  1. What phone are you using? It's rare for handsets to download data without the user actually making the phone do so (via apps/ web browsing). It could be the phone is accessing it's makers website for software updates. This was a common billing issue I used to deal with when I worked for a telecoms company. You could ask the CEO's office if they would do a retrospective bill as though the data bundle was added prior to the exessive use. Is the data a necessary part of your phone's use? If not, try switching the data off on the phone when you don't need it and, I'm guessing your phone has Wi-Fi, use Wi-Fi as much as you can!

  4. Thanks DX. Would I be right in dividing the PPI amount I don't have statements for to give an equal amount from 2002 to 2005 (ie 365.36 - 97.46 / 36 months)? I will have to look at the statements/ notes to see if there is any APR they've charged as all I have on the summary is an "effective APR" which ranges from 6.6% to 89% (varies from month to month) which gives me an average APR of 22%!

  6. Finally got my data and nothing groundbreaking! However, is this offer right? Which includes a calculation from May 2002. 1: PPI refund £365.36 (Of which I have statements from May 2005 which show a total of £97.46) 2: Interest of £41.61 3: 8% Simple Interest of £312.48 The interest (2) seems a bit low in terms of compound interest going back to 2002 as I've divided the PPI amount we don't have statements for, at a monthly rate starting from May 2002 to May 2005 and at 11.9% I make the interest to be 10 times as much! Should I submit my alternate offer?
  7. I assume you mean the app itself is free as to actually download it would incurr data charges, unless your priceplan has data plan attached or are downloading via wi-fi!
  8. An update! Well, I'm on the verge of finally getting my data as they are sending it to my nearest branch. And we know they are lying as they can now see records going back to May 2005, despite the previous letter telling me they can only see until August 2006! They have offered a slightly higher amount for 2002 to present. I am going to await my data and see what it shows before accepting or making a new offer!
  9. Cracked Screens are usually caused by physical damage (dropping/ sat on etc) and are usually not covered by warranties. In the instance, you've described it's hard to say what the actual cause is without a proper inspection as a crack "under" the glass is either again, physical damage or by another fault such as the "known issues" you've highlighted. Did you take the phone into a T-Mobile store or is it being repaired via a phone call to Customer Services? If the latter and all you reported was a cracked screen, then T-Mobile would automatically assume it's the physical damage case. I would get Samsung to confirm to you in writing the "known issues" of the overheating/ cracking so you can persue that option if T-Mobile refuse to repair. You never know, they might repair it as the repair centre are aware of the known issues!
  10. According to the Passengers Charter for GatEx the Southern Penalty Fare is in operation between Gatwick and Brighton. Tickets can be bought on board without penalty between London and Gatwick.
  11. Firstly, what are the charges for? Texts, calls, data? Have you got a copy of your bill for those amounts? From the sounds of it, you have been charged for using data whilst abroad, that or answering a lot of calls (again, whilst abroad). The only thing I can think of is to write to T-Mobile and ask them to look at removing the £400 element as a goodwill considering the unusually high amount and that you have paid over half!
  12. Sorry, but when you say laughing at everyone are you sure he was't sharing a joke with people as the staff/ magistrates/ prosecutors do know each other and do bond? Secondly, if you are appealing to have your criminal record removed, how can that happen if you have admitted to committing the crime? Are you hoping for a re-trial so that you can plead not guilty? If you are successful, then you will have set a precedent and future criminals will be able to no longer have a criminal record, including your ****-of-the-earth chavs that you love so much!
  13. Thanks DX, I have sent them both a failure to comply and an Official Complaint letter detailing my displeasure at their actions. As for a guestimate, should I ask for the average PPI from the refund they've given me? I.e £110 over 10 months, therefore £11 per month from May 2002 to August 2006, plus the interest they've charged me?
  14. Here we go, some advice as it seems HSBC are proving to be a pain in the backside! I am still in the process of waiting for all my data to come from HSBC, despite sending off the initial request in April (This is now with the ICO and I have sent an official complaint to HSBC in this regards which has still gone unanswered). I thought I would send in a claim for my PPI to see what they would offer in June. Whilst they have upheld my complaint, the amount they are offering me only covers me from August 2006 to date as they have "no data prior" as they destroy the data. Yet they noted that my policy started in May 2002 but no offer to cover that date (which is convenient for them as the period between 2002 and 2006 was when it was used most). What are my next steps - a letter saying "jog on, where's my money from 2002 and 2006?" Are there FOS guidelines for this? Secondly, I would still like to see the statements, and has been referred to the ICO, can I tell them that I will accept, or make a counter-offer once they have decided to comply with the DPA and provide me with the data? Your thoughts! Thanks

  16. It's a hoax, you cannot access a sim in that manner. Secondly its been around for years, we have the exact same email pinned to a wall in work from 2005!
  17. There is a number on the post office website you can call to confirm its been cashed, unfortunately I'm on my mobile atm and can't search it!
  18. It is possible to transfer the ownership of a contract to someone else, though this is subject to a credit check.

  20. Just query regarding the 8 week deadline for official complaints. I sent an official complaint letter beginning of June and only just received a letter asking for me to go into a local branch to confirm my new address. Does this reset the 8 week deadline or does it continue from the first letter, which means that as they took 4 weeks to respond, they only have 4 weeks left to respond?
  21. Thanks RDM, I have sent a complaint to the ICO so here's to waiting another 6+ months for the information! I have also sent an official complaint to HSBC and am still waiting to even have a response from them! I know I have to give them 8 weeks to respond before escalating to the FOS!

  23. HSBC still haven't bothered to send me the information and now looking at the court route to get the information! Is the N1 form the best option or should I use money claim online? I guess I should just list their failings in chronological order with my preferred resolution?
  24. MBNA have upheld my complaint and should be sending the cheque in the next 28 days! Thanks for your help IMS! I'll make a donation as soon as the cheque clears! Onto the next bank - HSBC you are in my sights!
