  1. Do santander still send you statements? I assume this is a joint account so you really can not afford to get a ccj. Do you work? You could look at turn2us.org as they have a list of people who give out grants to people in need and if your oh is a police officer there is probably one for them.
  2. I think they realise they have bought a pile of crap and are trying to salvage something by going after people who might not defend
  3. Economics is not an exact science or we wouldn't be in the **** now would we. I do think this government has it wrong in they seem to be penalizing the least well off much more than the middle classes.
  4. They are very slow and very stupid when it comes to replying to cca requests. So long as you have proof you sent it i.e recorded delivery with a pod i don't think you need any more.
  5. Sorry i assumed your partner had the dro or was it yours or did you both have one and if so why weren't most of the above debts included
  6. Ok so with the exception of the santander account i think you SHOULD be making payments. As for carphone warehouse do you have any proof? You could use that as a defence. I am sorry to disagree about discount means unenforceable as it doesn't. If a bank makes a decision to sell on a debt at say 25% the .ca can then offer you a discount and still make a huge profit. I understand what you are saying about a partnership but your partner went into a dro so all the debts became yours. Why inflate your disposable income when you don't need to. Its not about being a couple, its about doing what's best for you
  7. I think explaining your situation and offering a token payment along with your other debts would be a very wise course of action
  8. I do not understand Scottish law but if this was in England i believe what they are looking for is a county court judgement. This would mean you have to repay the debt. If it was me i would write to betterware in a manner that is not antagonistic and explain your situation and how it came about, then make an offer of repayment that you can afford. If you are not working then offer of£1 per month. As a betterware distributor you were i guess self employed. You may have a claim against betterware if and only if either of the people who lied to you were directly employed by them. If you need help on the technicalities hopefully someone can help you
  9. I fully understand the concept having done it myself. The opinion i was giving was fact based. It is not criminal proceedings they are looking at although if you have deliberately not paid them they could make a complaint to the police
  10. In my opinion you should not be including your partners income in your debts.
  11. You are in Scotland? I can only comment on English law. You would almost certainly get a ccj awarded against you which would seriously damage your credit rating for the next 6 years. That is in England and Wales . They are talking about civil proceedings and not criminal offence
  12. Well i am guessing that you have been talking to your creditors and thus acknowledging your debt so the option of waiting till they are statute barred is more difficult. Personally, if these debts are enforceable then i would write to each creditor with your offer backed up by a reasonable income and expenditure and await their reply. But i would send them all recorded. In your letter you need to ask for bank details as well so you can pay them.
  13. Just a suggestion. Surely part of cancelling the contract is returning the goods. If you are worried about claims you damaged it take pictures. I would return it and if there is any problems sue .
  14. I don't know,it could be theft or fraud but they are not talking about criminal proceedings are they. Debt in itself is not a criminal offence
  15. Well you should get some legal advice but i would suggest that in absence of the goods which you freely admit you received then you owe the cash and any claim against you would be successful
  16. The way you got this information doesn't just break rules it is also totally illegal. Unless you want your friend fired and potentially imprisoned you should think long and hard before using any of it. Of course as an upright citizen there is nothing to stop you tipping off the csa and dwp about rumours you hear such as they are living together. The fact you even have this information scares the hello out of me.
  17. Yes a refund or the next available flight. Of course if you have connections to catch with say a different airline and hotel accommodation booked it starts to get complicated. So you are booked on an emirates flight to say Hong Kong then a non related internal flight to somewhere in China, emirates alter the time so you miss your connection and can not get to your final destination you are screwed. This is why using travel professionals will be worth it. Even if it is an EU based airline but your hotels are booked separately and you opt for a refund will you get your money back for the hotels. All depends on booking conditions i guess
  18. Yes that is true for an EU based airline but they can change flight times and days in advance without paying compensation.
  19. Seems to me that airlines hold all the aces. They can overlook, change flights without compensation. Unless you book as a package through a bonded travel agent you really have little protection. Then people complain that they can book it say £5 cheaper direct.
  20. Has this actually gone through parliament yet as my council website says not.
  21. I tend to agree with Martin. In the absence of travel insurance you may well have to
  22. Without wishing to be rude this is why travel insurance is always recommended. If you have that you should be able to claim for your hotel costs.
