I am having a few problems with welcome who seem to be FV-1 Incorporated and progressive financial services limited

I took a secure loan with welcome but land registy are showing progressive financial services i have been out work a while and cut my payments to them they took me to court as FV-1 Incorporated to get a restriction on my flat wot does all this mean and can someone tell me were i should go many thanks

HI im with welcome sorry to say i took a loan with them for 15.000 ive paid over 10.000 and still have 22.000 to settle now if i go full term i will be paying 42.000 im be hind on ths they want me to start a new one lol

Has anyone heard of a company called FV-1. Its not on list as a dca. Would be interesting to know where they are in the dormant league. Global debt recovery have assigned one of my debts to them.

are theses the same company = are they door mat =which one would take me to court for reduced payments many thanks den

As it's a secured loan it's the same as a mortgage ie they can go to court to repossess your property if you get 2-3 months in arrears. The agreement itself may be unenforceable in some way so you may want to scan it on here ( personal details removed 0 so that someone can take a look for you.

 

It's difficult to advise without knowing your full situation to be honest - are you claiming all the nefits you're entitled to? Do you have other debts? If so what are they & how much?

see what you mean i was taken to court by FV-1 for the sum of 1,489.38

i was away at the time so did not get the chance to find out what the dept is for i have a ccj for that and a restriction on my flat and 33p a day interest till i sort it.

 

but welcome seem to be a part of FV-1 so i thought it might be the arrears on my acount.

 

but now he has give me seven days to pay another 143.6p and take out a new loan and i said no way take me to court den

A secured loan and a charging order are 2 different things. If you took out a secured loan with Welcome they don't have to get a CCJ to then get a 'restriction' ( I assume you mean a charging order which secures the judgement debt on your property? ) against your home. They can just go to court and ask that the property be repossessed, so it's not a money claim like a normal CCJ but a claim for possession of property.

 

If FV-1 have sued you via the court, got a CCJ in your absence & have since applied for and been granted a charging order then it sounds like either a different agreement altogether or they are trying to claim interest on the original CCJ.

 

It's difficult to be specific without knowing all of the info - you aren't even clear yourself what the CCJ relates to. In theory if a CCJ is granted in your absence & you have a dispute on the debt you could apply for it to be 'set aside' which puts it back to the claim stage giving you the chance to defend the claim.

 

The problem you have is that you would have to show also why you didn't receive any of the notifications about the charging order - there is always a hearing before a final charge is granted which would have been AFTER you defaulted on the original CCJ. You would also have had a letter from the land registry advising that a charge was being applied for.

 

I think you need to find out what the original CCJ relates to and look to do a subject access request to both Welcome & FV-1 to see what you can find out.

thanks you are really helping even if it dont look like it im not very good on the pc so that dont help

 

im not in the uk but my mum is at my flat she opens all my mail she bought it out to me she had no court letters just one from land reg from mortimer clarke who are on a 0845 number that you cant get though on ive e-mail from my cag e-mail and my own but no reply so far

No problem - as I say it's hard when we don't know exactly what has gone on... it may be worth ( if you haven't already 0 giving your mum power to act on your behalf in the UK so she could perhaps take everything down to the CAB or similar for you. I'm just very conscious that I don't want to give the wrong advice to you.

rang national debtline they have been a great help .

 

welcome rang to day with an offer of a new loan 2 years intrest free but they said stick to my guns and say no so let you know how i get on thanks abunch den

i took a secured loan with welcome in 2004 on the loan agreement it has in very small print progressive financial sevices ltd trading as welcome financial sevices though they have different reg numbers

 

the legal charge i have has welcome reg number

but land registry has progressive

 

is this right den
