  1. Hi. I recently submitted a complaint to Clydesdale Bank Plc regarding a credit card I had dating from early 1997. The complaint was declined, and I subsequently complained to the Financial Ombudsman. The good news is that the Ombudsman wrote saying that the Clydesdale were going to make me an "offer". Of course, I'm still waiting, and so to pass the time, I've put together a spreadsheet based on a previous one that I've seen used that calculates the PPI amount plus paid CC interest and then adds on statutory simple 8% interest to both. I guess I wanted to know if my assumptions are correct. Depending on the APR that I used, my calculations indicate that I could be due a compensation payment of anywhere from around 8K to > 40K even as high as 76K potentially (depends on how the calc is done). (As background, for a long time before my current job, I was stuck in the proverbial hole, card maxed out, paying interest by the bucketload and also paying late charges and the like - couldn't get out of it - mostly paid the minumum, or ran behind, it was a nightmare!). Potential Claim : 76,484.31 PPI Paid: 4,328.45 CC Interest Paid : 31,759.29 8% Simple on Principle Plus Int : 40,396.57 Two questions: 1. Have I got the calcs right? 2. Can I claim 8% on the credit card interest that I've calculated to have paid as well (i.e. 8% on the 31K as per my calls, or just 8% on the PPI figure of 4.3K?)   2. Hi, I am in the process of trying to source a mortgage however the fact that I have historic defaults on my credit files from telecom companies is causing me problems. These are all with Lowell and range from 4 years to 5 years old. What's the best way of dealing with this to ultimately get the defaults removed off my credit file within the next 3 months due to wanting to take advantage of a "right to buy" offer we have. Obviously I am NOT saying that I don't want to pay these however if its best to go down the "final settlement" route as long as the default is removed etc than I am happy to look at that? Some of the defaults I genuinely don't have a clue what they are and would protest against them if time was not against me. any help would be gratefully received. Many Thanks Scott
  3. RBS made me an offer of £2k for ppi from 2003 They said they would pay me by cheque. However, the other day I had a message saying "we have deposited the money into your current account. On checking this I found that they hadn't deposited into my account, but to their own holding account pending further investigations. I phoned the ppi office to be told that the loan on which I claimed the ppi had arrears and so they were investigating. However, I then phoned RBS credit management and they confirmed I had no outstanding debts, but then claimed they still need to investigate. If they suspected this, why did they agree that ppi was refundable and why can't they find any evidence. Really frustrating! I have to wait another 28 days now while they investigate. Anyone dealt with this before?
  4. Hi all, About 12 months ago my partner and I bought three ceiling lights from Dunelm and fitted them using the recommended bulbs. Over the past 12 months dark stains have appeared on our ceiling above each bulb. A sample light was sent back to Dunelm who investigated the issue with the supplier and eventually accepted liability, offering to pay to have our ceilings repainted. This is all great and we're happy with the service. We obtained quotes and sent a middle-of-the-road quote to Dunelm for approval, however they refuse to send me the money, instead insisting the money is paid directly to the decorator we contract to do the work. I have a few issues with this. It's not the decorator who has suffered a loss, we have, so why is not us who are compensated for an agreed sum? Second, I have never paid upfront for any work in the past, which appears to be what Dunelm expect me to do in effect. I guess my question is, is there any basis on which to insist it is me who is compensated, leaving me free to contract whomever I wish?
  5. Hi, I've been Chasing the Clydesdale bank for 4 years over mis-sold ppi from 1991 . I received an offer from them this week and was wondering if anyone could help me with the offer calculations, I am struggling to work out if the calculations are fair and correct. The loan amount was for £4800, taken out in August 1991 over 5 years & the monthly repayments were £149.47. The offer details are PPI premiums paid £1343.52 Plus 15% simple interest £47.78 Plus 8% simple interest £2468.65 Minus 20% incometax on simple interest £503.29 Total compensation due £3356.66 Not sure if the PPI premium was loaded upfront at the start of the loan or if the premiums were taken with each monthly instalment. If someone could please explain how they worked it out and if its correct,I just can't get my head around it. Much Appreciated Thanks
  6. Dear All, I need some advice for my wife. We have had a terrible postal problem; after reporting our postman for an incident over a year ago some of our mail seems to simply go missing - I wonder why? My wife received last august a witness statement for a court date for speeding and failure to provide - we had received no NIP, no reminder and no summons. We contacted the ticket office and explained about our post, and they agreed to fine her and give her 3 points for the speeding, but drop the offence under 172. Later on in 2016 a neighbour brought round a summons for, wait for it, failure to provide and speeding. We initially thought that this was for the ticket earlier on in the year but realised it was a separate incident at exactly the same GATSO! This time, we hadn't received the NIP or reminder, and the Summons clearly addressed to us at No 14 was delivered to no.29 round the corner, and the lady asked around and found out we lived at 14 and brought it round. Guilty of the speeding or not, my wife couldn't keep accepting points and a fine like this, so we decided to plead not guilty and to explain to the magistrates. We have had a letter drafted and signed by our neighbours confirming the above, and have had Royal Mail conduct an investigation into our mail not being delivered. The investigation is ongoing, but they have found no wrong doing at this moment in time. However, what they have said is that the Courts use proof of posting only, whereby bulk mail is signed for by the postal service as collected and therefore "posted". But they have also stated proof of posting IS NOT PROOF OF DELIVERY to the recipient, and that the recipient has NO CONTRACT with Royal Mail, their customer is the Court in this case and it really should be them that complains if their mail that they have PAID FOR is not delivered. They have looked at our complaint only on the basis that several items of our mail have gone missing over time and that there may be an issue. So we were going to go to Court and to state that the NIP etc was not delivered within the 14 days allowed, arguing that the post is the Court's responsibility, therefore both charges should be struck out. I know that there be many cases whereby someone simply states they didn't receive the NIP, and that the Court "get around this" with their proof of posting as is taken as papers are deemed served, end of. But surely if there is a genuine doubt if the NIP has not been delivered then this should be listened to? Whats thrown me today is that the CPS have written to us (again similar to last time) offering that the charge under 172 be dropped if we change the speeding offence to that of guilty and accept points and a fine? Really don't know what to tell my wife to do? Suggestions would be appreciated.
  7. Hi all, Last Friday I was taken by a surprise to have received a 'Conditional Offer of fixed penalty' from Met police for the alleged offence. Use of a motor vehicle with tyre with any of the ply/cord exposed. Now the reason I was taken by surprise is because I had no knowledge of it but car and details are mine. I can prove that I was not even in the country so it could not have been me. the date is early November 2016 and speaking with close family, It dawned upon me that my cousin who holds a provisional licence took that car on that day and when stopped used my details. Now my cousin is no longer in the country and have moved back to Switzerland. If it was only a matter of £100 fine, it would have just paid and be done with it but i read it says 3 points too.. Any suggestions?
  8. Advice needed - I had been paying an old debt (around £2000) which originated from an overdraft at Nationwide through Fredricksons at £30 per month, and it got down to around £1255. Then for some unknown reason Nationwide moved the debt to ARC (Europe). Just had my first contact with them on the phone, and asked them if they would be interested in a low settlement offer instead of starting up the low payments again (I have the money as in good shape now) I suggested 10% which they laughed at, but they came back with a 50% settlement offer which they are going to put in writing. And would be marked on credit file as 'partially settled'. Is it worth me doing this? I am trying to rebuild my credit file gradually in the hope that one day in the future we might be able to apply for a mortgage. I don't think this account has much of an impact on it as it falls under the closed accounts section, but for 50% I could make it go away and not be bothered by this new agency again. What do you think? Any advice much appreciated...

I instituted a legal claim for £14k, plus court fee (~£1k), plus interest (~£7k) (Litigant in person) (Total claim is thus almost £22k) The claim was almost statute barred when filed, and if filed today would be statute barred. The claim is currently subject to a 1 month stay until February and the defendant has written to me offering to settle for £16k. I am inclined to accept. They have sent me a letter (via email) which reads "Without prejudice except as to costs ... Without any admission of liability or wrongdoing we confirm that we would be prepared to offer you the sum of £16,000 in full and final settlement of all claims which you have or may have against us in relation to the Claim. Please confirm your agreement to the terms of this settlement by: 1. signing a copy of this letter and returning it to us at the postal address above 2. writing to County Court Business Centre (“CCBC”) to inform them that you want to discontinue the Claim. Once we have received a signed copy of this letter from you and we obtain confirmation from CCBC that the Claim has been dropped, we shall arrange for the payment set out above to be made into your bank account (details of which you will need to provide to us). " And then at the bottom there is a space for me to sign. (And none for them) So very simple. I just wonder if this is valid and binding on them, or do I need to turn it into a Part 36 Offer?

  12. I have a charge order placed on my house by Bristol & Wessex Water for £1800. They recently sent me a letter stating that if I don't pay the full amount they will be taking legal action and apply for an order for sale. I then will be sent an order to vacate my property within 28 days. My house is owned outright with no mortgage and currently valued around £200K. I am living on a small private pension with no chance of paying back the debt. I went to the CAB who told me that I will end up homeless and living on the streets as there is no social housing available for single men. The Water company placed a CCJ on my credit record so it's impossible for me to borrow money to pay back the debt and keep my house. I could never understand why there were homeless people on the streets, but I do now. I will be joining them soon. What an idiot I was buying a house. If I had a council house I would have nothing to worry about and a safe roof over my head. I know a chap near here who lives in a housing association bungalow. He owes banks £73k and will not end up homeless. Comments welcome.
  13. Hi I'm hoping you can help my sister with this quandary. She has some mortgage arrears for various reasons but they are now wanting to sort this issue out. A court hearing has been booked but her mortgage company have called and said they are willing to help and look at options. The arrears are around £5800. Going forward they can pay the contractual monthly payment plus an amount towards the arrears. The mortgage company say they will consider this but a i and e form must be completed. So I'm trying to help her work out what might be seen as a reasonable offer Their income is £2700 pm and essential dd etc including mortgage is £1715. On top of that we've allowed for food and a few other bits. So the remains non essential balance pm is £500. How much of that should she offer and leave herself for entertainment, unexpected expenses etc which would seem fair to mortgage company or potentially a judge.

  15. Hello helpful people. First off a huge thanks to all who have posted here, you have helped this long-time "lurker" to a successfully upheld claim with the Halifax for my credit card PPI. My card has had a largish balance on it for nearly all of its 15 years and my average PPI payment per month has been £28, with many payments £30-£35. My situation is thus. The SAR came back with ALL statements and payment details going right back to the issuing of the card in June 1999, so there should be no guessing or averaging on the part of the bank. I painstakingly input all the details into the spreadsheet posted on this forum (The running credit one titled "FosRunningPPI v102.xls") twice! and got the same settlement figure order of £26K both times. Halifax have now written to me upholding my complaint and made a final response offer of almost £16K. They are saying that I have 28 days in which to accept the offer, or to call them if I am unhappy with the decision. How accurate is that spreadsheet above in terms of how the account should be reconstructed? Could there be any other reason for such a discrepancy? I'd would like to contest the amount if it is wrong but don't want to end up like that guy who was offered £22,000 and ended up with £3,500!! Thanks for any help and advice. Much appreciated.

I received a form today from "together" (Blemain Finance) stating that I was due a refund for incorrectly added fees plus interest etc. They asked for bank details or confirmation of address to send a cheque, I vaguely remember Blemain finance but not what I had from them, could this be a way for them to confirm my details and then start proceedings against me for something I am unaware of? I did get into financial difficulties some years ago but have not heard anything and believe all outstanding matters were resolved, could this be a [problem]?

  18. Hi all Need some help Just received a PPI refund offer from Barclaycard. PPI began on 4th Nov 1999 and ended on 7th Nov 2000. The account is now closed. barclaycard dont have any statements etc from this time so have estimated the refund based on average figures. The offer below is based on "average amounts we would refund someone who was sold a comparable policy on a credit card held for a similar time period" Refund of Payments made for PPI cover charged on a comparable policy £240.55 Refund of interest charged on PPI Premiums charged on a comparable policy £126.28 Statutory Compensation £155.17 Income Tax Deduction £31.03 Total Refund £490.97 So, does that sound right? Or can i add interest? if I can, is it simple or compound? is it 8% or circa 24.9% which I think was the rate charged by Barclaycard. I have looked on the forums and googled this but have lots of differing answers and opinions but would really appreciate something definitive. I remember the card limit being £2500-2700 and I would have been close to that most months Thanks for the help Sausage
  19. Elderly parents cold called by British Gas and talked into having Smart Meters fitted with the promise that they could then choose to have free energy either on Saturday or Sunday. Meters duly fitted, told by engineer to call to pick their day, only then are they told they can't have the free energy until they set up an online account. Had they been told that from the outset they wouldn't have bothered as they don't have wifi, don't trust online stuff and are probably beyond learning how to do it now anyway. BG have given them £30 for their failure to mention the online requirement, but they're still disappointed.
  20. Hi everyone, I think I have made a mistake. Selling a house via purplebricks. The house went under offer within 4 weeks of been on market but still no exchange 6mths on. Having spoken to other local agent I'm not the only one. The problem I think is how their fee's are structure, basically they always get there money in 10mths, after that time what incentive is left? Also I found this having done more research I did an internet search and found an article under HSBC investments stating only 14% of sales convert to exchange.is anyone else having problems? If so what can I do about my situation?
  21. Hi, Excuse the lack of detail as i do not actually know anything and i only called Natwest as a PPI claim company kept hassling me and indicated you could of had PPI even though rejected. This was back in 2004 i had a loan i don't know the value exactly or period etc, this was refinanced with another loan with then a couple of times (loan chain) I think the first loan was 2 or 3k. over 2 maybe 3 years They came back with a some forms to fill Declaration and acceptance i just want to understand whether the banks offer is likely to be trustworthy. main wording being, I wish to accept the Banks net offer of £705, in full and final settlement of all or any claims which i might have against RBS for loan account number xxx **edit sorry the loan chains letter have same working but different figures in total it adds up to roughly £850 Thanks in advance for any help or advice you can add or give, if not then thank you for looking and have a great day ;-) Best regards
  22. My son has a personal injury claim originally valued at £20k. The solicitor was working on a 25% no win no fee basis. however, a few months ago he found out that the solicitor had failed to advise at the outset that he could have had union backing, so it was agreed they would discount the 25% fee etc. The matter should be going to trial in circa six months, but the soilicitor has now written advising that he wishes to offer the defendent the opportunity to settle for £8k pursuant to CPR 36. This is a 60% reduction on the claim value which doesn't seem right to me. Any advice on this would be appreciated. Regards
  23. Today in the post we had an offer of 15% off our subscription if we took up the offer. I logged into the address given as I wanted to see how it would apply in our case as we have the movies on discount at present. There was a button that you needed to click and I thought in doing so I woudl be able to get more information and how mcuh the discount would be. T o see this info I had to log in which I did and on logging in got a message that I had now got the discount and was locked into a 12 month contract and it seems there is no way to cancel this as we do not want to be locked into any contract. Seems a very underhand way of locking people into contracts as no "Confirm" button or being able to view the discount before confirming.

  25. A few weeks ago I boarded a train from Malvern Link to Worcester Foregate Street without first buying a ticket. There were long queues at the ticket office and automated machine, so I stupidly just got on the train and asked the conductor to buy one then. He was having none of it, took my details and warned me I'd get a letter in the post. That letter has now arrived from First Great Western, saying they are offering me the chance to settle the matter out of court by paying £85.20. If I don't pay, I could be issued with a court summons. I know I was in the wrong, I know I should've bought a ticket first, but the amount seems disproportionate - the fare was £5.20. Can anyone advise what I should do? Will they actually take me to court? Also, why wasn't it a penalty fare of £20? As far as I can tell, looking on the National Rail website, it should've been.
