  4. Hi Yes I agree the Landlords Insurance may cover this but the Landlord could take a hit with the Insurance Company when they come to renew increasing the Landlords premiums. The issue is the damage was caused by the Tenant that is in residence at present although accidental it was still damage they caused.
  5. Hi I have to agree with Bankfodder on this and it is also best to be upfront with the Landlord. As for the toilet cistern cover as mentioned have a look on ebay or do an internet search for local reclamation or salvage yards in your area also

Hi Thanks for that update and that is a shocking length of time to have to wait for the ombudsman and IMO you should make your Local MP aware of these shocking timescales for the Housing Ombudsman. I also fully appreciate that this would have taken its toll on you personally and if you need to take time out for you health then you do so as your health is more important.

  9. Hi Well if the gas engineer has been out then where is your copy of the Gas Safety Certificate tut tut tut Landlord at it again get onto him and request a copy of that Gas Safety Cetificate as you are entitled to and should have been given a copy.
  10. Hi Bazooka Boo One thing I did well it was the War Pension Agency at the time when they refused my Hearing Claim and I challenged them. 1. The Audiologist in London that carried out the Test wrote to the WPA and challenged them on who made the decision and there Medical Qualifications. 2. I also wrote and challenged on what Medical Qualification the individual hade that made the decision to refuse my claim. They ended up playing ping pong letters until the London Audiologist basically threatened them if they were challenging his medical experience and qualifications and they basically backed down. In your case I would ask for the Medical Qualification of those Individuals that mad the decision to refuse your claim as IMO this is very relevant because if they have NO Medical Qualification then what right do they have to refuse such a claim.

Hi Could I also ask has the Agent acting on your behalf or yourself clarified with this warehouse that the goods that were supposedly stolen from that warehouse has been reported as theft of these goods to the Police and they have a Crime Reference Number which I am sure any Insurance Company would ask for.

Hi Your welcome A least the Landlord saw the light and got the the Gas Safety Certificate complete (bit of advice for future which I should have mention any engineer that comes out to carry out the Gas Safety Certificate always ask to see there Gas Safety Registration Card which you are entitled to ask and they must show you without any arguments and if they do argue then that bring into question whether they are actually registered) So simply always ask anyone carrying out a Gas Safety Check to see there Gas Safety Registration Card or any work on Gas within the Property. Hi The likely outcome is that the Landlord is opening themselves up to legal ramifications and could even backfire on then if and I do say if they even tried to go down the eviction process due to there negligence. That Landlord even if they are new to this it is there Legal Responsibility to look into what they are Legally required to carry out as a Landlord it not for you the Tenant to chase the Landlord and point out what they have not done that is a Legal requirement as they have a Legal Duty of Care the buck stops with them. As for the Gas Safety Certificate that response it them trying to pass the buck so it is in your court to let them know so I would simply respond Dear Sir Thank you for your Email Dated but as this Gas Safety Certificate is a Legal Requirement by Law I should not have to chase this up nor have it passed to me as to when you want to sort it as this should been getting dealt with as a matter of urgency as at present I have no Gas Safety Certificate for this Property this is for you to arrange.   17. Hi Sorry to hear about your Father now in a Care Home as my own Father was in a Care Home until he recently passed away. I assume when you say your Father House he actually owns the Property just want to clarify? You will have to go through the Local Councils Means Test as I had to for my own Father when he went into a Care Home which is carried out by there Financial Department to work out your Father Care Home Bill and in the paperwork you would have to declare the property. We can't actually say whether you Father would be exempt from paying anything whether it for his Care Home Bill which he may end up having to pay something or the entire Bill or whether they would be exempt from council tax for there empty property as this should all be worked out when you have to fill in the Financial Means Test form for your Father being in a Care Home with the Council. Please bear in mind each Local Council in the UK can apply there discretion differently that is why it is difficult to really answer your question you would really need to direct this specifically to your Local Council. Also just so you are aware the Financial Means Test with the Council to see what your Father has to pay for his Care Home is carried out Annually. Now as for the Bins to the Property and it in now vacant since your Father is in a Care Home that is also a question you really need to direct to the Local Council as each Council is different in how the operate this at there discretion

Hi Your more than welcome and the first thing I would be doing is checking with the Local Council Private Landlord Dept that your Landlord is actually registered with them as I mentioned in my previous post most Local Councils in the UK this in now a Legal Requirement. Also keep a written record of every single thing they have not done and that does include your Deposit from the date your took up your Tenancy until you had to chase this up keep everything in writing for your own records

Hi Hope your keeping well just poping in to see how things are going Any further update on what SHP are doing to resolve this with A2 as it seems SHP should be getting more pro active with this as they helped place you into that property so should take some responsibility on this. Have you heard anything further from the Ombudsman?

Hi Well your Landlord isn't doing themselves any favours here and as for getting and email from DPS saying welcome to your new account is not proof that your deposit has actually been protected as the Landlord is legally required to issue you with a copy of the Prescribe Terms of that Tenancy Deposit Scheme your Deposit is protected in. Not protecting a Deposit opens the Landlord up Also is your Landlord registered with the Local Council Private Renting Dept that they are a Landlord Renting a Property as this is also a requirement is most of the UK now and a way to check is simply by contacting the Local Council Private Renting Dept and asking. If you are in England it is also now a legal requirement that a Tenant is issued with a copy of the How to Rent: the checklist for renting in England. As for the Gas Safety Check you should have been provided with a copy of the latest safety check and these are required to be carried out annually by the Landlord as it is a legal requirement.   22. Hi Just something else to consider as well from reading your Agreement with this Live in Landlord. Rent Means Clause: £900.00 per calendar month. Include all Utility Bills (Council Tax, Electric, Water & Gas) How can you be sure that the Live in Landlord actually notified the Council Tax Office of the relevant Local Council that you were actually living there? (bear in mind in the UK it is the individuals responsibility to ensure they contact the council to check this i.e. it was your own responsibility to make sure this was correct with the relevant local council but you have it stated in your Agreement with that Landlord which put this Landlord in a difficult position) What you could do is contact the Local Council to check that this Live in Landlord had actually notified them that you were resident in his property with that Agreement stating that Clause.

Hi I have to agree with them in a way paying for this by making some sort of price reduction or payment offer as they Misrepresented themselves on the TA6 Property Information Form where it states Is the Heating System in good working order? Answer YES Except when you had this independently inspected you have proof that a) Due to the Flue and Boiler being in a dangerous state. b) The Gas Safe Engineer they Employed needs to be reported to the Gas Safe Register and you require that persons Gas Safe Registration Number (doesn't stop you asking for that persons Gas Safe Registration which the Seller should have on there Gas Safe Report issued to them by the engineer they employed just another angle to play them off with that you are serious about this especially as this is Gas)

Hi Well just read the Tenancy Agreement and the Live in Landlord has shot himself in the foot here as you are correct due to that Landlord being a Live in Landlord you can't hold an AST therefore that AST Agreement that the Live in Landlord got you to sign is wrong. Yup you are still going to have to go Court route for return of your deposit and issue an LBA first.
