  1. Good day to you all. This is a little unusual but I hope someone can advise me on my legal position? About a year ago I started a Facebook group, it turned out to be quite popular and so I appointed some members as administrators to help me run it. One of these administrators asked me if it would be OK for him to design a new header/logo for the group to which I agreed. He designed it using a proprietry computer program, used public domain and royalty free images, the name of the Facebook group and also the accompanying website that I also registered the domain in my name. He has now left under a bit of a cloud and has sent me several messages regarding this logo, he has claimed it is his copyright and I have no right to use it. I told him to go take a running jump and continued to use it. He has now threatened legal action and has said I will be hearing from his legal representative. He has made the same threat to the remaining administrators, holding them jointly responsible. . The simple thing to do would be to change the logo but unfortunately we had it turned into a bumper sticker as well and several members have purchased one, they would quite rightly be a little miffed if we changed it. . So in summary, am I in breach of copyright even though (a) It contains the name of my group and my website? (b) He designed it whilst working for the group © It is made up of royalty free and public domain material? . Your advice would be welcomed.
  2. Hi folks, I raise a claim via my mobile phone insurer Lifestyle Group. This is underwritten and owned by the same people as #protectyourbubble (Assurant). I go through all the process and log my claim for lost phone. My policy says that it will be dealt within 1 day. After 3 days I'm told it's been passed to the fraud department. This is due to a system that told them to do this!! Eventually get phone call from this guy Sam in fraud. He is are that I have a disability and suffer from depression. He asks challenging and private questions. At all times I am told I can cancel my claim. I start doubting myself and cancel my claim. I make alternative arrangements and get a new phone. After looking on google about protect your bubble, lifestyle group, assurant, (most bank packed accounts) are dealt with by thes people. Anyway 8 weeks later I log a complaint wi them and suggest that the fraud department bullied me, had caused exasperated my mental health issues and brought back bad memories. I also said that I have been at financial loss due to the way I was treated. The company decide my claim was valid and we agree a cash settlement for the claim...Not for my complaint. They have now offered me £100 for my complaint and I am not happy to accept. Having rad the FOS guidelines they may have breached disability discrimination legislation. I have advised the company I require £1,500 compensation and that I have evidence of the way the treated me. All calls recorded, and agents advised at time. They say they have now reviewed there practise and changed. My question is using the FOS takes a long time.m I've advised I will take legal action. Has anyon had xperience with this company and what letter should I send them. The are discussing my request but I suspect they will decline. Any help much appreciated.
  3. I took out a payday loan in 2012 for £100, i believe it has been that long, i can't remember. I got in to financial difficulty and ignored the loan, silly i know. Today i received the following letter : Client: BCW GROUP(Gothia) limited creditor: Wonga-purchased payday loans account BCWF Ref: ****** Client Ref : *********** Dear Mr * We have been instructed by BCW GROUP(Gothia) limited to recover an over dude debt of £319.48 on their behalf. Our client has informed us that they are unaware of any legitimate reason for non payment on your account. Whilst our client would still like to settle this matter amicably, fai;lure to contact us to discuss your account and arrange a suitable repayment plan could result in us recommending our client to consider possible legal action. You can prevent the above action being taken by contacting us immediately, to discuss a solution which we will take account of your current financial circumstances. I'm not disputing I owe the money I would like to know, how to go about sorting it out. I am on benefits as I have serious mental health issues, and it's starting to effect me mentally all ready with worry. Any help or guidance would be so appreciated, I know not to ring them.
  4. A few years Ago a phone contract was purchased through one of A1 Comms online companies, The contract we where told was after a credit check and an agreement to sign a 2 year contract with O2. Now after 14 months my son wanted to change network so we called the service provider and they said to end our contract we had to pay an outstanding amount which we did. Over a year went past and all was good until my wife got a call from Burlington saying we owed them over £350 we told them to send us a copy of any paperwork and I was told by an "English Person" in some weird tongue that he could not send us paperwork as they did not have our address and would we confirm it. I told my wife not to speak to them as it must be a [problem] however over the next two weeks she got numerous calls and then BINGO they sent us a letter (they must have found the address). We contacted O2 and they said under our credit agreement with them we had paid it off in full and there was no monies outstanding. I then find out that in the small print it says A1comms can charge us if we end our contract early, when I contacted them they said it was because A1comms subsidised the handset of which I said "Rollocks" as the amount I had paid to O2 was more than enough to cover the handset and airtime + commission and we got NO DISCOUNT from O2 paying it early. Now I can buy the phone NEW now sim free for £100 so why are they charging me £350+ when they would have got no where near that in the first place. Its not as if A1comms called us first and said "you owe us money" they just past it on to Burlington Parasites Group which I find remarkable. What can I do as £350+ is NOT a reasonable charge and is NOT what they would have got from O2. Cheers Nick
  5. Hi Quick bit of advice. Earlier this year I was awarded 3 year ESA in support group due to Fibromyalgia and Functional Neurological disorder along with severe depression. I have been on every antidepressant my dr with prescribe and i'm being seen by mental health services, im also on Butrans patches for pain. Anyway been paid fine every since the award until 13th August when the payments just stopped, no letter, no phone calls nothing just no money. I have phoned the hotline a few times and they always say I can't see any reason on my system for not paying, i'll email another department and they will call back later the same day. Of course i've never had a phone call back. In the meantime the local job centre wrote to my wife inviting her in for a work related interview which is odd because she's self employed and does a little work here and there when it comes in makes no more than £500 a year after expenses. Anyway I wrote back to the job centre explaining she can't get there because we haven't had any money and the job centre is a 25 mile round trip, I made it quite clear it was not a refusal to attend but just not right whilst they are in breach of their side of the "contract". JCP have written back putting the appointments on hold indefinitely until they start paying me again, still no explanation why they are not paying. I've written a complaint and sent that in asking what is going on that was nearly 3 weeks ago, heard nothing. My MP has written to them again nothing. Am at my wits end over it, i'm not good on the phone when dealing with things like this because I am easily confused due to the neurological issues and I have a phobia of the damn thing so I rarely answer it unless I know who is calling. On top of the ESA problem, I returned our child tax credit renewal to HMRC and they have ignored it and rolled salaries over from last year meaning they have invented a £25,000 income we don't have slashing our tax credits down to £79 a month. So at the moment all we're getting is £79 ctc and £137 child benefit to pay for 2 adults and 2 young children. My wife and I visit the community cafe every thursday for a free hot meal to save a bit of money that way but to be honest i'm just getting to the point of snapping over all of this along with the car problems (posted in garage area) and these 2 problems (i'm hoping HMRC screw up is what has stuffed up my ESA but I have no idea on that!) Permanently on the brink of tears and feel so depressed. On top of my usual pains and problems im now losing a lot of weight because I am vomiting several times a week for now apparent reason when it happens sickness lasts 24-48 hours where I can't keep anything down, drs don't know whats causing that either/ Really feel like it's not worth bothering anymore just feel so under someones boot. We're only just managing to put food on the table at the moment let alone paying any bills. Does anyone have any advice on where I go from here i've written to everyone giving them the correct info but no one seems to be listening. I can prove that the DWP have never called back because I have extensive phone call logs showing they haven't called (no withheld numbers called either)
  6. Good evening, I hope you can help me. I am writing on behalf of my father in law. After a discussion with my father in law he said he was confused by a phone call saying he was owed £7000 compensation and asked if he wanted to claim it. An agreement was posted and he signed it the (t+c) in May. He is on various medication and currently in hospital with ill health. And still receives phone calls asking when is getting out etc After he told us about this we said, No they are parasites, we will do it for you, so WE contacted Barclays and then completed ALL the paperwork from Barclays, he was awarded £2100 compensation. Later, they demanded payment saying they were successful in their claim for PPI. NO they weren't I was successful, NOT them, they did nothing. They did not do any work Looking at the T+C there are breaches everywhere 2.2 The service We will review and consider the information and submit a FREE OF CHARGE data subject access. At most they may have contacted Barclays. Which as in their contract is FREE 2.3 We will update you on our process.. No sorry nothing till I claimed it back for him then demanded payment for MY work My wife rang them and what an evil nasty set of *&^^&%& on the phone, d emanding this and that, saying IT WILL be paid etc. You WILL pay it etc. She explained her DAD was mentally and physically ill and has no bearing of what was said on the telephone at all and they just laughed with words of yea yea we have heard it all before. We asked them to provide proof of their contact with Barclays and they can no do this, all they have is her Dads signature. Reading the contract we breached by going it alone, they breached it by not doing anything, therefore contract null and void. Where do we stand??? Im telling him not to pay it. I'm very angry they were even asking how long is he in hospital for is long or short term as it needs to be paid.

Only I receieved this request from Lowell Group via my email.............. To help me further understand how best to assist you with account number ******* going forward I would be grateful if you could provide the following information: 1. A letter from a relevant professional with details of your situation. Examples of a relevant professional include: – Your GP (or the medical practitioner who is treating you) – A social worker who is working with you – A psychologist who is working with you – Any other qualified health or support worker assisting you If you are unable to provide such a letter, we would also be happy to accept copy fitness for work notes (sick notes) or a copy of prescriptions. 2. A completed Income & Expenditure form 3. Consent to record your sensitive data 4. A Letter of authority, if you want a friend, family member or someone else to deal with this account on your behalf It is the part that I have underlined that I am most concerned about................. I have told them that as I am terminally ill and in the Support Group for ESA that I have absolutly no intention of furthering them with my details.   8. Hello and thanks for any help,advice and information you can give me. I received a parking charge notice on 7/7/2015 with the reason 'obstructive parking'. I sent email appeal notices within a couple of hours with attached pictures of the parking situation to the email address provided on the parking charge notice (sent from two email accounts to ensure they got through and were not filtered as spam) but got no reply. I continued to email weekly for 3-4 weeks still with no reply and no 'unable to deliver' messages from my email accounts. I also had a friend send an appeal message from his account - he too got no response. I have today received a letter from a collections service charging a higher amount for the unpaid parking charge. I presume this incorporates their fee. I contacted PCS (parking charge collections) and explained that I had appealed the charge and am still awaiting a response from LDK. PCS customer services asked me to forward my appeal email sent to LDK and they would negotiate on my behalf. I have forwarded PCS my appeal emails. I have since discovered that LDK have an appeals form on a separate website which is not listed on the parking charge notice. Should I now complete this form retrospectively and submit to LDK despite it not being indicated on the parking charge notice? Athere were no designated parking spaces in the car park - it is rough 'scrubland' and I have photo evidence to show cars around me changed while I was parked as compared to the pictures they have of my car at the time the charge notice was issued. Plus surely, without marked parking spaces, 'obstructive parking' is subjective rather than a fact that can be clearly defined. I don't want to 'go on' too much as this is my first post I would welcome any advice on how to manage this and if my appeal to LDK is fruitless then how to be able to pay the reduced fee that I should be entitled to given that I did attempt to launch an appeal a per the instructions on the notice.   9. Lousy Service, possible Breach of Contract? I phoned them and asked them if they could repair a tilt and turn window in a rental property They said that they could and quoted three prices (depending on what work needed to be done) which I agreed and furnished my credit card details. An appointment was made for a few days later. On the morning of the appointment the engineer telephoned me and when leaning it is a tilt and turn, said he could not do it. I complained to the company and Mr R**** sent me, (to the wrong address), an insulting reply saying they are not charging me and offering 15% discount on future work (as if). I have asked for reasonable compensation and if I do not get it will take them to court. A complete bunch of cowboys. I see that the company have complained to Trust Pilot about my naming one of their employee sin a scathing review. I have therefore removed his name. It is a pity that Able Group have not dealt with the problem rather than their petty attempts to have it removed.

I'Ve been trying to find out how UC will affect me as I was placed in an ESA Support Group a year ago for a one year - and then told this year that I wouldn't be called for any type of assessment at all and that they will look at my case in spring of 2017. Btw, I went through the hoops several times plus two tribunals in order to get where I am at the moment. Obviously I was relieved to hear about the '2017' decision, but now am starting to wonder what is likely to happen to me under the scheme for UC. If it helps, I have Fibromyalgia and am a 62 year old female. Please help me as I feel I can't bear to have to hoop-jump again at my age! I honestly thought that I might be left alone until 2017. Thank you for reading this!

I've been doing some in depth reading regarding the process to have an SAR carried out on various lenders etc. In the past I've had the following: Black Horse Loan (2002ish) Applied for my PPI back and told they couldn't find account (now they've been fined 110+ million i'm sure they'l be more helpful Halifax Bank Account BOS Bank Account Birmingham Midhsires Mortgage. I guess my question is can i just send a single SAR to Lloyds banking group HQ (now that they own all these subsiduaries) or will I have to make one to the individual companies within the group.
  15. Hi all I have been in a contract with xercise4less for over my 12 month period and have since joined a new gym! I cancelled my dd as was now 'out of contract' I have just received a letter from hardlands group demanding a 25 quid admin fee and the cancellation period fee? Can I just ignore this? I am moving house soon in any case... Any help appreciated thanks!
  16. Hi everybody, I'm in a bit of a mess and need some advice. I suffer from an auto-immune disease which means that my body attacks itself. It affects many organs in my body and I was in the Support Group due to this. I recently moved in with my partner and we filled in a change of circumstances form. When they received this form, the DWP told me I had been removed from the Support Group and placed back into the main assessment phase of ESA. They sent me a work capability form and said I had to start the whole claiming process again and that I might not get back into the Support Group. I have contacted them a few times about this and whenever I have spoken to them they have said that this is a mistake and to ignore the work capability form that they sent me as it will have crossed with our new claim and that things will just iron themselves out as the claim progressed. Everyone I have spoken to at the DWP has said they won't remove people from the Support Group for simply moving house. Today I received 2 letters. One from the DWP saying that I am not entitled to any money and that my N.I. stamp is no longer being paid and the second from a disability assessment centre saying that my work capability form has to be returned today. I don't know what on earth to do now. I have been told all along by the DWP that I didn't need to fill this form in and now on the day that it is due in I am been told that I do need to fill it in and return it. I feel like they have royally stitched me up. Can anybody offer any advice here? Can they really remove me from the Support Group just for moving house?
  17. My friend received two letters on Saturday. He has been in the support group for a while, and was awaiting the outcome of an ATOS assesment. Letter 1 told him he had been moved and has lost the support elemen of his money and Letter 2 tells him that he has a Mandatory Work Interview this Thursday, at the local jobcentre. I am not going to try and deal with an appeal myself, (too much has changed and too much is at stake for people if I cock up as a non-professional). I am going to refer him to a local disability charity that helps with these things. Quite well apparently, for a small fee. Anyway, whilst I get on with doing that could anyone tell me this, if we write immediately stating we wish to appeal this decision, does he still have to attend this appointment on Thursday? I would hand deliver a letter to the person he is supposed to see enclosing proof of his appeal (Mandatory Reconsideration). And also whilst he is being reconsidered/appealing, will they still dock the support element of his money? He is not well enough to attend the JC. He has just registered with a new GP who specialises with his problem , but has yet to see him. I am also a bit concerned that by appealing he might lose his money entirely and be forced onto JSA,in which case that will be the end of him as he cannot function like we do. Any comments on this especially welcome. I am told that this is rare, but can happen. Many thanks for reading.
  18. I am going to tell you of my problem with the marston group How they can be allowed to get away with wot they do is crazy . Firstly they operate a 0845 phone number which costs a fortune they don't pick up For ages most times I've called it's 7mins on hold till I get a agent then they are so rude, But wot I want to complain about is there online payment system two times I have used this and both times It says my payment had failed but the money is taken from my bank and put in holding account because they said I made mistake in information I gave , I then have to wait over Severn days for money to be returned to my account But I still have to make the payment again. I spoke to my bank and they said it should only be a mistake if I put in wrong details, and how cum they can still take money if a so called mistake is made, I fell they operate in a very dubious way, I have never heard of any company's taking money from account if a mistake is made if you make mistake they usually tell u so you can amend it, I don't think the payment should go from account so the bank is at fault as well, if you do have any dealings with this outrageous Company, pay the money into their bank over the counter. Something must be done to stop these company's having 0845 numbers to reach them they are makein a fourtune from these phonelines they say they hav over 1000 staff so why dos it take so long to answer phone I've spent nearly 20pounds trying to speak to them .
  19. Hi I joined a lifestyle fitness gym in October 2014, my job moved (but not my home address) so I didn't want to go to that gym anymore. I cancelled the direct debit in December 2014 - without contacting them. I knew they wouldn't let me cancel so thought no point in contacting them. I have since had a couple of letters from Harlands and CRS - the 'debt' now stands at £288.20. I know from research that they are all the same company. I have ignored every single letter... rightly or wrongly? I have never had a phonecall or an email chasing me? Now I have received a letter saying the debt will be passed to Zinc Group in 10 days. Just wondered if there was any advice on what to do next? Or just continue to ignore? I have been advised that these type of debt are not enforceable? Also, if the debt is enforceable, surely the 'debt' should somehow relate to the potential loss to the business etc? Thanks in advance

If you are a member of one of the other groups – Npower Boycott, Nasty Npower, Consumers Against NPower, etc and you see comments which are posted on this forum or in one of those groups and which you feel might be useful to the people who are on the Npower Nightmare Facebook group, then you might think to relay those comments to those people because we will be unable to do so directly. Some of you might also feel inclined to let the members of the Npower Nightmare Facebook group know that the Consumer Action Group has been blocked because I expect that most of them don't realise it. The way that the Npower Nightmare group is being conducted would almost lead you to believe that it is a shill group of Npower – but of course that is just being fanciful, isn't it?
  21. Hi all, Simple question really, it would seem that a pension I used to have (occupational) was with Tibbett and Britten group. The pension trustees apparently were wound up in 2012 as far as I can make out, but I still have around 8 years of contributions with this pension fund. What do I do ? How do I access my frozen pension funds from a fund that has been wound up ? This isn't my area of expertise, but I'm sure someone here is an expert
  22. I filled out the form to do some craft work from home (I am in the support group) I got a call asking me about it - and a start date which was sorted out. The lady said it will 'make a difference' and I will be asked to send them receipts and the likes. I have heard nothing back so not sure what to do next (this was over 2 weeks ago). Plus I am afraid by what she means in 'this will make a difference'. Will I lose my benefit, I am only talking selling a few items a week maybe month (some times not even that) to get some money back so I can buy more craft items (I understand the need to keep a check on me) but I am not going into business, and could never support myself. The craft work is to keep my mind occupied and stop the mental health problems completely taking over my life. I am not sure what I should do now/next as I am worried.

Hi I was hoping that someone could help me with a company called Are You Owed Money (used to be called Sentinel debt recovery) I had an outstanding debt with a garage for a repair which needed to be carried out on my car which in itself is a long story, i owed £900 and was contacted by sentinel to pay off this debt we agreed to pay off £50 every 4 weeks as this was inline with my pay and the only way to set this up was by giving them my card details they took payment every 4 weeks (first mistake). Around about September i didn't have enough cash to pay this i contacted them to tell them around a week before and asked could they take it out 1 week after the original plan and then go back to the original payment plan which they agreed and said it was fine. Then to my surprise they took 2 payments out one on my original date which left me with the money i required to pay my council tax and then a second payment a week later i contacted them and they did apologise and say it wont happen again. But this then happened 3 more times and i phoned them each time to tell them to stop it and reset the payments to the original plan but each of these times i was told that either the system was down or that someone would call me back (which they never did) During this time the company had change their name to Are you owed money i the phoned again to say that i wasn't happy and this is when i got a lady called Christine who was a very unhelpful she told me that "well i don't know who let you set this payment plan up as now the debt had risen to £1400 and we don't accept payments that low we will have to look into this and ring you back because you need to be paying this off quicker" this really did get me worried as i suffer from anxiety and depression (which i explained to them) really didn't help the matter, i did dispute the extra on top of the original debt but they just said "oh we will see what can be done with that when the majority has been paid off" I'm a bit lost now because they kept taking payments outside of the agreed payment plan i told them that i was going to contact the bank and block them which i did so then they change the name of who took the money to vantige legal and took another payment so i got the bank to block them as well. Now i have them sending letters to my old address even though i have told them i had moved at least 3 times demanding full payment and potential bailiff action. Any help would be appreciated. Thanks
  24. Hi im not the best at explaining please bare with me. A few years back, I was declaired Bankrupt Afterwards i struggled getting a Bank Account. Long story short. I saw Gregorry Pennington in the paper offering bank accounts for 14.50 a month. They didnt have to manage me with anything. I was just desp to have an account and GP said id struggle after going bankrupt. I had health issues lost a friend and had a breakdown over the last ten years. Only now able to go out about due to anxiety Ive had a support worker out whos gone through all my paperwork etc. Realising several DD s had came out of my account over the years. One i remember canceling because i got my card canceled the same day. And explained. That id contacted the police due to items going from my home. Police had infact changed locks and the persons were taken to court for doing quite abit of Fraud. It was dealt with in the Crown Court. On ringing up my bank(new name Think Money) after explaining everything. They rang me back saying as its over 12 mrhs. They wont accept it under fraud. Due to the lengrh of time going back 2009. Even health issues. Me having the break down. And police ref. made no difference , i also had a call around the time i opened the account with them. From them offering me home insurance cheap with them. I agreed as is be thinking of getting it anyway. Set up dd with them. Going through all paperwork my Support Workers come across 2 Policies. One is Think Insure Client 13.00 amonth. Other is 6.99. For Key Insurance?? Neither i know of. And theyre Rolling Contracts. With Millenium Insurance Brokers plc. I believe the bank gets the ok were interested in insurance. They then pass details over to Millenium who then pay rhe bank a percentage for it. The brokers charge me per year for agreeing to the credit. It then gets referred to Think Insure. Who go s through Ageas insurance. When supprt worker first noticed something wasnt right. Payments to Millenium were canceled, letter wrote. Phone call made. Going through papers now. The only policy stopped was the 21.00 home insurance. The 2 rolling ones are atill being taken to Think Money my bank. Theyve now sent a letter saying im no longer welcome to have a bank account with them. Because of recent issues. Giving me 8 wks to find alternative. I cant believe they can do this. Any advice. Help please. 14.00 a month over ten years to get treated like that
  25. I have a gym membership with the Harlands Group. A few months ago I emailed them to change my DD date because my wages where coming at a later date. They replied they couldn't find me. I replied and gave them all the information needed. A few days ago a DD payment failed due to it not being changed. I got a letter today saying they are charging me £25 for the late payment. I called them up stating that it was not my fault it was their company who couldn't change my DD date as I clearly have emails recording that I wanted it changed. They said they would chase me for the money. I emailed them saying : A few months ago I asked you guys to change my account direct debit information and was advised that you guys could not find me. I got a letter today stating that I have to pay an adminstration charge of 25.00 due to a failed DD payment. As the previous emails clearly state I have tried to get this date changed and provided all the information needed to do so including information on my account. As you did not do this I refuse to pay the charge and have canceled my direct debits. I called your hotline today and was told "we will chase you for the money" which is not exactly good customer service being threatened by a contact centre agent. I have taken legal advice and these emails clearly back me up that I wanted my information changed so feel free to meet me in court if you want the charges.
