Hello,

 

Can anyone advise?

 

6 months ago I won my charges back from the last 6 years. Since then I have incured additional charges, I have also received my statements from 1995 as well.

 

Question is: Do I apply for a refund for recent charges and then try 'the older than 6 years' charges. i.e 2 seperate things, or can they be done as one?

 

Also if they paid out all my charges in one go first time around, are they likely to contest the second time?

Someone else is more than welcome to correct me here but I don't see there being any reason why you shouldn't bulk it together. Just make sure you don't include any charges you've already claimed for.

Did you sign any kind of acceptance during your first claim stating that you wouldn't make any further claims?

If you're claiming past 6 years do some reading up on "concealment" in respect of the statute of limitations act.

Will is right in his comments, but i would be inclined to claim your recent charges, because they will pay them out with little effort, but the pre- 6 years charges will go all the way. You must read up as much as you can about the Limitations Act especially section 32. Your claim must be waterproof. Otherwise they will try to strike you out. Two years of my £20k claim were pre 6years. So it is not imposible

I am about to try claiming a second time, my feeling is as the others I would just go for the recent ones to start with. i am hoping that because they offered me a settlement after the LBA then they can hardly take it further than that this time could they?
