  1. Hi there I wonder if you can help with this. It seems fishy to me. My fiancee is a support worker (supporting disabled people who have their own tenancies) for an agency on a zero hours employment contract. All of her shifts involve supporting people in their own homes for the local city council (in Scotland, if that's relevant). On average, she works around 37 hours per week (sometimes a lot more), and does additional "sleeping" shifts (paid at a set rate) when they are available (on average one or two of these per week) My fiancee has been with the agency full time for around 18 months. The agency routinely emails all employees every week to say "You have been booked for shifts this week, so please check the online system" or "All shifts have now been allocated" but recently the weekly email included the line "All shifts over 6 hours moving forward will include a 30 minute unpaid break in line with the Councils working time directive." No other information was provided, and we have emailed the agency twice for further information but no reply. There are several problems with this: Firstly, my fiancee supports people with various physical and learning disabilities who explicitly, as per their care plans, cannot be left alone in their homes (or indeed alone in the community) for safety reasons. She works one to one with the person she is supporting, and no other staff members are available to relieve her. Some of them may inadvertently hurt themselves, or are vulnerable to abuse, or suffer from potentially fatal epileptic seizures. It is impossible for my fiancee to take a "break" from her work in the legal sense, and if she left anyone on their own it would be a clear case of a breach of duty of care and serious negligence. It should be noted that none of the Council's own support worker employees are also unable to take a break, as there is nobody available to cover their duties while they leave the site. As for the issue of compliance with the Council's policy/Working Time Regulations, the majority of her shift patterns never complies with the legal guidelines. For example, she is often booked for a PM shift finishing at 22:00, then a sleep shift, rolling over onto an AM shift starting at 07:00 and sometimes working well into the early afternoon. This pattern can repeat several times in a 7 day period. In addition, it seems like her pay conditions have been changed without her being asked to sign an updated contract. Any advice or guidance would be greatly appreciated at this early stage. It sounds very wrong to me, given the circumstances of her work. Thanks a lot!
  2. Hi All, I couldn't find a "marriage" related forum but please move this post if not relevant here. Mortgage issues is the closest I can get to. Here are the basic details. My daughter has been married for 5 years. They have 3 young children. Mortgage is in the husbands name. Both are named on the Deeds Husband is the only income earner. Husband decides to up and leave - not wanting to be involved anymore. A girlfriend has subsequently appeared on the scene. My daughter has agreed to take over paying all the bills and pays 50% towards the monthly mortgage payment. Husband want's to get back on the property ladder and restart his life and also have somewhere to have his kids at the weekend. He wants to force her to sell the house, split the equity and go their separate ways. My daughter is not in a position to do this with 3 young children. She doesn't work so even with some equity wouldn't qualify for a mortgage. Whatsmore, she didn't choose to be in this situation. It was his choice to up and leave. He refuses to rent even though he can afford to do so as he see's it as throwing money down the drain. Does he have any legal right to force her out and is she obliged to help him in some way restart his life? Cheers.
  3. I have received a letter from Barclaycard asking me to confirm my details in respect of something to do with my former SkyCard payment break plan. I rang the number and was taken through to the complaints team who asked me to fill out the form and return it. Has there been something in the news about this that I have missed as its all come a little out of the blue? I did have a SkyCard but that went away with all my other debts when I was declared bankrupt in April 2011 (i was discharged in October 2011), and I dont remember having any cover but then again maybe I did. I'm assuming they're contacting me in regards to potential compensation or something. On a related note, a couple of years back I was contacted by Natwest who informed me that I was entitled to compensation for missold PPI, in total they sent me just over £4500. Due to the bankruptcy I of course informed the Insolvency service and they thanked me and told me they would deal with it. Jump forward two years and I recently discovered that the money is still sat in an account in my name but has a no transcation marker on it. I once again contacted the insolvency office and they gave me the same speech as in 2014. Having checked back with the bank however the money is still sat there and seemingly the INsolvency service arent that bothered about taking it. So where do I stand in regards to the money, Is there a period after which I would be able to access it or will it always be theirs regardless of their inaction?
  4. I have received a letter from monument about PBP. It was totally unsolicited, and I have not applied for anything (PPI or the like)or contacted Monument in any way for years. This letter came totally out of the blue and I dismissed it along with all the other letters I have received from them over the years. I ripped it up and put it in the bin. The Short Story My monument account was pulled many years ago , I can't even remember the dates it was so long ago, leaving an unpaid balance of around £3,600 which remained unpaid. The Long Story I have just fished this letter out of the bin as yesterday, I received a cheque in the amount of just over £6,800. The letter I received last week referred to PBP - Payment Break Plan and looks to be a letter of 'without admission of liability'. I have scanned part of this and attached it to this post. It would appear than an adjustment of just over £10,000 has been credited to my account, and the cheque I have received looks to be the difference between the amount of the adjusted credit, and the outstanding balance as mentioned above. I'm just wondering if this is legit or maybe a ruse on the part of Monument to track down their un-paying debtors. I have seen other posts here mentioning refunded PBP - which I never knew I had, but these are dating back to 2014/2015. Obviously we're now at the latter part of 2016, and they 'look' to be still paying out. The letter states they will apply the adjustment values to any outstanding debt from the account, and should this result in your account going into credit, we will issue you a cheque within 28 days - which looks to be the same as others have posted here. I'm not sure whether to put this cheque in the bank or leave it be as I really can't afford to be snared in this way. Any input would be greatly appreciated. Thanks.

Hi , I work for a small engineering company, we currently work a 40 hour week with 30 mins lunch a day unpaid, if the managing director was to agree that we can work through our lunch is this acceptable, None of use use heavy press/ lathes etc and we are able to have a break \ coffee whenever we like Thanks
  6. I am mightily confused. I have been signing on for 12 months, at the start of my claim I signed a claimant commitment stating I will do X number of steps each week to find work, IE look in papers, ask family and friends, use UJM etc. I completed my job search online and always filled in my activity history on UJM, ensuring I recorded X number of steps as required in my claimant commitment. Part way through the year I was told not to use UJM instead I was given a paper template to fill that stated I must do 35 hours job search per week, this had a section to fill stating the time each task took. Some time later I was issued with a pie chart diagram which showed different activities I could include in my 35 hour job search. Now I have been given another paper template form which states I have to apply for and record 10 vacancies jobs per week. What the heck as happened to my claimant commitment, no where in that did I agree to a 35 hour week job search nor did it state when I signed it that it was a requirement. Secondly, I would never agree to applying for X amount of vacancies per week , what if the only suitable vacancies are ones I have already applied for. And now they have just reissued me a new claimant commitment to sign which is basically same as my old one except they have added “ engage with the work program” Can they enforce this 10 job application rule and what is in place to prevent me from just jotting down bogus applications. Obviously I am fulfilling my claimant commitment still but as there is no actual way to record that activity any more am I even obligated to carry it out. From what I can gather the 35 hour per week is only a suggestion and not enforceable as long as client shows they have took reasonable steps they cannot be sanctioned but I cannot find any info at all regarding the 10 vacancies per week.
  7. Hi! I have used the break clause in my tenancy contract to terminate it. It required a 2 month notice period, which I gave and was accepted by the landlord's agency. This means that my tenancy agreement ends by the 25th of August. Nevertheless, my rental period usually runs from the 8th of each month. I have assumed that, if the tenancy contract ends by the 25th I would only have to pay from the 8th to the 25th but the letting agent is asking for a full month rent... He says the overpaid money will be returned and that they do this to protect them from tenants not leaving at the end of tenancy. Is this legal? Do I have any obligation to pay over the end of contract period? Is there any protection for the overpaid money? What happens if I only pay for the period of 8 to 25 of August? Any help would be much appreciated! Thanks!
  8. I had a Barclaycard roundabout 2005 - I have only one statement as proof which shows a balance of £2,156. Account closed due to non payments and sent to 1st Credit debt collection agency in Oct 2006 with a balance of £2,541.90 outstanding. The debt was never settled as I had to leave my job to become a full time carer for husband with motor neurone disease. got a letter recently regarding 'Payment Break Plan' attached to this Barclaycard which showed first 4 digits of the account number, my name, address etc I am totally unsure of how to answer the questions to be successful in getting a refund. I can't remember any details at all BUT what is more annoying is that some time ago, I applied for a refund of PPI charges on this Barclaycard and they told me that they no longer have my account information so cannot investigate any PPI claim. If this is the case, how can they now be asking me about the PBP? Are they lying about the PPI claim? Should I reply with this PBP questionaire (but please can someone help as I cannot remember details - are they trying to catch me out by wanting me to slip up?) If they are asking me about PBP, do they know the details of my account? And should I then challenge them about the PPI claim? I started loads of claims for PPI back in 2006-7 but when our world fell apart with the diagnosis of MND everything just went by the wayside and they were all left half done. .is it worth pursuing them all again? Should I start completely afresh? What are my chances after all this time? It's PPI for 3 store cards (now owned by New Day), bank charges with Lloyds and Santander, PPI with Lloyds and Barclays.... ....help please! Thanks

I'm currently divorced but have recently noted from the divorce documentation that a Clean Break Consent Order is needed to ensure my financial future is protected from any claims my ex wife wants to submit. There are many online websites that can help, for a fee, but I want to do this myself if possible - is there any specific forms I need to complete or download since I cannot locate any on the internet. any help appreciated.

Hi Guys a while ago I recieved a couple of letters from Barclay card in regards to a payment break plan, I threw away the first letter as I have never had a barclay card, after the second letter I called the number & all they wanted was my phone number which I refused to give, threw that letter too but now someone has said that they took over certain accounts & its basically PPI that they want to repay me, can anyone advise, I also no longer have the number to call. I received a PCN from ParkingEye for parking at the Welcome Break Warwick (South) services for 4 hours 40 minutes on the 22/05/20015 I received the PCN today, the 12/06/2015 the Parking charge is £100 discountable to £60 payable by the 07/07/2015 I was completely unaware of there being a time limit to parking there, it was dark and i have no idea if there are visible signs or not. I expect there are signs, but were they illuminated I've no way of knowing, it was dark and late i was knackered from driving back from Liverpool after a full days work. Clearly i did park more than 2 hours as i fell asleep in the car, but what course of action do i take, pay the £60 and take it on the chin?

  13. Can a 'Reply Card' ever be a legal Agreement? Part of my SAR's request came a little photocopy purporting to be 'it'. No details other than my personal ones and a Declaration with Credit Agreement Regulated by CCA1974.....I am applying for a Providian Visa card..... (I can scan it later if necessary). No interest rate etc. Dated Oct 2002. Also, actual statements were not included, only a list of usage and payments made each month (quite adequate for reclaiming charges). But I'm sure I used to see, stamped on my actual statements, something about Payment Break Plan. Of course, I now know that is same as PPI! When I looked in the T&C's (they kindly included a recent copy of these) it had, in small print, that the PBP would incur a charge of 0.89% of the balance each month. Question 1. Is this a 'hidden' charge added to the APR charged each month so you don't realise it's there? Or, should I be less cynical and presume that I opted out without realising?? Question 2. How on earth do you calculate that???! Sneaky or what??!
  14. I had a disputed Credit Card account with Monument and the alleged debt which i disputed became statute barred. I haven't heard anything from Monument for a couple of years, however I received a letter this morning. Dear drob Thank you for your recent correspondence ( I haven't corresponded with them recently) We have reviewed your account and can confirm that yoy subscribed to the Payment Break Plan product. Without admission of liability, and as a gesture of goodwill we are prepared to adjust your account with the fees plus compound interest. Payment Break Plan Charges: £179.04 Account Rate Interest: £86.72 8% Statutory Compensation £35.80 Total Adjustment to Account £408.96 I am just wondering if I should be cheeky and ask for the cash, should they be applying the Payment Break Plan refund as an adjustment???
  15. Hello good people, I'm receiving ESA, the higher element and am also living in a property supplied by my local London Borough costed as Temporary Emergency Housing since my break down in 2012. I've been offered a 'break', a holiday of sorts in Broadstairs on the Kent Coast next month for five days. No cash just a stay outside of town no remuneration. Although I've seen little activity regarding the Council, Brent, checking on my personal occupational life, in Haringey, I don't want to give the paying authority for my HB any excuse to cut me off at the knees! Help and advice would be welcome, Peter. PS should probably have posted under a pseudonym but I'm trying to stay above the radar.
  16. A relative had a Monument card many years ago which had PBP attached. Not sure if they asked for it or not but they have made 1 or 2 claims on it due to ill health. However, if was never explained that they could have sort alternatove products or that the balance never reduced, it was just a 'payment break' during your claim period. The card facility was removed many years ago but the debt is still increasing each month from the PBP premiums being added to it but no interest is being charged. They have received a letter from Monument approaching them to contact them if they feel that they were mis sold the plan. I have claimed on other bank cards but that was 'ordinary' PPI. Does anyone have any idea whether it is possible to claim 'mis-selling' when they have made claims against the policy? If so, how would they go about it?

Hi All, I stayed at a hotel in Basingstoke on Saturday 2nd May and during the night, a thief managed to open the window from the security latch built into the window frame whilst myself, partner and two infant children were asleep. The thief managed to grab my mobile phone and sons changing bag from the window and can be seen on CCTV (cannot make out anything as camera is too far away) I don't have any form of insurance anymore so I am not personally covered however I want to know where i stand with regards to claiming from the hotel. The general manager has told me that their insurance will not cover theft but will pass on information to them. Basically, the security latches on the windows do not provide enough security! I can see how the thief has opened it and could do it myself to any one of the rooms on the ground floor in under 20 seconds. This needs to be sorted by them too

Someone who works for a well known supermarket (think of the colour green) as a delivery driver (for over 2 years) has been having an hour's lunch break deducted from their wages, even though the said lunch is never taken...All this has just come to light recently. Ordinarily if you work in store you have the option to 'skip break' on the clocking machine but being out on the road all the time means they are not in store to do this. The supermarket's internal electronic timing system will automatically deduct a one hour's break if you have been clocked in over a certain amount of time. THe point is, they believe this has happened well over 100 times since they started. Delivery drivers, at least at the store where they work, do not get a lunch break. So what would be the way forward to claim this money back? Even at £7 ph , it's nearly £1000 they are 'owed'. They have tried internal through the management team and HR but they are just simply ignored.
  19. Hello, I'm looking for debt advice (a payment break or the possibility of bankruptcy). I'm currently self employed and have been since 2006, business was good at one time but over the last 3 year my income has slowly decreased to the point where I'm working 12 to 14 hours a day, 7 days a week for very little money. I have tried to find full time work but had had no offers of employment locally in the last 3 years although I have had offers of work 200 miles away with a company I've worked for in the past, the offer of work with is still there. Unfortunately I'm unable to raise the money to pay rent, deposits etc so I can move to start work. I've been on housing association waiting lists for the last 3 years for the areas I've been offered work and have so far had no offer of housing, the employer hasn't been able to assist with housing. I'm 34 year old and live rent free, my home is owned by my parents. The house needs a lot of work on it and I do some of the work in return for free accommodation (I pay bills, council tax and other expenses). They supply materials and I do the work. My parents don't live here, they live elsewhere. I don't have a tenancy agreement or contract, it's just a verbal agreement between me and my parents. I have debts of around £14000 which include about £3600 priority debt (council tax arrears). My non priority debts are all unsecured. I did have arrangements with creditors to make token payments but due to a sudden drop in income I haven't been able to make any token payment for about 6 month. My priority creditor has now tried to arrest my bank account but there was insufficient funds. I fear that they may now bankrupt me. In about 3 to 4 months time my parents plan to sell the house I live in, I have been offered some of the money from the sale of the property to pay off creditors and to relocate so I can move to go back to full time employment (that's if I don't find work locally). What I would like to know is, what are the chances that if I ask creditors for a payment break for the next 4 or 5 months with an offer of repayment in full at the end of the payment break that it will be accepted? I would also like to know, if a creditor was to bankrupt me (or if I choose to bankrupt myself), would my parents be told? (They are the property owner so may be seen as the landlord). Their well aware that I'm in debt but have a lot of problems of their own at the moment (health and non health problems). I don't want to cause them any more worry than they have already. If I were to end up bankrupt (whether voluntarily or non voluntarily) what are the chances I'd lose my car? It's not worth a lot, I bought it for £750 through auction a few year ago, I don't know what it's worth now but have seen others selling for anywhere between £500 to £1200 and seen a few garages selling the same make/model for £1800+ but the cars seem to sit on their forecourt for a long time s o I don't see that as a realistic valuation. I rely on the car for my business, I also need it to help out with parents (they both got health problems and their mobility isn't what it used to be). Apart from my car I have very little other assets and my savings have already been used up paying off various creditors over the last 3 year. My only other assets are a very old laptop (not worth much and has a lot of problems, mobile phone (also not worth a lot), tools I use for business (estimated valuation £300) and the clothes I wear (nothing fancy). Ideally I'd prefer to ask creditors for a payment break with a full settlement at the end of the payment break. If I needed to I'd go for bankruptcy but it would be a shame as I've already worked hard to clear a good bit of debt. The pressure of being in debt and having creditors on my back has had an effect on me mentally and I'm currently on medications for the way I feel. Any advice would be greatly appreciated and I'm sorry for a long post, I'm not that great at writing these things.

The registered keeper has recieved a Claim Form from Parking Lie through Northampton County Court the POC reads; Claim for monies outstanding from the defendant, as registered keeper, in relation to a Parking Charge, issued 00/07/2014, for parking on private land in breach of the T+Cs (the contract). Parking Eye’s automated number plate recognition system, monitoring Welcome Break Michael wood (North), M5 Jct 13/14, Michael wood, Lower Wick, Dursley, Gloucestershire, GL11 6DD, captured vehicle reg.UL1ARS entering and leaving the car park, parking without a valid paid parking ticket. The signage, clearly displayed at the entrance to and throughout the car park, states that this is private land, is managed by Parking Eye Ltd, and parking tariffs apply after a free stay period, along with other T+C’s by which those who park on the site agree to be bound. In accordance with the T+C’s set out in the signage, the parking charge became payable. Notice under the Protection of Freedoms Act 2012 has been given under Sch 4, making the keeper liable. This claim is in reference to Parking Charge(s): 1234567890 end! There is only a date of issue and no mention of date or time that this refers to? Advice please?

  22. Hi all, We intend to enact the 6-month break clause in our AST, as we will be emigrating soon. It seems to be the 'standard' 2-months-notice affair, but the wording has me really confused: Surprisingly, this agreement is not approved by the Plain English Campaign! The tenancy began on the 28th February, so would it then end on the 27th August if served correctly? If so, would I need to serve the notice on the 27th or 28th June?
  23. We need some advice and or help. We got our Samsung TV a few years ago. Recently it has become slow coming on. We googled this and found it was a common capacitor(?) problem and when we contacted Samsung they agreed and organised a free repair. So the TV was still able to be watched. It still functioned as a TV. Then today their repair men came round. They took the TV apart and replaced bits. Then fiddled a bit more. Then the picture wouldn't come on at all and the TV started making a horribly dangerous sounding loud crackling noise. They said the repair had blown the screen. They hummed and hawed, tried to phone their boss who wasn't in because he's on half day today. They laughed when I said they'd killed the TV and agreed they had but Samsung only paid them to change the capacitor and left. My husband immediately rang Samsung customer services to complain. They say it is nothing to do with them, it was a free repair and the TV was out of warranty. We tried to point out it was working as a functioning TV before they sent these two men round to "fix" it. But they had paid two men to come round and break our TV. This went back and forth with Samsung saying they had no idea IF it was working before the men blew the screen. We said we have witnesses if necessary. After an hour of getting nowhere and not even an apology we took the name and address of who to complain to because they wouldn't even let us speak to someone higher up. What can we do? The TV is vital to us. My son is autistic and has a routine which includes certain things he "must" watch at certain times. So we now urgently must go and grab a TV, any TV we can afford otherwise he will literally go a bit off the rails. It's a nightmare on a low income where we are his carers and he is already not very well at all at the moment. We were happy enough with the TV this morning and if they hadn't come round it still would be. I now its a few years old but it was working fine apart from coming on increasingly slowly. If we had never had them come we would not need to go out tonight and buy a new TV. I know it was older and would need to be replaced eventually but not when their repair men came and wrecked it. But what can we do? Have they no responsibility at all? If I paid two men to go to their office and break their computer I would be responsible- no matter the age of the computer I would think.
  24. It states in our Union agreement (contractual) that we are allowed a 30 minute break . (regardless if it is under 6 hours) And this must not be taken at the end or beginning of the shift. The management in our office are making people take there break at the end of the shift . Therefore in our opinion we are getting no break at all because taking it at the end is just us leaving and going home they are basically paying us for the break but we don't actually get to have it , some people are complaining they are feeling dizzy and really hungry for a bite to eat as we work through lunch. we have talked to management about it and they refuse to let us have it during the shift ( so they can leave earlier) it suites them but not us! Plus they go out for an hours lunch ! The cwu are not helpful so we are going down the law route and are filling in an et1 as a joint group thing. Can we sue them? Will we get them in court for this

Hi there, I am new to CAG just joined today, and I am only 20 so please be gentle with me lol I have an ebay account but I recently got made redundant, I have always paid seller fees and I think been a very good customer, obviously with being unemployed at the moment I cannot pay the seller fees. I have a job, but I am waiting for my criminal record check to come back before they will let me start, so anyway I rang Ebay and said you know I have no Job I cant pay these fees that are £40.51. The lady on the phone said well theres really nothing we can do about that you must pay it, I answered how can I pay these fees when I have no job? She said you need to make a one off payment by the 15th of september otherwise we will suspending your Ebay account, I said so what happens when my Ebay account is suspended she said you cant use it and your account will go into the arrears department! I said oh right, so what happens if I dont pay it because I cant? She said and then Ebay will come to your house and get the money at which point I put the phone down, I know from my mum being a member of CAG that they have absolutely no right but im just wondering what do i do now? I cant pay it!
