  1. if as you say the default issue wasn't adjudged on, then it should still be open.
  2. have you tried the ICO (though they don't compensate an individual) if that works (ie they agree the default was in error), then maybe a separate action on that for the loss as a result? or a separate action on it anyway just a thought

  6. did he give permission without you asking? sometimes permission can be seen that the J thinks there is/maybe something in issue that needs a higher court to decide on? ie they think they may not have got it quite right. but again, costs risk!

  8. tel recording is a must. they record calls, so why not us. if skint, can at least try a pc mic, put the landline phone on speakerphone, use win 7/8 'sound recorder' then there are smartphone apps if using a mobile.

  14. typical, reserved but then a different judge. i was concerned you might get stung for costs. at least they were capped. did the J say anything about appealing (though again, costs)
  15. no idea. seems it would be for a court to decide in the circumstances. given the amount involved, and potential complexities, maybe see a solicitor.
  16. generally, maybe a contribution to the purchase, and or any significant contributions to its improvement. you've probably seen a relevant HC case on it, as you know. maybe best bet is to instruct a solicitor

  18. afair one dca (not yours) has sort of acknowledged in writing that an o/d after 2011 would be subject to a cca request re its required s61b agreement terms. which added to my view on it.
  19. true. the only blood was when the snap caught the little chaps head. the eye had half popped out with a bit of bloody goo there, and from the mouth. not much though.
  20. do you have an ad/script/privacy type blocker on your browser. disable those, and you'll prob see the tube links posted up (i tried that on the '...listening to now' thread, and most then showed up)
