Marvelous news Charley!

 

I will start a new claim with Cap1 hopefully shortly. I need inspiration and this has hit the spot for me!!

got home tonight to a very nice letter from the Court saying as this was a claim against a bank, it was stayed along with all the others. I was very tempted to write back and disagree with them, explaining all about how the credit card claims weren't subject to the Test case and that they were mistaken etc etc..........................

 

 

 

and then i remembered I'd already won and it didn't make any difference:D;):D:D

You do need to tell them that you are withdawing the claim - issue a notice of discontinuance

Notice of Issue received today.............deemed served 17th May......2nd June to reply.....28 days and counting to defend

Acknowledgement of Service received today, effective 21st May...........28 days to defend up on 14th June

I received a very polite letter this morning from CapOne saying their fees aren't unlawful, and they're only levied when a customer breaches the terms of their contract, but as they're such nice people they'll pay my claim in full!!!!!!!!!

What did I tell you CF??? Told you thats what would happen.:D You should get yor cheque within 14 days, or refunded onto your account. Don't discontinue the claim till the meny has cleared - as if you would!

Now then, quick update..........I received a second leter from CapOne this morning, dated the day after the "we'll pay up but we don't think we're wrong" one.....saying "we'll pay up but we don't think we're wrong" again, but from a different person this time.

 

well, thank you very much indeed,all contributions to the cf drinking fund gratefully received. Let's hope they DO pay me twice;)
