a higher court, because i can't see why anyone would want their case moving to a court where they may have less chance to win? knowing that the chances were that because the banks had settled EVERY previous case in full without a court appearence they'd get all there money back without any risk.Unless he's really does know what he's doing and wants this farce sorting out once and for all, but then surely we'd of heard something about it either on forums like this or esle were on the net, because if i were taking this sort of risk i'd be everywhere asking for help,and he almost certainly would of heard that he can claim charges back somewhere on the net . I'M NOT SAYING THIS IS THE CASE BUT I FIND THIS A LITTLE BIT SUSPECT

At this stage, we have no way of knowing. That is why we are urgently trying to contact Elliot.

 

It is worth stressing, once again, that there is no general stay on claims and that whilst three have been stayed, dozens if not hundreds have not. Moreover, each of the thress stays is being vigorously challenged.

This will not be a set-up by the banks. I dare say whoever Elliot is he will not be going into a higher court without legal representation. The judge who is sitting will have to take a fair view and will also have to consider public opinion ( not too sure though how much he will be aware of this but there doesn't seem to be any precedent for reclaiming bank charges) but as we all know there is significant evidence from the OFT to substantiate a claim. This case could be the one to set the precedent and hopefully the ruling will be in the favour of the little people. Does anybody know how much Elliot is claiming? obviously it is under £5,000 if the case has been passed from the small claims.

 

As someboby mentioned in a previous thread, it could well be that the small claims courts have been overwhelmed with applications to reclaim charges and this is probably only just the start of things to come. This could just be a way of dealing with this issue. My friend is a lawyer in London and I am going to be contacting him to see what he can come up with. he's pretty well read and knows what he is talking about. I don't think we should be panicking too much at this point.

Ok, here's another daft question...........

 

A lot of the recent posts suggest that this case is not from a forum member. But on post #44 there is a link to a post in the Lloyds TSB forum from a member called empirestrikesback about his claim for £18k.

 

It seems around 22nd June he was deciding upon court action - a week later we have a case Elliot v Lloyds TSB referred to the Mercantile Court. Well if it's for a claim for £18k and compensation for the loss of his business, it would.

 

Wouldn't it?

 

Has anyone checked with empirestrikesback to see if it is him?

 

I notice this thread has a timetable for a case at the end of this year.

Hi Either party can request a matter be sent to the Mercantile Court. Whilst a lower court must be guided by a higher court that only applies to the actual matter ruled on which may not cover everything & any ruling can be revisted if considered peverse

 

Also the OFT should be notified asap of this impending case & the banks attempts to circumvent their recent findings

I have written a note to the judge in my case, asking him to release Elliot's contact details or to allow the court to act as a conduit. I would like Elliot to contact me so we can discuss the similarities in our cases. The clerk said that the judge will look at my note tomorrow morning. Whatever happens I will go ahead with the application to have the stay order set aside.

Lloyds' solicitor has told me that I can write to the court to say the claim is settled as they won't go back on their offer. The clerk, on the other hand advised not to, until the money's in the account. I think we all knew that anyway.

I am getting really confused now lol. all this business about test cases. It'll be interesting to see what, if anything emerges from this. In the Grand scheme of things there seem to be only a handful of cases that have been stayed. Eventually there will be a case taken into a higher court and some precedent set but this is all unfamiliar ground, with the banks opting to pay up and tell everybody to keep schtum. Although there are plenty of people visting this site and claiming, there are still thousands, if not hundreds of thousands who are unaware of the OFT's report. I doubt it will be long until the floodgates open. I don't think we should be too concerned about test cases.
