  1. Hello, I have a Hire Purchase agreement for a car with the Bank of Scotland and over the last 2 years I have had about £200 worth of charges. Would I be able to claim this back? If so would the letter I send be the same as the one for bank charges? Thanks FREDDIE
  2. Hi, I have something similar with Next Directory. They have defaulted me and yet have stated that they do not have a signed agreement!!! From what your saying then there is no way they should have passed on my details to a CRA? Am I correct in thinking this? Would the Information Commissionaire or the F.O.S rule in my favour?   3. Hello, Can anyone advise? I have a HP agreement with Bank of Scotland and have had about £500 worth of charges for being late in paying the monthly payment. Is this something I would be able to pay back? If so how best am I word to the letter, any advise appreciated. Thanks - FREDDIE
  4. Hi Pinky, Good news for you! Just out of interest who removed the default? I have been trying for over 12 months. Next have written confirming that they don't have a signed CCA, and I have wrote and told them that this means I haven't given consent for them to record info about me! They aren't budging. Numerous letters to the CRA's pointing out this, hasn't resulted in anything. Even the default is not a properly valid default, but it appears that no-one wants to know. I wrote to the I.O.C in Spet '08 but it will be another 3/4 months beofre they get back to me, even the F.S.O who have a backlog of around 6 months!!! Will let you know the outcome of trying to get this Next default removed. FREDDIE
  5. Hi Pinkerton Angel, Any update on this? Have they agreed to the default removal upon receiving the settlement sum? Please advise - I am having similar issues with Next. They defaulted me, even tho' they wrote to say they don't have a signed CCA FREDDIE

Hello, (sorry to 'barge in' on your thread) but maybe bobbyh99 (or anyonelese) can advise, as I have a similar thing: I have (what Next Directory are classing as) a default notice, where it's dated 16th July and they tell me that the balance is £1,700 but £600 needs to be paid by 8th Aug.... i.e 24 days to pay! Does this make the default notice invalid? Also it does not refer anywhere on the notice to the Consumer Credit Act....does that make it invalid as well? Any advice will be greatly appreciated. I have applied for my SAR from Virgin and have found it difficult to find information about how far you have to go to get your money back, I get the feeling that to get anywhere I would have to take them to court which is a bit daunting...   9. Ha, ha good one DCA-KING!!! Whenever I get a phone call like that I usually say can you just wait a minute - then either carry on as normal with them racking up a large bill or even take the phone into the toliet and flush the chain!!! Trumping down the line usually stops them.

  11. hello, I took out a hire purchase loan agrrement with the Bank of Scotland for a new car I bought. A few times I have missed the DD payment and they have charged me £25. I have recieved an upto date statement showing all the £25 charges that total £350. I assume I can claim these back. What sort of letter do I write? Is it similar to the first letter I would have written to the bank? Bit confused so any help would be appreciated. Thanks FREDDIE

  13. Hi, I have an Alliance & Leicester mortgage with no facility to take a payment holiday. I was going to to contact them to say that I can't make the next month (or maybe 2 months) payments. I assume then that they would revise my balance and calculate a new monthly payment. If that was the case, does anyone know how it would be reflected on my credit file? Would it go down as being late, being in arrears or would it be a normal payment marker on my account. Please advise if you can. Thanks FREDDIE
