  1. I've just received an offer of compensation from Lloyds on a Credit Card I held from 2000-2004. The offer is for £970 plus just over £1000 interest. ... (this being 3 years after they said I didn't have PPI on the card) I'm thinking that this is very much south of the actual figures involved, seeing as, when I closed the Credit Card Account in 2004, (by re-mortgaging), the balance was at £21,000, which was systematically built up over the 48 months, so roughly by £500 a month from account opening. Any thoughts as to whether I should attempt to get CC statements for the period and refuse this offer ? Many thanks
  2. Hi. Long time since I last posted on CAG. I am hoping someone can help me guide my Brother. He had a loan for £1000 way back in 1991. PPI single premium was added making his total loan £1,112. He still had his original loan agreement which made it very easy to fill in his claim form for missold ppi. He originally had gone to his bank to take out a pension plan with scottish widows (still running) whilst there he was encouraged to take out a loan also. That was his first and last loan! On to the misselling of ppi, when he called back into the bank to sign the paperwork for the loan, the form had been prefilled. He hadnt been given a choice on taking out the ppi. he states that when he questioned the figures prior to signing it was only then he was told it was required for the loan. lloyds letter just consisted of a breakdown of his ppi figures and conclude that he is entitled to a refund of £6.33 including interest. Im a little bemused and wondered if I should be doing a spreadsheet to include 8% interest? Any help would be greatly appreciated Thanks in advance P.S The offer letter arrived Thursday and the cheque arrived this morning. Quick service.....
  3. I recently made a purchase ONLINE, live, gold bullion. I have used the regulated company & site many times before. pressing the CONFIRM button . it requires acceptance etc, that clearly states the order cannot be CANCELLED and payment is immediate by debit card. it is VERY clear that this contract is exempt Regulations 2013 regulation distance and off-premises because of LIVE fluctuating prices. PRICES ARE FIXED upon confirming, which I did, and is a in STOCK items. I receive the confirmation of ORDER , and acceptance of order also confirmation of receipt of payment ALL 3 By email. However the fluctuating OFFER price was a lot lot lower than usual .But the gold markets where very volatile (e.g. in 1min GOLD price fell 5% Lower, though I did not know this , till later,) but I made the decision to purchase. and I was very very happy. Please could you advise me if the well established bullion online regulated trading company, can now, cancel my order. and just refund my payment. Briefly citing it was an live OFFER price ' error ' due to technical /software glitch. and stated I am taking advantage of them. and if I continue the argument they will hand my case to their solicitors. please advise, many thanks graham young
  4. Sham one folks, please see below a copy of a letter I received from Lowell, I did start to pay this debt via Payplan before I found this forum. The debt is a credit card with Capital 1 for just under £400. I stopped paying and told them I wanted my CCA and my SAR which I still have not received, I was hoping somebody could advise me on what my reply should be, I am also pretty sure that they should not encourage people to pay by credit card e.g., Encouraging people to take out more debt. I also have the same letter regarding an Egg account even though the CCA they sent me is not valid We are disappointed that you have failed to keep up to your payment arrangement that you promised you could afford to repay. We can only assume that this means that you are either UNWILLING or UNABLE TO PAY. If you are unable to keep to your repayment plan or are unable to catch up with your arrears, then we may be able to offer you a greatly reduced settlement discount to clear your account. Should you fail to make contact with us we will assume you are UNWILLING to keep to your previously agreed arrangement and therefore we will have no alternative but to send your account to our legal representatives, Hamptons Legal. We do not wish to take this action and urge you to contact one of our advisors on the following number: 0845 279 7117 PAYMENT CAN BE TAKEN OVER THE TELEPHONE BT DEBIT OR CREDIT CARD
  5. I decided after many years being with my Bank to re-claim all my bank charges over a period of years!! today i received a call from my bank in regards with what i was asking for, the lady on the phone sounded quite vague and then by saying that they could only refund me partially my charges for 6 months??? So then i refused it and i told her to put it in writing what she had offered me,i told her i disagreed with her offer and i will be taking this further. Can anyone advise what i need to do now? thanks
  6. Hi, Received an offer from the coop bank to settle my PPI claim but their interest calculation seems way out from what I think it should be. They've offered a refund as follows:- PPI premiums paid = £2,098.70 Card Interest on premiums = £1,478 8% interest on notional credit balances = £1,068 Link to my calculation sheet (extract) is below; can someone check if the coop are being fair and my calculation is wrong, or is my calculation correct http://jmp.sh/v/fjUmMLllLhjN1syQzm9S
  7. Hi I have been offered a full refund on a faulty item I bought but I would prefer a repair. Do I have the legal right to turn down the offer of a refund and demand a repair? Thanks.
  8. I took out £200 loan with wage advance just after Xmas. My monthly payments are £72 approx. I telephoned today to offer a full and final settlement and my offer was declined because not in arrears. I explained my circumstances have changed. The only offer they made was to force it into arrears and redo an affordability assessment and then make 6 payments . Every payment made is interest only the final payment is the loan amount plus interest (£272). Any advice appreciated

  10. Hi all, i usually read the forums but dont post but i got a letter you might all be interested in this morning, i have received a letter from Wonga this morning re: historical debt collection practice. I have had the usual "you were affected" emails ect but this one actually offers compensation and refund. Its a low offer of £56 pound but they are also enclosing forms to request an individual assessment where they are asking what difficulty you incurred ect because of this, evidence of other loans i had to get out due to pay them back. I was at one point in deep to payday lenders and have in majority paid them back (one still on my dmp) so was wondering if you guys think i should accept the offer.
  11. Hi, I've been dealing with debt collecting agency by letter, regarding monies I owe, and can't pay back in full. I made two offers to pay the debt as "Full and Final", they accepted my second offer, and I have now received a letter as shown below, please can you advise me on whether to accept this, kind regards. "We can confirm we are willing to accept your offer of xxxx in partial settlement of this debt. Once paid, you will not be pursued for the remaining balance by us or any other third party. Once the account is settled, our entry on your credit file (if there is an entry) will show as 'partially satisfied' defaulted account with a zero current balance."
  12. Hi, I'd really appreciate some advice on how best to tackle Ladder Loans. In summary I borrowed £2000, have missed a few payments but even so have paid them more than £4000. I'd now like to know whether a full and final settlement is the best option, or whether I can fight this and pay nothing more The details are as follows: 1 - Ladder Loans is part of Inventive Finance Ltd, which I've found out runs a network of payday lenders. I was offered £2000 in July 2013 on an 18 month repayment schedule 2 - The APR per annum is an eye watering 299%, meaning that according to the CCA (which I now have), I agreed to pay them £5031.36 for that original £2000! 3 - I made 15 payments of £279.82 on time, so I've already paid them £4192.80 4 - Due to further financial difficulties (problems with my business), I missed payments no 16 (end Nov) 17 (end Dec) and what would have been final payment no 18 (end Jan). They've added £12 penalty charges for each of the missed payments 6 - They've never written to me about these missed payments or about adding penalty charges, I suspect they have been trying to call my mobile though. I asked for the CCA about 10 days ago and it arrived on Friday. I'm now thinking of doing one of two things. 1 - Offering them a final settlement on the £862.56 they say I still owe, to get them off my back Or: 2 - Making a formal complaint and seeing if I can eventually take it to the FOS. I'd base this on them adding on penalty charges but not writing to me as well as the fact that I already paid them more than double. Am I correct in thinking that payday lenders can't now charge more than 100% of the original loan? Or did I read that wrong? Can a hugely inflated interest rate be challenged? I'd really appreciate which is the best of the two routes to go down. Do I have a leg to stand via the complaints route, or would I be best just offering maybe £300 (so a third of what's still owed)
  13. Hi has anyone successfully gone to their current employer, saying I have a new job offer, and result being you stayed with existing employer, because they convinced you it was worth sticking around, and they did not want you to leave ? (possibly they offered you more incentive to stay too) what would the best approach in informing current employer that you have a new offer on table or were you simply wished bon voyage ! Shown the door, so to speak as a percentage, what would you say most companies would do ? try to keep you or throw a party (appreciate there can be a multitude of reasons dictating what action a current employer would take)
  14. Dear all, I had an interview for a team manager position in a learning difficulties service charity organization on the 9th of March 2015. The employer called me later in the day and offered me the position which i accepted. The employer sent me the conditional job letter offer. The HR manager called and emailed me, before they received the references, saying that "unfortunately the job position was withdrawn because the funding to support the job was not more available." If it can be useful , i am adding this information- I am aware that my current manager knows the new employer`s manager and that the two different organizations are based in the same borough.Should i be suspicious about my current manager as she might have spoken over the phone with the new employer`s manager before sending out the reference? Now, how can be possible that after about 3 days that the references went out the job funding was not more available? Should HR have had the job funding approved before adverting the position on The Guardian? Can i take any legal action? Any suggestion will be very much appreciated. Charlie
  15. Hi all, Back after a long break, good to see some of the old familiar names are still here.... My OH has a very complicated credit history. Lots of accounts are being paid off under a plan which was originally put in place by CAB, then taken over by me once i discovered CAG. She has just received an 'offer' from our good friends at Lowell - a discount of 75% to pay off an old bank debt. on receipt of payment they will 'update your credit file to show the account as partially satisfied and we will close your account'. Now, would I be right in thinking that 'partially satisfied' is absolutely no use to us, and we should ignore this offer like all the rest? Just to avoid the obvious questions, this loan is certainly pre-2007; we are not currently paying anything, and i don't remember without digging into the mountain of files when the last payment or acknowledgement was. All i need is an opinion on the 'partially satisfied' gambit.
  16. hi all I had a vist from a swift bailiff for a unpaid tv license fine 2 days ago who said he had a looksmith on the way. I did not let him into my home as I came home from work and he was sat in his van outside my house and he told me I had 1 hour to find the full payment of 650 pounds witch I just cannot afford I made him a offer of 100-150 pounds a month witch in no way was he going to accept and kept threating me with removal of goods from my home within the hour until I saw the letter he put through my door before I got home witch stated I had 24hrs to pay he was not happy when I pulled him up on this so he left saying he would return in 24hrs if I had not contacted him with the full payment then he left. I then phoned swift to try an sort something out with them but was told by the first person I spoke to too explain my circumstances and he should be able to help me. so I rang him back and tried again but he just kept saying I would not be getting a payment plan and I had to pay in full amount by the time my 24hrs were up. so I rang swift back and ask to speak to a higher person in charge. when she came to the phone her first words were hello I can only give u the same advice my colleuges gave you to witch I replied so u will listen to me but not help me to witch she replied correct so I hung up the phone. so I rang him back up the next morning to inform him that they was no way I could pay fine and explain I have 4 children and a disabled partner and that id spoke to varous people regarding this matter such as citizens advice the courts and his own company with all more or less saying he could help me out if he wanted to it is in his hands. he replied by saying I thought u was a genuine person and thought I was going to pay and that I just said I was going to try to sort out to get him from my home and then ring him and say I was not going to pay. this made my slightly angry as ive tried my best to come to a solution even saying why would I ring u to say I cant pay if I was not trying to sort out to wich he replied listen I don't care what citizens advice the courts or any body has to say you will pay the full amount or ill be back next week to remove goods. so I told him u are supposed to come back today when then 24hrs are up not anytime he feels like it I just want this sorted. he said no ill come when I want to. ive been told by varous debt advisors not to let him in and get it reffered back to court but I no he can just get a locksmith and just enter my property witch ive been told nine times out of ten they wont do because they have to pay a locksmith there and then out of there pocket. i just dont no where i go from here im making offers but just wont aceppet any of them
  17. Hi, sorry if i havent posted in the correct place. i have applied for a mortgage everything has been accepted subject to a valuation. we are buying a house of my inlaws for about £35000 less than its worth. valuation was done this morning, my mortgage adviser said he will chase them tomorrow and then wait and see what they offer. what i want to know is...what does he mean by offer? i have been told that i have been accepted subject to valuation and have even received paperwork advising me of costs and monthly payments direct from the Halifax. never bought a house before so just worried, can it go wrong now? thanks
  18. Hi Just looking for some advice. I have a debt with Very. It's balance is £8500 although not sure why I'm assuming intereest and charges. The last few months I've been getting letters from ARC Europe asking me to contact them which I havent. Today I get another letter saying their client is willing to offer a very reduced settlement if I pay within 35 days. Is this normal. Why would they accept a reduced offer. Thanks
  19. I have a joint Halifax account with my ex which is still open but not used. I have highlighted £100's of charges in my statements (mostly missed DDs), going back to 2006. Can I reclaim these without his consent? If awarded a claim I would lodge the cheque in this account. Also, we separated 2 years ago, have 4 kids , and £1,000s in debt in credit cards (paying an agreed £50 per month) , and unsecured loans (which are in my name). He contributes nothing to the upbringing of his kids, and I am left to pay the mortgage and insurance etc. do I state these reasons of "Financial hardship"on my claim letter, or just claim that I believe these charges were "disproportionate"? any advice welcome.

  21. I'm asking for advice on behalf of my partner. He has a 3(ish) year old debt with Orange regarding a contract mobile phone he took out. He took out the phone/contract then after a few months sold it as he was struggling to manage his finances and stopped paying the monthly bill. He was repaying the debt via his DMP with Step Change as it was passed to a couple of DCA's. It was passed back to Orange/EE a few months a go and Step Change were unable to make the repayments. He rang Orange/EE and asked for details to where he could repay his debt as it is included in his DMP but they said he would have to wait for it to be passed to another DCA. Low and behold, he still heard nothing. Eventually, he rang Orange/EE again last week asking the same question and was told they would accept a settlement of £31. They said they only wanted to cover the cost of the handset. I told him to repeatedly ask them if that was a full and final settlement and them nor any other organisation would enforce or pursue for the remainder, and he would be free from any liability. They agreed to all this on the phone but were pretty sketchy when he said he needed confirmation and agreement of this offer in writing. They did say they would send a letter but as yet he has not had anything, and I don't think he will. Obviously, I've told him the importance of not making any payment until everything is in writing. So he has written a letter but we cannot find any postal addresses to send it to. Does anyone have a postal address we can send this letter to? What happens if we cannot find an address, therefore cannot send the letter, and he receives no letter from Orange/EE? What happens if they do not pass the debt on again so repayments can be started again? I'm worried of nothing happening for months/years then a letter through the door from a court. What evidence would he have that he has tried to repay? He definitely does not want a CCJ and he would not be able to repay it off in full within 28 days, if it did go to court. Honestly feel like I've hit a brick wall with this one.
  22. Hello, In 2012 a drunk driver crashed into my car and I had various injuries. There is a dispute with the third party insurers on the amount of compensation requested by my solicitor which they set at £48,000. The insurers have admitted liability, although a court date is set for March. My solicitor had stated that they would make an offer before going to court and I have now received a formal offer of £11,100 in the form of a judicial tender ! The letter advises that if I decide to go to court and the judge offers the same amount or less then im liable for all expenses which could be £40,000 plus I have made an appointment with an advocate for next week to discuss options. Obviously its only myself who can make the decision on where to go with this but has anyone else been in this situation where they have escalated this to court? Ta
  23. Hi. I'm hoping someone who knows what they are doing can help with some advice, on the next steps I should take in relation to my complaint for mis-sold PPI on a Credit Card with NatWest. I've received a Final Decision letter from RBS which upheld my complaint, and making me an offer in redress. I was a slightly confused as to how they had arrived at the figure, and so contacted them to request a breakdown of their calculations, particularly in relation to the compound interest part. I've attached a word document (Letter From RBS NatWest.doc) which contains the wording I received in response, along with their "breakdown", which to me seems to be of little help in providing clarification. Now that they have finally told me (it wasn't mentioned in the original Final Decision Letter) that they are "guessing" at some of it as they do not hold the data further back than 2001, I'm planning on providing further evidence in the form of some extra statements that I have found for months prior to that date. Whilst not fully completing the picture, hopefully it will help them to come to a more exact calculation. I've also attached a spreadsheet detailing all the amounts that are known, and where there are unknowns (those cells highlighted yellow, for months marked with an 'x' in column A) I've added in a nominal calculated figure to make the sheet work throughout. I'd appreciate it greatly, if someone could take a look at the spreadsheet to firstly check that I've completed it and the compound interest and statutory interest is worked out correct, and if so, then secondly that the numbers that I've added make sense, and are suitable, or if I should do something else to fill in the blanks. Finally, I noticed that on the spreadsheet that the interest stops accruing whenever no monthly payment is made for PPI (I finally got them to cancel it after a long fight earlier this year), and I wondered if someone can just confirm that this is right, or if the interest would continue whilst the credit card is still in force and the whle sorry tale has finished? Thanks in advance for your help.
  24. Just had a letter from FOS upholding my claim against Capital One, it was rejected twice by Cap one, saying I had ticked the box therefore I knew what I was buying.... But I work in the public sector with an excellent sick pay scheme, and did 10 years ago when I took out the card. Should be an interesting pay-out, a 2000 limit that over such a long time So don't be put off just keep at them :-D:-D:-D
  25. I emailed Next and Isme with a list of my income and outgoings and asked them to accept a reduced payment of £36 a month. I explained that I only have Carer's Allowance and Income Support totalling £72 a week. I have £18 a week left so I offered both catalogues half of this. Isme not replied yet but Next have refused my offer but said they will accept £54 a month with no interest or charges. Can anyone please advise me on how to respond as I cannot afford more than £36 a month?
