  1. Hi, I'm new here and so apologies if this has been asked before. I have searched the forums for info on Motormile but have a few questions that I couldn't find exact answers to. Any help will be appreciated. recieved an email informing me that they have purchased a debt and I now owe them the outstanding balance. I actually don't have any problem with that. I do owe it and if I can work out a payment plan then I'll pay it. Questions I have though are this: 1) How likely are they to visit my 'home' address? From there website I can see that the closest doorstep office they have is around 70-80 miles from the address they are likely to have. I live abroad so I don't have any worries about them turning up but it's possible they have my parents address on file. Although the most recent address they should hold is somewhere else. Are they likely to visit 'older' addresses? And travel 80 miles hoping I will be in? 2) Does anyone have a working email address for MMF? Seeing as I am normally out of the UK I can't phone, have no postal address here and I need to email them to offer a payment plan. Or at least seeing if I can get a reduction and then pay the balance..... Thanks.
  2. Hi, please excuse me if I have posted in the wrong area, I had a credit card with MoreThan in June 2004, in June 2006. out of nowhere Morethan stopped supplying my credit card, and the account changed names to Lloyds, and I was sent 2 credit cards in the post, 1 a mastercard and 1 a visa I think. I never signed a credit agreement with Lloyds, when they sent me the cards. Due to long term sick at work and losing my job, I got into a lot of financial problems, and defaulted on this credit card in December 2008. My last payment to them was May 2008. After the initial letters whilst depressed, I never heard anything for a long time, over the past few years, the debt has popped up with numerous DCA's sending me letters, but about 4 months ago, I had a strange letter from Llowels saying they now owned the debt, and have been sending me monthly statements. I am now receiving daily texts, and daily calls on my mobile and home phone from them (my house is currently being sold), so I am not living at the address, so the calls there are not a problem, today I have received a letter from their legal department threatening court action. I have today checked my credit file, and my Lloyds default has been settled, and at the same time, I now have an account with Llowels on my credit account for this. so it looks like 2 bad accounts as well. My questions are, firstly, any advice of how I should proceed. 2) Can they do this on my credit account, My worry is I am moving in with my bf, who is very credit conscious, he knows of my problems from my past, but wants to deal with it for me, but I am scared that contacting them, will mean I am admitting I owe the money and I will never get them off my back. Thank you
  3. Hi everyone, I have a small inquiry and am losing sleep over the matter. I have recently received letters from marston regarding council tax debt which state I owe manchster council. I was a student when i lived in manchester and that was back in 2003 onwards. I moved away from manchester back to my home and now after 8+ years I receive a letter saying i owe about £500 pounds.... and that a bailiff was over at my house... I am confused as when i was a student i fax'd a council tax excemption certificate over to the manchester council and at that point i had already paid a bailiff £400 pounds. Once i spoke to the council back then they told me not to pay him and that it would be corrected even though i had already paid. He gave me a dodgy receipt back then too. I do not know what to do and am needing help please can anyone assist me asap ;;
  4. Hi, I am looking for any help or advice: I ran up a large amount of debt more than 10 years ago on a Barclaycard, after my business failed - I tried to pay it off over a few years, but with all the interest charges, I found it impossible and gave up - with the last payment / default @ July 2008. The debt with Barclayard was just over £15,000 (!!). I buried my head in the sand for the last 5 years after searching the internet a few years ago and satisfying myself that the debt was un-enforceable and as such have never replied to any of the multitude of phone calls and letter received from many debt collectors over that time. Of course, I now realise that this is probably not the truth! A few months ago, I started getting letters from Lowells, Fredriksons and now Bryan Carter. I checked my Experian File and noted that Barclaycard wrote off my debt last year / sold it to Lowells (without notification). The letters of the last couple of months have been quite aggressive, leading to the last letter, where (on Bryan Carter headed paper), they are notifying me that if I do not pay in full by the 26th August, they will issue court proceedings. I have had these types of letters before - but this one seems to be worded differently from the usual we 'may' issue proceedings. Needless to say, I am worried, as I have absolutely no means of paying this large amount of money. I have so many questions (sorry!) to anyone who can help. On one hand I am tempted to just ignore it as usual and see if they actual issue proceedings. On the other - after reading about these jokers - I have started to think about what if they just try for an uncontested CCJ - especially if I never reply to anything. Does anyone have any further clues as to how many of these letters from BC actually end up with proceedings issued? The amount they say I now owe is £16,078 (which is more than what I owed Barclaycard). Does anyone have any suggestions as to a next move (if any?). Do I send a 'prove it' letter or a letter saying I have no clue about the debt (after all - I have not idea where they got the actual amount from). Any help of advice would be most welcome and thanks in advance (sorry for the long rambling post!).
  5. My family member has goods out on BH and now owes the just over £30 a week!! they told me today that BH have been calling out and threatening to get in to house to take goods back. I have told them to SAR as they have many DLC/OC on the accounts, im wondering if they stop payment and make a token payment to them as they are now financially struggling as they have lost their job i know BH will throw a tantrum the store manager is prone to calling police out to customers who don't make payments and of course because police are not trained they just say please pay or allow them to take the goods, i personally think it there way of getting in the house.
  6. Hi All, Read on the forum that the OC's and DCA's are becoming very litigious of late. Was wondering is there any particular reason for this or is it the way forward for them.
  7. Hi there, My first post so please be gentle! The usual story, lost my job, got into debt with several companies, of which they are all mostly cleared now. I still however owe Green Energy over £800, incurred during the winter for heating and from previous missed bills . I have massively decreased my electricity usage since getting into trouble to around £30 per month, and started paying them back £60 per month. However, they wanted me to setup a Direct Debit for this which at the time I said was fine and to send me the forms. However since then I had several large unexpected bills that automatically went out via direct debit, and pushed me back in debt and caused me overdraft charges. As a precaution and to prevent a repeat, I canceled all direct debits and now pay manually and informed Green Energy that I would pay manually before the end of each month after they started chasing me for DD forms. They are aware I am on extremely low income, and I informed them that I could not guarantee when cash would be available in the bank for automatic payments, and could not risk further overdraft payments making me fall even further in debt. The reply I got back from them basically threatens me, and they are trying to force me into automatic payments. My question was, is it legal for a utility company force you to use a DD even knowing that it could cause you even more debt? Can they refuse a payment plan by me not paying by DD? I understand they are just trying to make it easier for themselves to collect payment, but it really will cause me hardships if I go into overdraft again as I can barely keep up with current outgoings. Below is a copy / paste from the relevant parts of the email: ------------------------ "I did make the agreement of £60 per month on the understanding that you keep your usage under £30 per month and that you make your payments by direct debit. As you do not wish to pay by direct debit I am afraid the agreement we made is not possible. Your current arrears is £834.36. If you can make a lump sum payment of £400 by the end of August then I can accept monthly payments of £60 per month via any payment method if your usage remains low. If you cannot commit to this a direct debit will have to be set up by Friday 30th August and I will require a manual payment of £60 by then to cover August’s usage. The direct debit can be on 15th or 25th of each month with effect from September. If you fail to act on either of the above the full balance will immediately become due. ------------------------------------------------- Thanks
  8. Hi, I recently received a letter from the above stating that they have been instructed by Fredrickson international on behalf of Lowell Financial to issue court proceedings for a debt of just over £400. Lowell have this debt registered on my credit file, it was for three mobile. I defaulted in Nov 2008 for £86. The default amount is registered as £86.00 but the balance is shown as £437, how is this possible?. I was paying all my creditors a token payment of £1 per month up until July 2012 when I was told not to by the money advice charity because we as a family did not have enough incomings to cover priority debts let alone non priority. Do I ignore this as a threat or do I send a CCA or SAR because I suspect they will not be able to produce either.
  9. Hello. I'm Dan. I took out a payday in Dec 2012 for £100 with a company. MMF had been chasing me since then. I don't have the money to pay since falling into the sick ESA trap. I have has numerous calls and texts, then letters to the point threatening to 'visit un announced' Today I get a call from 'Mr O' in a deep threatening voice along the lines of 'Call us or i will be there' I phones up and complained to argue with 'muppets' to tell me, you took the loan out, pay us NOW. I did not agree with the way I were spoken to, so they ended the call. I So then called police and have a crime reference number, Then called FOS and registered a complaint and then to OFT, who can't do sh1t unless enough complaints come around to look at the in the "next review"? So these calls from Mr O (to which they are under the OFT can do this) Just ignore them ok. They can't do anything. My concern is that, if 'old' people are threatened by these, they must be scared. MMF told me 'old people don't take loans' Please sort this..
  10. Hi Few months ago i borrowed a loan to pay for my car as it was in the garage and needed the extra cash to pay for it as i rely on it for work, i have always had loans not with payday firms but with banks etc, Last month i came out of work due to redundancy and still waiting on my redundancy money from the firm i worked for for 10 years. Obviously now i have screwed my credit rating but thats the last thing on my mind, i borrowed £150 off these idiots back in May and made contact with them as soon as i received my redundancy letter which was in the middle of May i had no reply off these people whats so ever i have emailed dozens of times and still no response off them, 4 weeks later this person called Zen Young kept pestering me by text message and email until i give him a mouthful which he didnt like and told him its not the fact your chasing the money its the fact your now emailing me with threats after i gave you plenty of time about my current situation. He told me to fill out and I&E which i glady did and only offered the minimum until i land back on my feet as now i can only claim JSA and all that goes on bills. I filled that out 3 weeks ago and heard nothing off him emailed them a further two or three times and still they do not respond. I have always been told only speak to them by email, i feel that i am getting no where with these cow boys they ring me about 4 or 5 times a day spam my phone with text messages here is the last 3 i received. They claim that they want to help you but actually make your life 10x harder with all the grief you get. Are they allowed to just send a collection agent to your door without sending it to a DCA first ?, i feel i would get more sense and a response out of a DCA Is there anyone i can complain to as i now sick and tired of threats and constant phone calls and text messages, i have tried my part they dont seem to cooperate.
  11. Hi there, I received a ticket for parking in the wrong zone at a hospital as I couldnt see the small sign post and it was my first week there. I received a ticket and looked online and everyone said to ignore it. 3 months down the line and I am very anxious and stressed about letters I am receiving from debt recovery plus. The letter states they are offering me a reduced price to avoid court proceedings and they want to commence court proceedings. The letter states they are offering pre action protocol and have given me a week to pay £120. it says if i do not pay they amount will go back to £149 and also £30 court fee, solicitor cost of £50 and interest at 8%. I dont know what to do as there is so much information online about this, also another factor is the car is not registered to me but a family member as we share it. Any help is appreciated AnxiousP

  13. Hi Guys, I could really do with some advice on how to deal with DVLA/Intercredit. In the past month intercredit have sent me a few letters to my home address which I moved to 18 months ago stating I had ignored DVLA attempts to contact me, I have not heard anything from them and they knew where I lived as I updated them previously. Basically they are demanding £80 within the next 72 hours (again) with threats of going to court if I don't pay up. The car they are talking about was supposed to have been scrapped march 2011. At the time I had bought a new car so the guy knocked £100 off the price because he was going to scrap my old one for me, It was literally falling apart. The V5 was filled out then sent along with the V5 for my new car, I received the new V5 around 7 weeks later after chasing it up but I forgot to check the other one had been removed from my name So it seems that they had received it because I had the New V5 but I cannot prove they were sent together all I have is the receipt for the new car. I'm a little concerned as to where the old car is because according to DVLA it's not scrapped with Liability date of 1/08/2012 Is it worth me trying to challenge it?
  14. (I'm assuming that the good people of Roxburghe are watching this thread, BTW!) Hello, I have just this week recieved a letter from these characters regarding parking issues that happened in 2012. I'm not going to give too many details as I would rather my case was not able to be identified because of the possibility of you-know-who watching! They are offering me a chance to pay, in the absence of which they will consider legal action against me. Apparently their solicitors have also written to me but this letter is the first I've heard of any problems. Usually I would ignore these people, but given the threads regarding court cases I thought I should get ahead of the game. They request that I phone them to find out how much I need to pay to avoid legal action. They suggest that I do not ignore the letter as it is in my best interests to pay. What do you recommend as a good next step? N.B. I'm happy to defend this should court papers be issued, as the place the so-called infrngement tool place was free parking anyway and blah blah blah. Thanks!
  15. I am disabled and my husband suffers from PTSD to the extent where he is continually getting worse and I have been told he will always be vulnerable and very unlikely to return to normal. I Now have to pay 25% of my council tax, I cancelled my husbands doctor appointments and my hospital appointments to be able to pay the first month albeit four weeks late and ten pounds short. I managed to get the second months payment together with the arrears of ten pounds from the previous months and paid this although again it was a month late I have informed Cornwall Council that I will pay and how much and when each month, however I yesterday received a notice from them stating that they want the full amount within seven days or take the matter to court and instruct the bailiffs to act thus incurring more charges, they are already taking money I cant afford and for the sake of four weeks I think they are being very unfair and aggressive as they do not want to take our circumstances into account even though we are not refusing or trying to avoid payment, any advice please will be most welcome
  16. I was due to be evicted tomorrow morning but managed to get it suspended after filing an N244 and attending court this morning. This is the 5th time that I've been in this position although only the 2nd time I've actually been to court, but the hearing did not go as I had expected and I think I came within a hair's breadth of losing my home today. If it happens again in the future, I will need to request permission from the court to appeal the eviction and the judge made it clear that this was my last chance. I've only had to go through this 4 times previous because Halifax have threatened eviction each time I've underpaid or missed a payment - even though I've kept them in the loop and the reason has never been a total inability to pay. I provided evidence that I was able and had been able to maintain payments towards the mortgage and the £12,227 arrears. I arranged to pay £700 per month which is £90 towards the arrears each month but the judge felt that I was just getting myself in even deeper and he stated that my case was marginal. I can keep up payments but is there any way to get the suspended possession order cancelled after a period of time?
  17. I have an agreement with EON to pay a monthly amount with a payment card every month, this agreement has been going for 8 months with me making my payment on the day every month without fail, paying a total of £1,530 Gas and £1,092 Electric in this time. However over christmas i was rushed into hospital and have 2 operations, during this time i missed 1 payment and was late for another, however, despite the fact i was now not working and am a single parent, i managed to catch up with my payments and am now fully up to date with all payments at present, despite this i have now recieved a visit from an EON debt agent, adding £55 for this visit, and threatening with breaking in to fit a prepayment meter and even changing my locks with a locksmith, and various other threats of extortionate fees, i am totally disgusted with EONs actions and complete lack of customer care, i am now ready to forward a complaint to the energy ombudsman, how can they behave in this way to such a vulnerable person? how can they justify adding £55 for an agent to hane deliver a letter? is this reasonable costs?
  18. Hey, I was wondering if you could offer any advice. I've had a Very account for several years that I haven't been able to keep up repayments with due to work being hit and miss. It is currently with NDR Money who started off by demanding £80pm off me and now more recently £140pm with hardly any cash coming off the account itself after interest/charges. I couldn't afford this so I was just paying them what I could afford £10/£20pm. I logged into my account on Saturday to make the usual payment and noticed that strangely I had been credited the following amounts into my account: Refund Administration Charges £348.00 Interest Charge Amendment £1,388.13 With the balance leftover being £316.00 I figured to just to wait and see what my statement said but lo and behold a letter came in the post today stating the following: Dear CJ87, Default Notice Served under section 87(1) of the consumer act 1974 Running account credit "we refer to the above agreement which you have entered into with us. The Payment Clause of the agreement provides that you must make the required periodic payment in full by its due date." "You are in breach of that clause because you have failed to make all your periodic payments in full when due, and arrears amounting to £1262.42 are outstanding." "To remedy the breach you must pay us the total arrears by the 9th of February." IF YOU DO NOT TAKE ACTION REQUIRED BY THIS NOTICE BEFORE THE DATE SHOWN THEN THE FURTHER ACTION SET PUT BELOW MAY BE TAKEN AGAINST YOU. Further Action: "On the date shown, we shall require the outstanding balance on the account, less any rebate allowable, as set out below." Amount outstanding:£2059.77 And so on and so fourth. There is just no way I can afford this. I would be very grateful for any advice on what my options are. Over a grand in charges/interest just seems like robbery to me. Sorry for writing a book but I figured I'd best give as much info as possible, Thanks in advance. Chris
  19. hi there I have lived in this rented house for 3 years, I have had escalating bills for the last year and a half and even tho I came to agreements to pay, after every review they became so high I now cannot afford to pay what they are asking. The origonal debt was £258 and is now £1200. In between all this added debt, I was trying to set up an AFFORDABLE payment plan, they would not accept what I had coming in and what I could afford to pay out so I wrote a letter complaint to one of the directors of NPOWER and agreed to accept my payments. It was all ticking along nicley and then my JSA was stopped because I went into hospital and they changed me over to Employment and Support Allowance, which in turn affected my rent payemnts etc. Then out of the blue with no warning NPOWER merged both my accounts for GAS and ELECTRICITY. Instead of paying two direct debits they now tried to take the whole amount out at once in Dec 2012. Back to square one, letters threats of entry. They have tried telling me I need a meter fitted, but I can bearly afford to heat the home now, without the added cost of the meter billing. Plus I am a private tennant, the landlord has told me he specifically does not want a meter fitted. The reason they were separate in the first place was if one DD did not go through I could easilyring and pay over the phone, but with the JSA mix up and the ESA payments be lower than JSA I could not afford to pay the DD. Any idea what to do next please all help would be greatly recieved.
  20. My son has had a letter from EDF demanding 150.00 or the baliffs are coming 17th December to force entry. They have not read the meter i over 2 years and just provided estimated bills h e has being paying them around £40 per month and now this. I dont know what the correct bill is because it has been left for all this time, I guess it is partly his fault for not being on the ball. He is on benefit and cannot pay them anything untill the 26th when his benefit is due. Don't know what to do when they arrive. Any advice would be appreciated. Regards, Mashmallow
  21. Hello, I'm so worried and slept very little last night DLC bought the debt I had with MBNA, and along with lots of other creditors I have been paying a fixed amount each month and never missed a payment, they called me last night wanting to take my £5.00 a month to 1 percent of the balance which would make a payment of £85, I told them that I have little to money left at the end of the day and am paying off 11 other creditors, they say they will now go and get a charging order and force the sale of my home, at my age I will never get another mortage, I feel sick to my stomach. Any advice would be greatly recieved I have called the old CCCS and they have made an appointment for me to speak to someone in regards to a possible IVA as I have been juggling all this debt for two years and am shatterd by it and the late nights calls.
  22. I had appeared in court today and lost a fast track claim, unfortunately for whatever reason a costs order was party granted to the other side. The costs order is for £13,500 - as I was leaving the court I was approached by the other sides council and was told that they will enforce it and take it all the way to bankruptcy. In terms of background I only have two assets, my home and my car, nothing else and I don't have any money to pay the claim whatsoever as I haven't paid any court fees either. I just wanted to find out what I could do? Any suggestions?
  23. Hey all , Its understandable a company you owe money to can get frustrated , but there are ways and means of getting said money and i want to know if the person that's spoken to me has behaved in a disgusting way. My partner is my carear and we went with a buy as you view for a washing machine and a dryer , im writing this on her behalf to see if there's anything illegal about the gentlemen's actions from buy as you view. We started falling behind with payments a few weeks ago , around 90 pounds or so most of which is charges for making a late payment in retrospect we only owe 40 pounds minus the charges. Now we have had no issues with the direct debts before now as we dont see it leave the account. But lately we had a few issues which stopped them being paid for a few weeks. With this being the only issue we have ever had with the company we thought they would allow us some time to get the money together to clear the arrears, they said it was fine. The day we set to phone them up and make a partial payment them there was a knock on the door. It was a gentlemen from buy as you view demanding the full amount , my partner explained that would be impossible to do as the weekly budget has already been set aside and we cannot adjust it to the amount he wants as we already came to a agreement with the company over the phone. He started rambling on about how he was going to enter the property and remove the products from the house there and then. Now at present my foot is broken and as i suffer from a number of mental health issues , i didn't think showing my face and getting myself into trouble would be the best idea. So i decided to call consumer direct and they where about as helpful as a chocolate teapot stuck up stairs and having my partner face this clearly ignorant man , i had no choice buy to allow her to use my card and i could clearly tell this man was intimidating her , he even went to the trouble of causing his manger then his manger starts to guilt trip my partner *I quote* We thought you could afford the products why are you letting us down by not paying*. When i shouted down to my partner he cant enter the propertie its illegal , he shouted up , IT ISN'T. Now this happened around a week ago , and we now have a regular payment going back to them to clear the small debt. But i want something done to this pig who made my partner feel like this. Its still bothering me now and i very much doubt its going to go away until this bloke is dealt with. Thanks for reading.
  24. Am sure this is covered somewhere but when it affects you that fear sets in...and I need your help - Had a default on card account from almost 6 years ago. I was ill at time, went through hell and have never recovered. The default is recorded as Nov 2006 but there is a ''updated record'' in 2010 showing on my credit report. I have seen letter over the years, but not been able to pay anyway and have ignored. Will the six years be up this year or from the ''updated date''The letter threatens me with solicitors, court action, visits, bailiffs......can they do this? I am scared to leave my home, scared to answer the door, never answer the home phone.
  25. hi, i am new here but already reading everyones advice has helped me out loads with different issues over the past few months. This is one that i feel i am stuck with, and i need your help to figure out how to stop this, or at least stop it going the distance. at this point, as much as it pains me to say they have worn me down and i would ok with paying a fine if it meant it keeps my record clean (i teach kids sports after school and having a clean record is important to me) I'm being bullied by TIL (same as other people) except that this is only occuring because the station i boarded the train on (cross gates) ticket office closes at 2pm and the train was packed as it was a delayed service so when i got off at wakefield westgate i approached a person in a high vis jacket to ask where to buy a ticket (as i needed the return to leeds later) who turned out to be a RPO! he stopped me from buying a ticket by starting these procedings. he told me i would recieve a letter asking me to pay the ticket in 14 days and i left the station, angry but appeased at the same time all of the finer points of the story is contained in the scans of the correspondance between TIL myself and the other person i was travelling with, I need to know am I on the right course? do i need to change tact? is there anywhere else i could go to get this sorted? how far can i take this without risking court/criminal sentence? if you have any questions about my side of things then i will be checking back regularly to keep you informed. 4 Our Letter 2.pdf Thanks in advance guys 4 (1) Correspondance.pdf 1 Correspondance.pdf 2 Correspondance.pdf 3 Our Letter.pdf
