1. Hi, I've had a Samsung UE40F6200AK for 11 months - in that 11 months I've had the same fault appear twice. The first time it appeared I rang Samsung and without a bat of an eyelid they arranged for an engineer to come out and repair it. Now that I think about it I expect this was a common fault as they didn't question it. The first fault happened after about 4 months. The latest fault, exactly the same as the first happened over the weekend. In both cases I get a darker horizontal bar appear, I can still see what the picture is but it's darker as though a "light" behind the screen has failed. My first question is, should I receive a warranty on the parts they're replacing? Secondly, what rights do I have as a consumer that's had the same part fail twice within the first year of owning the TV? In the first instance they replaced the LCD display as it seems this is not serviceable, I expect them to do exactly the same this time. Thanks in advance, Pete
2. I used to be on the dole but on my visit a few months ago to the dentist, I told the receptionist that was working there I was no longer on benefits and could she update the system to show this...she also gave me a blue paper to sign which I did (I assumed this was normal procedure) after I had told her to update the system to show I was not on the dole anymore. Last week I got a NHS DENTAL PENALTY CHARGES NOTICE for £150.00! I was gobsmacked because I remember telling the receptionist to update the system to show I was not on the dole, so this would not happen. Luckily I had another dental appointment this week and explained to a receptonist the above, she said she could not understand why the receptonist months ago on my last visit had not updated the system and told me to email the practice manager who would investigate this and also locate the blue slip I was asked to sign (after telling the receptionist on my visit a few months earlier I was no longer on the dole) I emailed the practice manager explaining I had told the receptionist on my last visit I was no longer on the dole and to update the system to show this. This is the email I received in response from the practice manager ' Thank-you for your recent email, in which you state that you were not in receipt of any benefits on (date), as you has NHS treatment there is a set NHS fee to pay. The charge is levied irrespective of any misunderstanding or error on either part(patient or receptionist) as at the end of the day there appears to be no confusion as to whether you were in receipt of any benefit. It is incumbent on the patient to pay any fees due just as you would pay at a supermarket check-out, where you are in receipt of goods or services. May I also point out that the form you signed is a statutory legal obligation which must be disclosed by us the the NHS upon request. There is currently a no if’s no butt’s campaign by the NHS to recover lost fees and we would ask you to bear this in mind when receiving treatment from ' The error is clearly on the receptionist at the time who failed to update the system to show I was no longer on the dole, if the system had been updated when I had told them this would not have happened, the practice manager is fobbing me off, what can i do ?
3. Hi, I have a problem with my tv where it displayed pink vertical lines down the middle of the screen. I phoned costco about a month before the 5 year warranty run out they got a repair company to look at the tv. The repair company turn up and looked at the tv and saw the problem and took photos of the problem and said they would need to take it back to their workshop to fix. Once they got it to the workshop they said they could not replicate the problem but cleaned the inside of the tv and returned it to me. When I got the tv back the problem had gone until now 7 months later when my warranty has now run out. I want to phone costco to see what they say but before I do I would like to know my rights are in this situation. Mark. Sorry i have put this is the wrong subforum can someone move this for me
4. Hello CAG, Sorry if this is in the wrong forum, please feel free to move if incorrect. Long time lurker, only ever posted once before (against NCP - and won!!), just hoping someone can give me some helpful advise on an issue I now have. purchased a Sony TV from Tesco in April 2012. It had a Tesco 1 year warranty and also has a manufacturers 1 year warranty as well. No issues until now, but this weekend turned it on, and there are lines across the screen (horizontal), happens on all inputs/channels, checked cables etc etc, definitely the TV. Not impressed because I paid the extra for the 'name' and I thought I was making a bit of investment rather than paying less for a cheaper model. Phoned Sony and got through to some rude woman in Egypt?! who said go away. I then spoke to a guy at Sony in Scotland who was helpful, but they said being as it was after the manufactures warranty had expired there is nothing they are prepared to do, and the cost of repair would probably be more than actually buying a new TV. To me, a TV should last a lot longer than 2 years 8 months.. ie without a fault that effects the general operation of it... Whats also annoying as this is the 'upstairs' telly, which isnt used half as much as the TV downstairs so this is even more annoying! Is there any kind of act that even though the manufactures warranty has expired, I can 'lean on' as the consumer that the goods are not of good quality and have not lasted a reasonable amount of time... I cant really say to Sony that the TV was faulty upon purchase as the lines have only appeared now... Any help greatly appreciated, and keep up the fantastic work that you guys do here.
5. Ok on 20/1/15 i was stationary at zebra with people crossing, got rear ended by builders van cause he's looking at building work other side of road. he's a self employed builder carpenter. He offered to pay for repairs but seeing damage I knew car was a write off - so I insisted through insurance, so we exchanged details, he apologised admitted liability, I did a quick DVLA / MID check, there and then and van insured , mot and taxed. I even took license number from him, you'd think I done it by book.... Now it turns out license , van registered and insurance at his mums address, he lives elsewhere with girlfriend, which you could put down to just forgetting to update.... but here's kicker- I report to my insurance company that day and they contact his insurance company (same as details he's given me) told by my insurance company they have until 30th to fast track payment as car will be a write off. (as I have already got independant estimate) My car is collected and written off by 27/1/15 given a value of £690 which I accept as told if I dont hire car will be revoked or deemed chargable. but he has either not contacted his insurance company and or just not admitted liability, so no payment and all seems in limbo as my insurance company have contacted his and at stalemate. so I now had a hire car for 3 weeks so guessing about £750 of hire - just worried if he's Missing in Action so to speak I will be stuck with a bill for a hire car and no payout.
6. Hi All. My Father is nearly 80 and relies on his landline. He recently reported a problem on his line to his provider (Post Office) who confirmed there was a fault and advised him BT would be out to have a look. BT arrived a couple of days later and the engineer says there is a fault caused by water ingress and he needs a new connecter box in the house. He replaces this box and disappears. Next thing my Father is being charged by the Post Office £144 + VAT for this tiny box! No-one, not the engineer or the Post Office at any time suggested there would be a bill, let alone one for £144+VAT, they just did the work. He thought, as it was their box and their line, there would be no charge. Question is can they just do the work without advising him there would be a huge bill? Surely they should have quoted him for the work? Not only is he on a pension and can ill afford the cost, he is quite upset about it as he feels conned. The irony of it is that the water ingress came from the hole where the cable entered the house and wasn't sealed properly originally, so it is actually their fault anyway. Thanks in anticipation of any advice.
7. On March the 8th I bought a used 2003 Audi with 90k miles on the clock for £7500 with £5000 on finance. I've had a couple of issues in the past 4.5 months but being a reasonable chap they were nothing I wouldn't expect in an 11 year old car with 90k miles. However on Thursday it developed a rattle which my mechanic has diagnosed as timing tensioner failure. If this is not fixed it will lead to catastrophic engine failure. The timing system is supposed to last the life of the engine but clearly it has failed long before it's time. My mechanic has advised that to remedy the fault will be around £3500 and the engine needs to come out. I think I have a claim here but is it with the dealer or the finance company? Thanks!
8. Hi, I have a 16 month iPhone 5s, on the three network, and until recently the battery on the phone was ok at best. However, more recently I have noticed that my iPhone will power itself off when the battery power is low. I have noticed the battery power at 38% and it has done this. It would also turn off if I had around 10% power and I attempted to use the camera. Anyway, the only thing I could think of that had changed was an update to the IOS that could potentially cause this. I tried to phone three uk today but their system was not available so I could not speak directly with someone. I managed to have a 4 hour conversation with three uk via a series of tweets and when I eventually explained to them that the phone battery was not working as I expected it to they asked me to contact apple directly. I replied back saying The Sale of Goods Act makes reference to 'the seller', this is the shop, the retailer, or the individual you bought it from, and this is who you made the contract with. They replied back and said that three's policy does not cover device faults and sent me a link, http://support.three.co.uk/srvs/cgi-bin/webisapi.dll?command=new,kb=mobile,ts=mobile,t=article,varset_cat=billing,varset_subcat=3772,case=EXT(EM36278) The fault has, as yet, not been identified, so the question I have is, am I being fobbed off and is there anything else I can "tweet" back to three uk to try and progress this? thanks in advance Miffed_With_Mobile
9. Hi I purchased a car on 2/8/14 for £1295 and was given £350 for my old one, so paid £950 cash, no warranty was ever mentioned and now the car has developed a loud knocking noise, sounds like drive shaft area, no warranty was mentioned, there is also no mention of it on the very basic receipt. just also looked through the paperwork, and the v says 3 previous owners and car was advertised with 2. any thoughts on where i might stand with this one. cheers
10. Hi all i found this forum through google so hopefully i am posting in the right area. I am claiming ESA and had an Atos assessment on June 6th. 25 minutes before my appointment, they rang me to cancel saying the doctor had a flat tire and couldn't make it. Fast forward to around July 12th (Not got the letter on hand), i received a letter asking me to explain my absence from my assessment on July 10th. I wrote back saying I have had no notification of an assessment on July 10th. A few weeks later, i receive another letter telling me my ESA has been stopped due to failure to attend my assessment. I rang up straight away to dispute this decision and a friendly gentleman arranged a callback for me at 3.30pm. The callback didn't come until Monday 10am which i missed (Today) I rang the number they left on a message and spoke to a woman. She was condescending to me throughout the call and was very deliberate in confirming and asking me "So you got that letter but not your appointment letter, can you think of a reason why? - I dont know if this is part of their training but i found it disgusting along with her tone and impatience throughout. She told me that it is being referred to mandatory consideration and could take up to 28 days. Is this the correct next step? I am absolutely stunned with the whole saga and am now extremely worried about the mandatory appeal. With the process taking up to 28 days, will i receive the ESA backdated if they overturn the decision? Thanks
11. Hi all Long time again (it's funny how you only seem to need these forums when something goes wrong! It's reassuring to know there's a place to turn in times of crisis!) Situation is on the 1st of this month I took delivery of a brand new mini, on PCP. Today, I was in an RTC that wasn't my fault (police attended and are doing the other driver for driving without due care). I am having the car repaired by the mini dealership, which means I have to pay my excess and recover it later. All standard.* I spoke to the mini dealer today who have looked at the car and think it may be a write off. My question is, this is a car with over £5k of extras on top of the basic cooper price. If they write it off and I suffer a shortfall between invoice price and the amount I get as a settlement, can I claim the shortfall from the third party via the "uninsured losses" route alongside the excess etc.? I don't have gap insurance. Thanks for any pears of wisdom
12. Hi All, Really miffed at the moment. I had an accident on a local country lane where a car coming the other way hit my car. I saw the other party coming and stopped. However the other driver had the sun in their eyes (I could see them fiddling with the passenger side sun-visor for their child as they approached). As I`d stopped and could see they hadn`t noticed me I braced myself for impact. They saw me at the last moment and although they tried to stop and go onto the verge to avoid me, didn`t succeed. Both cars had bumper and bonnet damage requiring repairs but fortunately no-one was hurt. The other drive got out and apologised and later that day their husband phoned my husband, offering to pay for the damage/repairs through one of their garages, saying that if we went through the insurance route the insurers would probably claim for 50/50 fault . We wouldn`t have been happy to do the repairs though their choice but, either way, the car is leased so we needed to go through the proper approved repair process. Further down the line we had a call from our insures saying that the other party has denied fault, blaming us, and that the insurers were going to settle 50/50. We now have a cheque from our insurers to cash, for half the excess we had to fork out at the time of repair, along with a more expensive quote for insurance on our other car. I`m loathed to cash the cheque as this will be in final settlement. Our insurers keep telling us that they`ll not pursue the case as there no independent witnesses. Unfortunately, the only "evidence" we have is a copy of the business card from the repair place the other party wanted to use, along with circumstantial evidence that the time of morning and sun position that day backs up our version of events. The other party is a rural neighbour-ish so we know them to nod to. I`m tempted to ask them to explain why their insurers are claiming the accident is our fault (as they may just be going along with what their insurers are saying) just in case it an "insurance cutting legal costs" thing. I don`t fancy it becoming confrontational though. Could it class as harassment if I approach them, no matter how peaceful? Could anyone please offer advice to whether this worth pursuing (perhaps through small claims if not though the insurance) or should I just bite my lip and write if of as one of life`s Ah-bugger-moments? Thanks P4L
13. The Asus tablet we bought just over 12 mths ago for £250 stopped working because of what store staff identified as a manufacturers fault (the screen froze). We were offered £150 which was refused. Surely if it is a manufacturers fault a full refund. repair or replacement should be offered under the 2yr EU directive. Please advise
14. Hi everyone hope you can help. Bought used mazda 6 09 reg for £10,000 august 2013 through finance. In October would not start, not recognising keys (keyless entry model). Under warranty went to dealers, they didn't have a clue so went to a mazda dealer. 5 weeks later returned car with new PCM. Although under warranty still had to pay £420 excess labor and diagnostic. 7 weeks later same problem, recovered to mazda dealer (although not their car) as EH didn't want to know. 6 days later could pick up. Said they recharged the battery and now working fine. However before recovered the AA said battery was fine. 5 weeks later would not start again, went to mazda dealer, 4 days later picked up car said faulty key. Now on the 10th July happened again, still waiting for results of how they get it going. Sent letter to finance and dealer asking for replacement. Finance want more details. However dealer stating this is not the same fault. Surely if the symptoms of the faults are the same (not recognising the keys) it is the same fault? Have I any chance of getting a replacement? Sorry about the long text but advice would be greatly appreciated.
15. Hi, purchased a Range cooker (gas + electric) in June 2012. After about 9 months the central ring started playing up and they sent out an engineer a few times as it would start working and then stop again. After about 15 months the oven/grill selector switch burned out. We purchased the item for £500 and the retailers answer was pretty much what can you expect for £500? I believe that there is some element of the Sale of Goods that says items must last a 'reasonable amount of time' in accordance to the price paid. I'd deem something for £500 to last more than 15 months! I sent the below after doing some research on the internet: Letter was sent recorded post a few weeks ago so the time for them to act has elapsed. My question is - can I proceed with a Moneyclaim online for the amount or is there something else I can do? Quite happy to do the former by paying the fees etc. Thanks for your help all
16. I wrote this for insuranceguy since he said he offers help , but I cannot PM him because I do not have 15 posts . This is my first . Maybe someone can PM him with this link for me , or offer any advice at all . Thank you very much , kind and concerned citizens . I do not have a thread . I just was researching about my case , which I have an attorney representing me supposedly anyway , and I see that you offer advice . I hope that you can help from here , without a thread and if I need one , I guess I could compose one , but I have no idea where it would go . so I will start here if I may ? I am traveling down a 2 way street with traffic on both sides . This street is named Poplar . This street has no stops for me whatsoever , and there is a red light ahead , about 1/4 of a mile . Along this street , there is crossing traffic , by means of a stop sign . However , I have the right away , and the crossing traffic , who has the stop signs , need to yield to me and proceed after I pass , or before , if it's safe . So again I have no stops whatsoever . So I am traveling down this street and I am coming up to a car who wishes to cross across Poplar , the street that I am on . She is traveling north from south and I am traveling east to west . The person driving this vehicle is only paying attention to the cars to the right of her . As I am nearing closer to her , I still notice that she has not looked left yet but by this time I need to focus on my own driving and not hers . So I proceed forward , at around 25 MPH the speed limit , and as I am almost parallel with her I hear my passenger yell watch out ! I instantly look to the right and I see her coming right for us , and gut instinct , we are going to get hit . If I would have stopped at this moment she would have hit us , it was already set in stone , I was getting hit no matter what I tried , but gut instinct , to try to avoid the accident I intended to go on the wrong side of the road to give the this driver time to see me and to stop . However , I had oncoming traffic so I could only make it a few feet into the middle of the street while stopping . If I would have proceeded to go straight and not veer into the middle of the street , she would have ripped the whole side of my car , rather than just hitting the front , so my actions did give her some time to notice me before she hit us and this street that she is crossing is not just straight across . She had to drive at a right angle , to continue crossing onto her same street , Elm . So she was so busy with only looking toward the right , in the direction that she was heading , that she never noticed that I was on the side of her and had she would have looked left , she could have avoided this whole accident . It was not safe for her to proceed , as per the police report putting her at fault . She had to wait for me to cross first , then proceed . So she proceed without looking left thus smashing into me . And this all happened in a matter of split seconds by the way . So I get to the middle of the street and stop . I have no where to go , speeding up wont help , and she's already heading straight for me . So by the time she finally stops paying attention to the cars on the right , she finally looks straight onto the street which she is aiming for Elm , while after already into the intersection and she finally sees me stopped in the middle of the street and slams right into me . Again , in a matter of split seconds . So in a nutshell . I'm driving eastbound on a street with no stops for me whatsoever , I totally have the right a way , and a driver wishing to cross my lane of traffic does so without looking left to make sure there are no cars or pedestrians , thus making it not safe for her to proceed and by doing so she crashes right into the front side of me . I got a lawyer and I had to speak to their adjuster , and I didn't even know what an adjuster was before this , no accidents in my life , but the adjuster was rude , was rushing me throughout my answers and was trying to confuse me into saying things that just didn't happen . So to me this phone call was BS to begin with , which she recorded by the way , because my attorneys helper , said it was fine to do so . Also at the scene of the accident , the first thing the other driver said is , where were you ? Because she never saw me , because she never looked left ! And I tried to explain to her , I was just driving down the street and you never looked left , and she tries to say well then it was your fault . You must have been speeding . So I said yeah right [problem]mer , I have my 71 year old grandmother with me , oxygen in the vehicle and a lapdog which my grandmother was holding . So I driving very defensively , which is why I was noticing her to begin . If I would have been alone , I would have not paid so much attention to her . But so anyway , I instinctively called 911 who came to scene , took both of our statements , and placed her at fault . Well when she contacts her insurance , she decides to change up her story , and she tells them that I was behind her , which is absurd . I am traveling east to west and she is traveling from south to north . At no time was I ever behind her . She was crossing my lane of traffic , she has a stop and I have none . So I had the right a away . I had no reason to stop , until I saw her coming straight for us . So my attorney and her adjuster says they need to wait for the police report and when they finally get it , it shows that she is indeed at fault . She basically failed to make sure that the intersection was safe before crossing . She never looked left , and again , had she would have , then she would have never went and we would not be here . So anyway I get an email from my attorneys helper that based on the recorded call between her adjuster and myself , their insurance came to the conclusion that because I saw the accident , I'm at 30% fault . Which is bogus . I only saw the accident 1 to 2 split seconds at most before it happened , but the adjuster took my words and twisted them around to make it seem like I was watching her the whole time until she plowed into me . Which just wasn't so . I eventually had to take my eyes off of her to pay attention to my own driving and then is when she gunned it , darting across the street , slamming into me and if it wasn't for my passenger yelling watch out ! I would have never even seen her coming . So yes as I was traveling down the street , I was observing her because I sensed something odd about her and as I got closer she still haven't looked left but I figure eventually she would , because everyone has to . I mean this is the freaken law right ? So I stopped paying attention to her , paying attention to my own driving and the other drivers around me , putting her behind me , because I cant be driving for everyone else . And I guess I was almost just pretty much parallel with her and my passenger yells watch out . I look right see her coming for us , try to go on the wrong side of the street but cannot due to oncoming traffic , so I slam on my brakes in the middle of the street . I look to the right and within nanoseconds she slams into us . So again police place her at fault for not giving the right a away to motorists who are on the street which she is crossing . But my recorded conversation , taken out of context twisted and mangled by their adjuster , says I am at 30% at fault since I saw the accident happen . I mean seriously wtf ? Everyone saw the accident happen . My passenger first , then me second and then finally the other driver third . So their bogus claim has no merit by my understandings , but this so called recorded phone call somehow proves , to their insurance , that I could have avoided the accident , since I saw it happen . Which is pure bull feed . So my attorneys helper says their insurance deems me at fault and wants to do a 30:70 . 30 me and 70 her , but I know for a fact this is 100% her fault as so did the police say the same and wrote in the report . This insurance adjuster had just twisted my words around to make up a story which doesn't even exist to get this 30:70 . More bonus for her right ? So I'm waiting on a recorded copy from my attorney to listen to the tape because during the recording , they weren't letting me finish my statements . Either my attorneys helper would tell me to stop speaking or the adjuster would ask a question and then before I was even finished she was ask another and yet another and then she was like , "well you already said yes" and she yelled at me when she said this and I was like , wait a freken second , that is not what I meant . And she responds , like a freken child , "but you already said yes , but you already said yes , but you already said yes!" So this recording from their insurance adjuster for their insurance is not reported accurately , of what actually happened and which basically goes against the police report . So what do you think ? I mean , I told my attorneys helper , I will not accept any fault at all . There was nothing I could do and yeah I was paying attention to her as I was coming toward her , because sometimes people will dash in front of you and try to cross the street in a rush . Which is actually what she did do , to avoid oncoming traffic from the right hand side , but since she never looked left she dashed straight into me . However , I never saw her leave the stop sign . My attention was by then , off of her and on to the other traffic , and again it wasn't until my passenger said watch out , that I actually looked right and saw her coming for me . So again they said because I saw the accident I'm 30% at fault which is straight out fraud , I feel . There was nothing I could do . She was coming straight for me so I just stopped toward the middle of the street and braced for impact . Any ideas sir InsuranceGuy ? And I’ve been dealing with my attorneys helper this whole time , so I haven't actually spoken to any attorney at all . She's the one handling my case , in if she comes back with the conclusion and says well sorry Rob , that-is-that , it's gonna be 30:70 , then what can I do ? Who can I report this to ? My other friend said the BAR , and I've already read online to file a complaint with something to do with the automotive insurance regulatory system , but I'm not sure exactly where or with who . But from your insight , if the adjuster is basing her claims on not facts but the fiction of twisting my words around until she gets a story in her mind where I am too at fault , is what she is doing - then how do I go about getting this overthrown ? It's a false statement on her behalf which she is trying to use against me and I refuse to be a victim . I'd also like to file for fraud or an additional police report if possible . And InsuranceGuy , I’m a totally honest person . If I was partially or totally at fault , I would just come out and admit it . We have insurance and hey I'm not gonna waste anybodies time , but the point of the matter is I wasn't at fault . I'm just driving down the street and get hit from the side by someone who failed to see me , because she never looked left , and tried to dart across my street , to continue onto hers , thereby gravely injuring my 71 year old grandmother who was my passenger , amongst myself . Any ideas please Mr. InsuranceGuy , anything you need let me know . Need me to post this into a forum if you could just point me into the correct place to post I will . Thank you so very much in advance , =) And anything you need . Just advise . Robert Reinaga from CA . P.S. Sorry for any typos , I've already reread this like 3 times and I have the hugest headache in the world . So when I feel better , I will reread and correct any errors . Thank you .
17. Hi. This is my first post but I have used some valuable information from this site in the past. I recently bought a Porsche 911 from what appeared to be a very reputable dealer. I had Porsche perform a 111 point inspection yesterday. They informed me of some serious engine problems and advised returning it. I called the dealer with this information and today I sent the following letter accompanying the inspection report, recorded delivery: On 29th June 2014 I purchased, and took delivery of, the above vehicle from XXX. On 2nd July 2014 I discovered that it was not of satisfactory quality. This was highlighted by the report produced from Porsche East London after an official 111 point inspection (attached). Within the report Porsche indicated the following: · Knocking noise from right-hand side of engine, suspected bore/piston issue. This was backed up by evidence of discolouration of left-hand side exhaust pipe caused by increased oil use on the right-hand engine bank · Right-hand front coil road-spring snapped · Brake pipe support bracket securing bolt snapped It was also indicated, which I had experienced from day of purchase: · Judder felt through steering when 1st applying brakes Section 14 of the Sale of Goods Act 1979 requires dealers to supply goods of satisfactory quality. However, the vehicle is clearly not of a satisfactory quality which is defined as free from minor defects, safe and durable for a reasonable length of time. You are therefore in breach of contract. I am legally entitled to reject the vehicle and to be reimbursed for its full purchase price of £xxxxx. I will give you seven (7) days to reply to me accepting, unconditionally, my request in principle and advising me of a date by which I will receive payment. If you do not respond, or you do not respond positively within this time period, I shall send you a letter before action that will outline my intention to recover the full amount plus interest , costs and compensation through the Courts. Once an agreement has been reached to the points contained within this letter, you are entitled to the return of the vehicle to your business premises (at your own expense). If they ask to inspect the vehicle do I have to permit them to take it away or can I refuse and demand a refund? One final note, I paid for the majority of the vehicle on Credit Card to cover me under Consumer Credit Act. Thanks,
18. Hi all, Basically I'm looking for a bit of advice really, I was involved in a car accident on the 23/06/14. I approached a dual carriageway roundabout in the middle lane and the third party was in the left hand lane after going past the first exit the third party appeared to be wanting to turn right at the roundabout and me going straight over he collided with the rear end of my car damaging the door, around the wheel arch and wheel of my car, his car is damaged on the drivers side wing next to the indicator. Immediately the third party blamed me for being in the wrong lane, which I wasn't, unfortunately no witnesses either. I Immediately contacted my insurance company and explained to them what had happened and they soon collected my car to be repaired. This is the situation My insurance company have told me worst case scenario if he blames me it will be 50/50 which I'm not happy about as it wasn't my fault. As either insurance company hasn't decided who's at fault yet I might be worrying for no reason. But on the other hand I want to be prepared for the 50/50 fault claim. Can I contest it? My cover has legal cover so can I use one of their approved solicitors to defend my case? Any other avenue I can take? I'm not very clued up on this, I've been driving for over 10 years with 9 years no claims never been involved in an accident so this is all new to me. Any help would be a massive stress relief and massively appreciated
19. I bought a treadmill from a company called MK Trading via Amazon in October 2013. In February 2014 the belt started slipping all the way to the side and rubbing against the motor. Following the instructions to adjust the belt only worked for a few moments of walking on it and the belt slipped again. I asked the company for a replacement but the refused and it got repaired instead. I tried it once when it returned and seemed to be ok but then I had an operation so it sat in my hallway doing nothing till this week. Again belt slipping so I contacted the company asking for a refund. I am sure I read somewhere but can't find it that if it is not a permanent repair you are entitled to a replacement or refund? Anyway the company refused to refund me and have implied that the treadmill belt is a maintenance thing I should do at home, despite the fact i would have to do it every 30 seconds! I wrote to Amaon who were no help, company now saying they will collect it for inspection and repair it again, only if this second repair does not work will they offer me a replacement. Do I have to accept this offer? I really think another repair is a waste of time as the same thing will happen again. Would be grateful for any advice, thanks in anticipation.
20. Hello All, i bought a morphy richard 9 in 1 steamer from argos and had to take it back because the handheld leaked water - had no problem what so ever getting another model (vax s6). so i used it yesterday and two problems arose. 1) the tube got extremely hot - and i mean extremely hot, comparing it to the morphy richard and another model my sister uses. 2) i had hot steam coming out from the cap where you put the water on the 3rd try. - i took a quick video of this so i took it into Argos asking for a refund (wouldve liked another model but didnt do any research as to which one to get so just asked fro a refund) and so it begins.. the man that was serving me - i think he was the team leader or the store manager - was checking the model out. fair enough. but according to him, the tubes "hot level" was acceptable and the steamer didnt let any steam escape via the water hole. My problems are: how hot would the tube have to get to call it acceptable for a steamer?, because to me i couldnt not even touch the tube and was shouting at my children to stay away from the tube, and comparing to another 2 models, i felt it was way hotter. Also how do i prove that i closed the lid properly on the 3rd go and the steam still escaped? as he is saying i didnt close it properly. so he took it in for over the weekend to check. my concerns are that what if the problems arose were intermittent?, and he doesnt find it..... i mean to him the tube wasnt hot but to me it was and i dont want to use as i have a 1yr old who waddles about, and a 3 yr old and 2 other children (whom im not worried about as they can avoid coming next to it if i tell them). surely this is a safety issue for my kids if nt anything? any help greatly appreciated
21. Hi folks sorry if im going over old ground, to cut a long story short i bought a car from AC and within 7 days it broke down with an inherent fault, the code of which we have documented 5 times by the AA over the last year, the car did go in for repair during the warranty period (was in garage for 53 days at one point) but the obvious fault was never dealt with and we feel the car was managed to get it through the warranty period, is it worth getting a solicitor involved or is there any other people who can help us get our money back, unfortunately our house insurance has legal aid but it wont cover motoring claims. We are waiting to hear back from my credit card as i payed a deposit with that, what is the chances we will see anything back!? Cheers for any info
22. A close family member was driving her car on a roundabout when a cyclist left the pavement attempting to reach the roundabout itself, ie not joining the traffic but crossing it and collided with her car (he was fine, luckily). It was caught on CCTV by a house on the roundabout and several police cars arrived, two of which were traffic vehicles and the rest local police vehicles. The traffic officers went into the house, watched the CCTV and told us it absolutely wasn't her fault and she had nothing to worry about, the cyclist had inexplicably cycled directly into her path. There was some damage (ultimately costing almost £1000) so she went through her insurance. She's come to renew her insure now and has found that the insurance company has recorded the claim as being her fault! She has protected no claims but it is still affecting her quotes with the same insurance company and other companies. Any advice on what could be done to remedy this as obviously it isn't true that she was at fault.
23. Have a Vauxhall insignia 1.8i SRI Nav - under 29000 miles. Now 5 months out of 3 year standard warranty as car bought 2nd hand. Had problems with coolant during warranty. Dealer replaced thermostat and at another time they topped up coolant. I have advised that this is now a latent defect and should be covered under warranty. Both the dealer and Vauxhall are stating warranty expiry but as a gesture of goodwill have given me 50% off a £500+ bill to replace thermostat housing and cooler pipe!! I am sick to the teeth phoning and mailing arguing the point. I have mentioned that this cannot be wear and tear but I keep getting the same garbage back. Any advise how I take this forward? I am actually in the process of selling the car as I have no confidence in it!! To add, I get 25 MPG on average. Dealer tells me its my driving!!! Vauxhall advise I have it checked. Dealer is willing to check free of charge but I won't hold my breath for an improvement or remedial works done free of charge!!!
24. Dear all, My first post here I will try and make this as simple as I can. Car in question is a 12 year old vehicle (rover 75) which are prone to head gasket failure the vehicle had done 99000 miles when we had our first failure in August of last year, the vehicle in otherwise excellent condition and maintained regardless of cost. The vehicle did hit high on the temp gauge and was stopped immediately, the vehicle was recovered by the AA to our local garage The garage: the garage in question is a local out of town garage that we have used for servicing and mot work since moving into the area 3 years ago. We had been happy with the work carried out and the cost but not always with their organisation skills or communication but on the whole a good service The garage, initially said they would look at the car within 48 hours, this didn't happen it took close to four days of me calling them to eventually be told it needed further investigation. I asked them to go ahead and strip the head to see what damage was done it then took a further two days to hear the result( I called them) the head was sent to be checked and skimmed and returned I asked that parts such as cambelt, water pump, thermostat etc were replaced at the same time Three to Four days later I was able to pick the car up after paying the almost agreed rice of £1924 (actually £60 higher than expected) The car ran fine up until just before Christmas when it get hot again, it cooled I checked water levels, all seemed OK the following Monday I took it into the garage for them to check (along with an MOT) I was told a small pipe from the radiator had perished and would need replacing (replaced) and I had a pin sized hole in my radiator but it was not urgent and I should keep an eye on the coolant levels. As this was on top of Christmas, and £364 MOT bill i was happy to hear the radiator was not urgent, 4 days later steam high temp gauge and a recovery back to the garage It took almost a week of constant calling before they could tell me they had looked at the vehicle but would need further investigation, I received several rather "scripted" reply's about how I had been told about my radiator and checking my levels, which I found rather suspect. I then started to visit the garage after work in search of the manager, but he always seemed to be out. I eventually caught up with him on a Saturday morning, where he told me it was indeed head gasket failure again but his work or parts were not at fault. He claims the vehicle would not have traveled 6000 miles if there was a problem with his work or parts. I am lucky enough to know a mechanic who works for a main dealer and has 20 years experience who has told me the reasons why it cannot be the fault of the radiator and that water under pressure was merely looking for a weak spot, how there was a possible issue with the block itself or any number of faulty parts, or dodgy work may have caused this. Still the garage owner is adamant that he is not at fault and I have left my vehicle in his yard for close to 6 weeks with no contact from him, after he agreed to find out the price for a recon engine. The garage contacted me this Saturday and asked what I was doing with the car, and I simply reminded them I was waiting on a price for another engine I know this is a lot of information but I needed to tell the full story, Something isn't right here and maybe i'm wrongly suspicious. Communication with the garage is difficult because they do not return calls or give vague answers and I feel i've gone as far as I can speaking direct to the garage. It is part of the autocare group, I have been in contact with a body they are affiliated with but they don't answer the phone! Any suggestions please
25. im going to keep this brief: I purchased a car of ebay trader having being told i was getting full recon engine, new turbo and six months warranty since buying car i have had lots of trouble of which dealer was aware of from 2nd of purchse. It started with bad oil leak turned out it where engine had been fitted wrong lots of bolts also damaged fitting engine also the engine is not a full recon just old block with original parts added and there is no warranty with garage plus more issues appeared with car. I have followed consumer rights info 14 day letter responded dont care if i go to trading standards they take years and in meantime your dont have a car. 30 day pre-court no response After looking into where i stand i was told win in court but never get a penny out of him just throwing good money at bad but trading standards should be dealing with anyway he broke 3 laws in place to protect us from them. 1. dealer and garage fiddled service book to up value of vehicle 2. dealer sold car not to standard as advertised 3 dealer sold car not fit for purpose Took all evidence to trading standards where i was informed due to cut backs there not really dealing with the traders breaking the laws but you can take him to court but its a lottery, probley better if you just fix car and forget it. I stuck now as where i go with this and who to see to help fight agaist this matter of trading standards turn turning a blind eye any help here guys.
