I sent for my statements which took about 40 days and have susequently sent a request for repayment of the charges. They offered the difference between the £20 and the £12 on any charges made before the reduction in the price for charges which was a derisory £88 which would be paid into my account I am claiming £220 plus interest.

Sent LBA saying thanks for part payment but i shall be claiming the full amount they still insisted that they would only pay £88 which had been credited and that was it. I shall now do a MCOL this weekend and start the ball rolling

Hi my be better to do this by the N1 route in court I found the POC to be to large to fit MCOL as some are now trying to say not enough info on MCOL and trying to get claim struck out.. For me cap1 have till 4 july to reply after being served by court.

 

Advice I have seen and been given on CAG re claim in court is CAP1 acknowledge then pay very near to when they have to enter defence.

I have completed MCOL form and was deemed to be served on 21st July. I have had an acknowledgement of their intention to defend all of the claim I presume they now have 28 days from the 21st to file their defence. So we will see what happens now.

They normally respond before the AQ arrives, as seen on most occasions it will cost them the AQ court fee too when they settle. Not long now.

As predicted by you all cap1 sent letter stating that they still thought the charges were lawful but as a gesture of goodwill they would reimburse the penalty charges in full and the court fees and notify the court that they have settled the claim, payment to be received within 14 days. Letter from court also came today and said the claim was now settled cheeky devils ive not even got the cheque yet

Hi Carl,

 

Just been reading through your thread and WOW.

 

I was just debating as to whether to file my claim against Cap 1 due to upcoming surgery and as they have had a bit of a reputation in the past.

 

Reading through the Cap1 threads and yours it has given me the shove to get the N1 filed tomorrow.

 

Congratulations and I really do hope mine is as straight forward as yours.
