Keep in mind that is not up to you to prove there is a problem with your mattress, it is up to them to prove there isn't. You don't have to send them pictures etc; it is up to them, once a complaint has been lodged, to come and investigate themselves. -

You stand at the very top. As advised by the maker, it has nothing to do with them but only to do with the store, it is the sellers problem. Yes, they will try and fob you off as customer service doesn't exist for many commercial establishments any longer. You just keep going with this and if shove comes to push and you need legal assistance, you thread will be moved into that section. -

Having destroyed any evidence, you have certainly narrowed your chances. Consumer regulations doesn't say you have to have photographs of everything, so get a quote and send a copy to Aldi along with the motorway patrol report that he will have had to make.

If you are wanting to get at your brother in law, you should inform the police as no tax probably means he has no insurance either.

What is to stop your son now telling people that everything in that shop is for free as they can just walk in and take it and no one will stop them. As said above, what a sad and silly situation. Make sure he is paid every penny of holiday pay accrued. Also keep in mind that if/while under notice, he can legally register at the job centre and go looking for another job and not lose any pay. -

You reply repeating that the car was sold, contrary to regulation, in an unroadworthy condition. You also say that you require a full refund of all monies paid including the cost to find out it was unroadworthy. You give them 14 days to comply and say that at the end of the 14 days if the funds haven't been repaid, you will without any further notice issue a court summons and you will name both the owner and the seller in that claim. Don't fall for the harassment rubbish, they are just tying to pass the buck and worry you so you just accept how things have gone and go no further. Make all correspondence by recorded or special delivery and any phone call on a landline or mobile where the conversation can be recorded. -

F Search for all the review sites you can find and make recommendations on them as well, let the whole world know.

No template. Just tell them the car they purchased on xx date has suffered with a problem that makes the car 'not fit for purpose'. Say that is has been back for rectification 5 times and so far they have failed to solve the problem. If the car isn't repaired within 14 days, you will reject is and expect a full refund. Copy that to the dealer as well.

A PCP is regulated just like HP, and also just like HP, the finance company owns it and not you, so write to them and tell them that their car has a problem and you want it fixed or changed. If neither is done to your satisfaction within 14 days you will reject the car and expect a full refund. Is it a manufacturers PCP ?

What they are suggesting is that one of the drivers might be riding the clutch. It's very rare for a clutch to cause problems of jumping out of gear, this is usually a sign of gearlever or internal gearbox wear or even worn or faulty engine mounts. I don't trust garages and especially don't trust selling garages, so if they are going to pull the clutch to check it, you should be there and see the parts for yourself. EH might not do it, but some garages will hang on to worn part so they can then show the customer and hence put the blame on them. Is the car on finance ? If so, is it HP ?

If it's slow, it could be head gasket into the exhaust so you aren't aware of it as no cloud of steam in the exhaust. If it's into a cylinder, that can leak in overnight while the engine is not running and you can get a hydraulic lock (like having a brick on top of the piston), which will wreck the engine when you go to start in the morning. You need to return to your chosen garage or another one and ask where the leak is. You should also be in contact with the finance company as it is HP. This isn't your car, it is the finance companies property and you are just hiring from them. You chose it and they bought it, so get onto them and 'tell' them their car has a problem and you want it fixed or you will be rejecting it for a full refund. All finance companies try to absolve themselves from any blame or responsibility especially Moneybarn but don't take no for an answer. Whatever you do, don't stop making payments.

I ask because it isn't a case of pumping up the system and seeing where the leak is. You obviously have a leak, testing should be carried out twice using different methods and shouldn't have been handed back to you saying he can't find one. Any professional 'will' be able to find it, so although you trust him, testing hasn't been carried out properly or fully. If no one can pin down the leak, then you need to dig in deeper, it could be the heater matrix or O-rings, is there any damp below the heater or in the footwell carpets or is there any smell inside the car ?
