  1. Good day ! I have a very old debt with Hsbc and really need some help, please. I had 2 accounts with hsbc - set up start 2003. A business account - which was simply me trading as XXX. Had a healthy Turnover and with an agreed unsecured o/d of £3k. And a personal account, again healthy with an agreed unsecured o/d of £500. The Business Account was closed end 05. Owing nothing. I continued to trade only using my Personal Acc. Between my business and property rental I had enough healthy flow of income for Hsbc to increase my o/d to £25k by start 2005. The o/d was an "On-demand Form"; Unsecured. However, during 2005 I started to have financial problems and ended up owing the whole o/d amount of £25k. By the end of 2005 Hsbc wanted to transfer my o/d into a Managed Loan Agreement. They sent the papers, but I never signed. So then Hsbc handed over the whole debt to a DCA, Metropolitan. I paid them a nominal monthly amount for 3 years. Then Hsbc wrote, start 09, saying they had assigned the total debt to CL Finance. Again I have been paying a nominal monthly amount for almost 5 years. In total I have paid back apx £4k to these DCAs. I missed a couple payments this year. CL have just written demanding immediate payment of the £20k and threatening Court Action. What can I do ? The debt is unsecured. I do not have the ability to clear the outstanding o/d amount. Would be most grateful for advice. Many thanks x Anyone ?? Can I send a template letter to CL Finance ? Like a SAR ? What form do I send into CL to see if the unsecured overdraft is enforceable ?   2. HSBC now owns HFC Bank in Brighton. I wrote to HSBC Coventry PPI claims office giving my name, DOB and precise former address, last week, but they replied to say: no records of my account can be found after 32 years, and that they are not legally obliged to retain documents beyond the statutory period if an account was closed. I also opened a Loan Account in Bournemouth and fully repaid around 1983. -- same answer from HSBC: no records. I myself have retained no records whatsoever, but I am absolutely certain I had those accounts, and 70% sure there was PPI as was standard custom in those days. Is this a dead end? Should I invest in £10 requesting a SAR, if so SAR sent to HSBC Coventry or to HFC Bank in Brighton? Later to complain to FOS if we suspect HSBC does have records? Thanks to all for sharing experience.
  3. Happy New Year to all! I have contacted HSBC using their online contact form about PPI that i took out with an old Marbles credit card. They have replied giving a credit card number and the start date, the also confirm PPI was paid. Reading other posts I see its best to start with a SAR request, can anyone advise the current address for making SAR requests or is it the standard complaints address : HSBC UK Bank plc, Complaints Department, POBox 5207, Coventry, CV3 8FB ​Thanks in advance
  4. Hi, HSBC responded to SAR request as nothing on the system for 2003 - 2004. Then after I sent them a policy number for CRP PPI on closed credit card. We have an offer as Full and Final settlement of Miss Sold policy! Premiums total £150 Redress Total £460 inc premium. Does this look about right? Many Thanks
  5. Mrs Echodale is being harranged by Cabot over HSBC credit card debt . HSBC agreed that if she made sixty payments of £xx then she could save £1800 and would not need to make any more payments after July 2018. She has honoured the agreement and made last payment as agreed. Cabot apparently bought the debt a few years ago and are chasing the £1800, they say they have contacted HSBC and have been advised that no such arrangement exists. We have the original Metropolitan/HSBC letter from 2013 and even though the onus is upon Cabot to 'prove it' we have sent them a copy. I think next step is to send a formal complaint to both organisations. Any advice welcome.

  7. Hello everyone I’m looking to get some help if possible please my partner recently applied to open a new HSBC bank account for the cash incentive via the online system. The account she applied for some reason was declined but then instantly offered a standard basic account instead which she accepted and the card and pin arrived a few days later. The following week another letter arrived in a large envelope again from hsbc this time stating they had now closed the account without warning or notice due to not meeting the banks criteria. Strange but ok fair enough she’s not wanted as a customer until she noticed it was hand signed by someone from the fraud analyst department Becoming very worried she contacted the bank who refused to tell her anything and was then advised to send a SAR request to HSBC bank and also CIFAS. Friday she received a letter from CIFAS with a Single CIFAS FRAUD listing from HSBC BANK under the heading APPLICATION FRAUD that she did not list a previous address with adverse history APPLICATION GRANTED This is absolutely disgusting she’s done nothing wrong currently been living in the same house since June 2014 so we’ll over 4 years now. HSBC application page clearly asks for 3 years address history which she’s obviously listed her current address so nothing makes sense at all. She’s sent the HSBC ceo a email who’s replied today with this ( I can understand your frustration in that we ask for any addresses in the last three years and you moved four years ago, so shouldn't have to supply another address. However, we had information there was adverse credit data accrued in your name at a different address within the last three years. I'm very sorry for any confusion caused but we have correctly followed our process. We also correctly reported the instance to CIFAS, as we have an obligation to do. I'm understand this may not be the outcome you were looking for but I hope this has helped to explain our position. If you feel the information we had was incorrect, you may want to check with the Credit Reference Agencies. We use three agencies, Experian, Equifax and Call Credit. ) We are both extremely upset and worried about this issue as she’s done absolutely nothing wrong and is now obviously petrified that all her other financial dealings with other banks etc will see this and close everything down. What do you suggest we now do and has anyone else had issues like this previously that could advise we would be very grateful
  8. I was in a relationship with a man who was both physically and emotionally abusive. He had used my bank account to commit fraud and HSBC held me liable for the debt from the fraud which is £9,566. I managed to find another place to move to and made sure I was virtually untraceable on social media and the internet. I never told the police about the abuse at the time for fear of him being arrested then released and onto me. However I did report the fraud to the police through Action Fraud and they replied a few months later saying that they cannot follow up on it as there is not enough evidence. Now HSBC are harassing me to pay back the debt, I'm a 22 year old student who cannot pay back such a large amount. Although I am terrified of him I tried to locate him so the police can find him yet he is nowhere to be found and I believe now that he had been using a fake identity whilst with me. HSBC have been immensely unhelpful, I have gone back and forth into branches and made numerous phone calls which have all been useless and I cannot take out debt relief management plans or file for bankruptcy because the debt is from fraud. They also filed a CIFAS flag marker against my name so I have to use an online bank now and will not be able to get jobs in many sectors when I finish uni, for 6 years. I opened a case with the Financial Ombudsman which is taking a long time but have been studying hundreds of their decisions on similar cases and they never rule in the favour of the victim/consumer, so I am not confident. What do I do?
  9. I wonder if anyone can help me regarding a claim form my daughter in law has received from Shoosmiths, regarding an overdraft from HSBC bank. She has sketchy information and is suffering with cancer so difficult to find out too much regarding past details. I know she had a £5000 overdraft on her cleaning business about 7 years ago. The debt was passed to Arrow Global in 2012 (this information is from Experian) and the sum owing says £5500. On the claim form it says the debt was assigned to Arrow Global in 2016 and the debt is for £6000 plus £600 for court costs. I didn't think they could add anymore charges once an account was defaulted? She did send a letter to HSBC we think in 2011 to ask for a consumer credit agreement but HSBC said they didn't have one, unfortunately she doesn't have a copy of that letter. Also she thinks the account hasn't been paid or any communication for over six years which I understand would make it statue barred? She received the claim form on the 12th June but the date on the form is 7th June so I am assuming she has until the 21st June if she is defending it and 21 days if admitting it. She wants to send Shoosmiths a letter telling them it is statue barred but I wonder if that is the best way? Any advice would be greatly appreciated.
  10. I am looking for some advice with respect to a PPI refund and compensation in connection with a former Endeaour loan. I had a compensation refund in 2015 which was based on premiums I had paid from 2002 - 2013. But I did not know if it had been calculated properly because although I had requested that the PPI be cancelled in 2013 all my loan account statements from Endeavour/HSBC and subsequently Sancopia Portfolio showed premium payments . I then spent 3 years trying to find out how HSBC reached their compensation figure and which premium payments were used for the calculation. Finally after escalating it to an FCA case I was sent the HSBC spreadsheet for the calculation which did not include any premiums from 2013 - 2015. HSBC say that the premiums from 2013 - 2015 were reversed and they have sent the FCA a screenshot form their internal systems which show that the premiums were reversed and refunded. FCA say they are satisfied that 8 of the 15 payments have been reversed. What I would advice on is whether this is correct if they are still showing on the loan account statement i.e if there is no corresponding reduction of the loan account to reflect these reversals. As a result of this long running issue, I have the internal HSBC PPI compensation spreadsheet with all formulas. I am more than happy it with the CAG if it can help others succeed with their claims. Advice would be much appreciated.
  11. Quick question. If you have already had a bad debt (sorry minds gone blank on the word) on your credit file for 5 years on a debit (the 5 years is now over) and the creditor can't find ur CCA agreement and you moved home. Forgot to inform the creditor and a letter from a different creditor (11of them) turns up on your door step. (10 statements and one letter to say I've failed to inform them). Can they issue a CCJ against my file on the same debt? Also do I have to inform them I now do live at this address. They asked me to contact them without further delay to confirm how I propose to lay off my outstanding balance (like that's going to happen)
  12. Hello, I am in the process of trying to sort out my partners finances. He has several debts but I will post them in different threads. The first is 1st Credit and HSBC. I thought it was a credit card so sent off a CCA request to which he got a fairly standard reply that they were sorry he has a dispute and they would contact the original company for more information. Fast forward about three weeks and he received a package of papers containing a covering letter saying that debt relates to an overdraft and is therefore exempt from Part V of the Consumer Credit Act 1974; a facility letter; default terms and conditions (dated 2014) and a load of statements. I know I did the wrong thing by using a CCA request. Anything I can do to rectify the situation now?
  13. Hi, I am looking for some concrete advice please on where I stand with a debt that's hanging over me. The debt is for around £9k and was originally a HSBC credit card. I received a CCJ toward the end of 2013, along with a Charging Order against my property, which I unfortunately didn't contest. As I am self-employed and have children, there has been no enforcement action that the courts would take against me, so I have never paid anything toward the debt, or acknowledge it. HSBC gave up earlier this year and have sold the debt to Cabot. I have read a number of threads on this forum and others which contain a lot of conflicting information. So I guess my questions are: 1. Can I get the Charging Order removed on the basis HSBC no longer have an interested in the debt, or have Cabot effectively taken ownership of both? 2. Am I right in thinking Cabot have no enforcement options whatsoever unless they get the CCJ and CO re-assigned officially in the court? 3. Will Cabot likely affect a low F&F settlement to see the back of this debt, or do they usually hang on for the long run? 4. I believe there are probably at least 1-2k worth of charges and interest added to this credit card, can I pursue HSBC for them, and if they are awarded, can HSBC withhold it against the original debt?   14. HSBC UK have not complied with my Data Subject Access Request (SAR), submitted under the new General Data Protection Regulation (GDPR). The DSAR was requested on 16/06/2018 and should have been disclosed by 17/07/2018. 16/06/2018 - Request sent to HSBC UK for DSAR under new GDPR 18/06/2018 - Acknowledgement email received from HSBC UK Customer Care Team 22/06/2018 - Acknowledgement letter received from HSBC UK Data Protection Office 17/07/2018 - Data not received, so contacted HSBC UK who stated that they were not aware of this request and have not even started to gather data for the disclosure 17/07/2018 - Internal complaint made to HSBC UK Customer Complaints Team 18/07/2018 - Complaint made to Data Protection Office and Letter Before Action sent to HSBC UK. Telephoned Data Protection Office and confirmed that they have received both email and LBA. When asked for timescales in relation to compliance for my DSAR, a team manager has advised they don't know and cannot give any timescales. I have made them aware I will be reporting the non-compliance to the ICO, but they didn't seem at all bothered. 18/07/2018 - Information Compliant Handling Form submitted to ICO 18/07/2018 - Complaint acknowledgement received from ICO Next steps: Now waiting for the Data Protection Office to make contact with me to progress DSAR and also waiting for HSBC UK complaints team to pick up the complaint. No doubt this will be towards the end of the 8 FCA timescales! Also, waiting to see if HSBC UK will comply within the 5 working days afforded to them in my LBA. I very much doubt they will, due to the large amount of data they will need to gather, redact and securely send on to me. Will potentially need to look at submission of a POC for a County Court claim if not. Submitting a GDPR POC is unchartered territory for me, so if it comes to that point, could really do with some help. Hints/Tips: Some may already be aware of this, but I was not. None of the calls received at the HSBC UK Data Protection Office are recorded. So when I asked for copies of all recordings to their department, they advised me of the above. Also, HSBC UK Data Protection Office don't advertise or easily give up there email address. So if you do need to email that team, you can do so here roi.poc.fulfilment@hsbc.com. It definitely works, as I have emailed them my LBA and complaint letter and they have received it the next day.
  15. I opened a current account with HSBC in December 2007. With various problems I had with PDL's clearing out my bank account, I became overdrawn and I changed banks to avoid them having access to my money. My salary went into my new bank account. With some transactions going through, it went into overdraft and then exceeded my overdraft as well. I argued with HSBC that I had requested these PDL's not to access my account, but I was given the old "You gave them your card details and you owe them money". The amount racked up purely with bank charges. According to my credit report, HSBC closed my bank account in May 2010. In exactly 43 days it will be 6 years since they closed the account. It was apparently sold on to Arrow Global in September 2014. Last week I received a phishing letter from Shoosmiths asking me if I was me living at my address. Ignored the letter. Yesterday received letter from Arrow Global saying the management of my account had been assigned to Shoosmiths and I should direct all correspondance to them. Ignoring that as well. Now my thoughts are this is already statute barred, as it would have been a few months between my last transaction/payment into the bank account and when they closed the account. Does anyone have an idea how quickly Shoosmiths ramp up their harrassment from when they send the first phishing letter to when they become more aggressive? I know that in 43 days it falls off my credit report.
  16. I have today received a CCJ claim from the Northampton County Court Bulk Centre, for a credit card that was held with HSBC a few years ago. The last statement I can find for the account is 2009, although the assignment to the DCA was later than that date. Having read through the forums for some advice (which is very handy and I'm very grateful for) I'm going to write to them tomorrow with a CPR31.14 requesting the agreement, default notice and the assignment. From people's past experiences, what are the chances of them providing this information? And do they have to provide the originals, or just legible copies of the originals? And am I correct in thinking the fee to enclose is £1? If they do provide the info as requested, and I have no other defence, I can't afford to pay them the amount they're requesting. I could offer to pay them a token amount every month or I could borrow a lump sum and make them an offer of a full and final settlement, although it would be much less than they're asking for. Either way would I still end up with a CCJ? Many thanks.
  17. Hi all, I'm planning to send a SAR to HSBC on behalf of a friend who holds a credit card, a current account, a savings account and a loan account with them. My friend lives in Jersey, where all dealings with HSBC have been conducted. Can anyone please confirm if a single SAR is sufficient to cover all of the above accounts and the correct address to which it should be forwarded, given the location being Jersey and I am unsure whether or not banks fall under the same legal jurisdiction and share the same administration offices as do those in the UK, or are classed as separate entities?   18. Hello All, I have received a letter telling me an old HSBC Credit Card was sold to Cabot Financial today and that they would be in touch shortly. The account is not statue barred. Whilst I am happy to enter into a repayment plan, I want to make sure that they have all their ducks lined up and have all the correct paperwork. I originally had a dispute with HSBC after they blocked the card on Christmas Eve and that very nearly left me stranded Birmingham Airport over the Christmas Period. At the time there were plenty of funds available on the card and it was the only card I had on my person at the time. Long story short I phoned them on the day asking why the card was not working and noone could explain it to me either. I was promised several callbacks which they never made and a resolution the same day which also did not materialise. As I couldn't buy the train ticket I needed, I had to take several buses to my Christmas destination which in all took over 10 hours to complete a 60 mile journey.......... As I hold an ENCTS pass this journey cost me nothing but did cause considerable inconvenience at the time. I made a complaint at the time and whilst they acknowledged the complaint, they did not respond and when it came to them wanting something (i.e. to pay the bill) I refused until the complaint was resolved to my satisfaction. Apparently they had nothing on file and still did not know the reason for the failure of the card. This contradicted what I was told on the day of the failure which was "A Back office team is working hard on this as we speak and it will be resolved shortly" which now appears to be from my perspective a complete lie. Fast forward to the issue at hand now, I received a letter that the account has been sold to Cabot Financial and that I will begin a game of letter tennis within the coming days. How is it best to proceed from here. I don't particularly want to furnish Crapbot with too much information. But I'm happy to do my homework and see what happens. Debt is for a Credit Card approx £1,800 I don't doubt for a second that Crapbot will take legal action eventually but I'd rather give them notice as it were that I know how to handle this matter. I'm thinking just a bog standard CCA Request uncrossed postal order and see what they come back with? Perhaps a SAR to HSBC as well?
  19. Hi, I have accumulated some relatively large charges from HSBC Business over the last few years, mainly for unauthorised overdrafts. Is it possible to have any of these refunded? I am in quite a bit of financial difficulty at the minute. I dont have any lending on this business account. I would also like to keep the account open, so dont want to do anything to harm that if possible. Thanks for reading! Jamie

Hi Ive just received a letter from Arrow stating that my debt with them (which i did not know i had) is now with Restons, I just called restons to find out what the debt was for and was told it was HSBC but passed to them from Arrow, i disputed the debt and was told that they would take legal action, I offered a settlement of £900 as the total of £1750, but it was declined Any advise please Thank You
  21. Feeling like I could do with some advice please. I have had 2 PPI's that HSBC have agreed to pay out on. I sent all the forms back on 16th Feb and was told that the offers were sent out to me that week. Nearly 7 weeks on and I have still had nothing in the post. I have been chasing weekly and have been promised calls back on 8 occasions. Can someone give me a direct email address of the head of complaints who deal with PPI at HSBC? With a husband who has been out of work for 8 months, this PPI payouts really will ease things for us and was hoping that they would have been in out account by the end of March. Any advice I'd be so very grateful for. Thanks in advance.
  22. Hi all, I was clearing out some paperwork today and found some old statements from an HSBC Credit card from 2004 - 2005. I was shocked to see some pretty massive payment protection payments every month, up to £70 in some months. I know that I had this credit card for many years, before and after this period, so I could have paid thousands in insurance. I genuinely don't remember if I paid this card off or not, I can't find any DCA letters chasing it up. Even if I didn't the debt would be long since statute barred. Last payment would have been made around 2007 ish. With a card this old, how would I go about kicking a PPI claim off? Also if I still owe the balance would HSBC simply be able to take the balance and pay it off against the loan?
  23. Hi- I had an HSBC credit card from 1998 to 2011. I read in other posts that people who opened a credit card this period had PPI on it I was able to find some statements from as far back as 2004 but I can't see any reference to PPI on them. Would that be included in the interest charge ? Should there be a separate charge for PPI? Is there anything else to look for on the statement that indicates PPI? Any advise would be appreciated. - Andy
  24. Hi all, I've got an SAR back from HSBC today. The last payment I physically made on this account (Loan) was on 28th June 2010 (a long time after it had defaulted). However I made a PPI reclaim on it which was credited to the outstanding balance on 16th June 2016. On the SAR this is listed as a payment from debtor. Would this have reset the statute barred clock, even though this payment was made without my consent? (Outstanding balance is now £1950) Also they haven't been actively chasing it, I only received a letter on the date the PPI reclaim went through asking me to call them. Since then there have been no letters. They also do not have my current address. Should I update them?
  25. Hi, I have read through a number of posts but only managed to confuse myself more, so thought i'd better just post. I have an old HSBC Current Account that I think was sold on in around 2000/2001 (memory a little hazy) to a DCA (but I cannot remember which one) and I paid them £1 a month. Around 2013 Cabot bought the debt and I continued to pay £1 a month. This was a joint account which they refused to acknowledge, said it was only in my name and they had no record of my partner on the debt - great! So fast forward to today. I stopped paying them in July this year, completely forgot as was paying by postal order - my own fault, and have since received the following letters: 05/10/2017 "Welcome to Cabot Credit Management Group that own your HSBC Bank Current Account. We have recently confirmed you are living at the above address and need to make you aware that we are now responsible for helping you manage your account and receiving future payments" Then a bit about contacting them etc. 22/10/2017 "We have recently confirmed that you are living at the above address. We do this through a variety of checks, so we're confident we have the correct address for you. We need to talk to you to arrange a repayment plan on your account; we can help you find an affordable solution. 06/11/2017 A bit about understanding how it's difficult to clear debt, we want to help etc then "We own your account and are prepared to reduce the balance in order to help you become free of this debt sooner. If you would like to take up this offer call us" I have a couple of questions: I have looked at other forum messages advising sending a CCA but I don't think this would apply to me as its a current account - is that correct? What would be the route for me to follow if I can't go down the CCA road? I've seen some info on pre 2007 agreements - does this have any bearing on my case? Can Cabot put the debt back on my credit file as a default, as i've stopped paying, even though its over 6 years old? I'm sorry for the long post and thank you very much for reading
