Hi,

 

Claiming £1100 and also contractual interest which is another £1100. They initially offered me £500 and credited this back to my card, said id accept as partial payment etc or to take it out. Weeks later they offer me another £600 as partial payment and credit my account.

 

Just wondering what the success rate is and whether its worth holding out for Contractual as well, as they have paid all my claim back just not the interest ? Whats the likelihood of going to court etc

Hi!!

 

MBNA do seem to pay up they just don't seem to do it in one go! Keep at 'em and see what happens. I've just dealt with my hubby's card. I reclaimed charges and the contractual interest. They refunded it all in 2 parts after about 2 months. I think the fact they haven't got a credit agreement was a big factor!!

 

Have a read around the threads to get a feel for how they deal with people.

Hi guys

I'm in the same position. The have now offered y approx all my charges in two payments. I accepted the first as partial payment and wrote back to them to this affect and they have written back with another payment for the rest of may charges.

 

I'm wondering what to do now about the contractual interest? Can we still claim this if they have paid back and we have accepted the charges? I hope so as this will sort me out no end!

Good luck. Im writing my rejection letter now, am going to start court proceedings through MCOL if they dont come up with the interest as well. They did say that the amount offered was a 'goodwill gesture' so they havent admitted to the charges being unlawful.

 

Let you know how i get on.

How long have you had your account? I would be inclined to send them a CCA request before you actually file with MCOL...... If they havent got the CCA it is very unlikely they would want to go through the court process,,,,:)

I won against MBNA, Nat West , Barclays, Barclaycard and PPI payments from Barclaycard

Abbey National still to go.... what will I do with my spare time?

Hello everyone. I agree with Standing. First though i would actually just send a letter thanking them for their offer, but you will only accept it as part payment. I would then send the CCA request off if they don't come back with a further payment.

 

MBNA only make part offers because some people are willing to accept less than they have claimed. Considering how much they are paying out, you can understand why MBNA try to see how little they can get away with!

Well MBNA finally paid up in full a couple of days after i was due to file on MCOL.

 

Exactly as you said hopeful, they paid in 3 parts. I rejected offers for £400 a further £600 and then finally offered another £1200 which was a bit more than my full claim with CI. This probably covered the 8% interest i could have got on top.

 

Good news and my balance is down to a more manageable £800. Onto filing N1 against Barclaycard now, they are being less cooperative.
