Just an update folks, I received a telephone from DWP back in July who asked if we wanted to supply any further information. I said that I had requested a SAR and when I received that I would make a decision on my partners behalf. SAR arrived and its unbelievable that the DWP and ATOS dont listen to doctors letters. Anyway never got round to submitting further information for appeal. A letter arrived last week stating they had decided that my partner now scores over 15 points and therefore the appeal would not proceed. In my opinion this is what they will do will a lot of people. Anyway partner and I are ok. (for now)

Not sure about a technical issue, however fact is clear the employee owed employer money back and she agreed to pay back from salary. If she had not agreed to pay from salary then you could argue an unauthorised deduction from salary. This does not appear to be the case? -

Your empoyer did make the payment in error and recalled, and they can do this. You must have known they were going to ask for it back and they woulf not get it out of the 3 days owed. The bank have done what requested by BACS and they are not at fault. It leaves you in a negative position but very little you can do in my opinion. -
Does ISCS not mean "Income Support - Carers Service" normally used when full payment cannot be paid due to other qualifiying benefit?

My understanding is that only one of you can claim for housing benefit in the property. Who is the lease in the name off. If/when your mother added her name on then you are entitled to HB until that date. From the date of change in circumstances then you or your mother will claim the rent. Are you your mothers carer? If so then you may be entitled to a 2 bedroom rate. If not then possibly a discretionaty payment from the council. My understanding is that if to family members share the same house then only one can claim Housing Allowance.

Each giro will state on it what period it represents. There should be a letter in with it saying what its for. Its unlikely to be duplicate payments unless its a clerical claim. My understanding is that payments would be checked before sent. Why can't she phone and find out what its for. If it is wrong and she spends the money then the DWP have the right (in law) to claim this money back. -
Once car is collected contract iscancelled. Any deposit you paid is pro rata down and will be returned to you.

The issue I have is my partners first ATOS examination states no prospect in circumstances for at least 12 months. I watched documentary recently and it was stated it was unreasonable at such short intervals. -

They are a loan matching service, and there website is misleading. However, does say within their terms and conditions what they do. It might be tough but at least they are going to refund it. You could raise a dispute with your bank stating you were unaware they were charging...if thats what you believed. -
You can advise them within a reasonable time - ie can be a few weeks either side.

I'd get my credit sorted out before borrowing anymore. Its unlikely infact impossible that anyone will lend money in these circumstances. Rebuilt your credit rating them change over to a better lender.- 9 replies

Hi Folks, My partner had ESA medical in November and received 18 points. He was then called again in April and received only 6. Is it ok for them to ask for 2 medicals in such short period of time? We are at appeal stage and need some support with what to do. My partner has mental health issues and a critical illness. Do we complain to ATOS. He is seeing his consultant later this week and will get the hospital to do letter, any help appreciated

£850 overdraft with Santander "I" had no idea about

Have they never had any letters from the bank regarding this. Its unlikely bank would have put overdraft on without their knowledge. They can consider an overdraft to pay a DD or payment but they would have wrote to your parents. Do you know when the overdraft was added? When was the card last used to take out money. Write to Santander requesting all information SAR and put cheque for £10 in with it. Your inlays will have t sign this. An alternative is to go to local branch with your inlays and see if you can get to bottom of it -

Perhaps the doctor was calling to advise they had missed consultants report. I'd write to the Practice Manager and advise you want a copy of everything they hold on you Subject Access Request (£10) fee. As the consultants secretary to fax the letter to DWP and ask DWP for a reconsideration.- 23 replies

Im not sure what happens now! Glad your complaint was upheld. Im sure HRC will make suggestion to your company, followed by intervention from your union and employment solicitor. If you are currently off sick...could you go back if changes were made? If not and the relationship has broken down I suppose they may offer a compromise agreement. However, if thats the case no real winner does not address the issues in reality -

I would push your union about this. There is strict rules under Equality act, you can put a grievance in about DDA, however your employer must have reasonably known about it. In my own opinion I'd submit a ET1 claim form and send a equality questionnaire to your employer. Its up to a tribunal to rule on you having a disability - you should submit your claim, as its ongoing you have 3 months -1day from the last act of alleged discrimination -
Ok so he appealed to get on JSA and they took decision to grant appeal. He then goes on JSA misses an appt and gets put off it. He appeals this and the appeal was not reconsidered. I dont understand - they allowed him to go on JSA. Should he not have been sanctioned for a specific time? More information here required.
