  1. Hello, I have a Hire Purchase agreement for a car with the Bank of Scotland and over the last 2 years I have had about £200 worth of charges. Would I be able to claim this back? If so would the letter I send be the same as the one for bank charges? Thanks FREDDIE
  2. Hi, I have something similar with Next Directory. They have defaulted me and yet have stated that they do not have a signed agreement!!! From what your saying then there is no way they should have passed on my details to a CRA? Am I correct in thinking this? Would the Information Commissionaire or the F.O.S rule in my favour? Thanks FREDDIE
  3. Hello, Can anyone advise? I have a HP agreement with Bank of Scotland and have had about £500 worth of charges for being late in paying the monthly payment. Is this something I would be able to pay back? If so how best am I word to the letter, any advise appreciated. Thanks - FREDDIE
  4. Hi Pinky, Good news for you! Just out of interest who removed the default? I have been trying for over 12 months. Next have written confirming that they don't have a signed CCA, and I have wrote and told them that this means I haven't given consent for them to record info about me! They aren't budging. Numerous letters to the CRA's pointing out this, hasn't resulted in anything. Even the default is not a properly valid default, but it appears that no-one wants to know. I wrote to the I.O.C in Spet '08 but it will be another 3/4 months beofre they get back to me, even the F.S.O who have a backlog of around 6 months!!! Will let you know the outcome of trying to get this Next default removed. FREDDIE
  5. Hi Pinkerton Angel, Any update on this? Have they agreed to the default removal upon receiving the settlement sum? Please advise - I am having similar issues with Next. They defaulted me, even tho' they wrote to say they don't have a signed CCA FREDDIE
  6. Hello, (sorry to 'barge in' on your thread) but maybe bobbyh99 (or anyonelese) can advise, as I have a similar thing: I have (what Next Directory are classing as) a default notice, where it's dated 16th July and they tell me that the balance is £1,700 but £600 needs to be paid by 8th Aug.... i.e 24 days to pay! Does this make the default notice invalid? Also it does not refer anywhere on the notice to the Consumer Credit Act....does that make it invalid as well? Any advice will be greatly appreciated. Thanks FREDDIE
  7. Hello, Just wondering of anyone knows if there are any 'technicalities' that I can use to get out of a mobile phone contract with 3? I am paying £35 per month for 500 mins and unlimited text. Thanks FREDDIE
  8. FAO: Nicolee2931 Can you please update everyone on how you get on. I have applied for my SAR from Virgin and have found it difficult to find information about how far you have to go to get your money back, I get the feeling that to get anywhere I would have to take them to court which is a bit daunting... FREDDIE
  9. Ha, ha good one DCA-KING!!! Whenever I get a phone call like that I usually say can you just wait a minute - then either carry on as normal with them racking up a large bill or even take the phone into the toliet and flush the chain!!! Trumping down the line usually stops them.
  10. Hi, I can afford £10 as well. Advise by PM how I can get it to you. FREDDIE
  11. hello, I took out a hire purchase loan agrrement with the Bank of Scotland for a new car I bought. A few times I have missed the DD payment and they have charged me £25. I have recieved an upto date statement showing all the £25 charges that total £350. I assume I can claim these back. What sort of letter do I write? Is it similar to the first letter I would have written to the bank? Bit confused so any help would be appreciated. Thanks FREDDIE
  12. hi mike, any luck with the sexy bird in the branch?
  13. Hi, I have an Alliance & Leicester mortgage with no facility to take a payment holiday. I was going to to contact them to say that I can't make the next month (or maybe 2 months) payments. I assume then that they would revise my balance and calculate a new monthly payment. If that was the case, does anyone know how it would be reflected on my credit file? Would it go down as being late, being in arrears or would it be a normal payment marker on my account. Please advise if you can. Thanks FREDDIE
  14. hi, i am having the same problem - any update? did you eventually get it removed? freddie
  15. Issue 5: Get rid of partner. (only kidding - we love 'em really)
  16. Thanks, Yes, I have written to Next on a number of occasions, their last letter said it's theie final response, so as per my threat I have referred it to the I.O.C. Am I right in saying that they aren't allowed to record info about me? I will write to the CRA and inform them, just to see what they have to say about it. FREDDIE
  17. Hi Rory32, Thanks for yur reply... Just a bit of info on the background.. Next have written and admitted they have no signed C.C.A. Even the default was registered with the CRA 2 weeks before they wrote to me to warn of a default - even then it wasn't even a proper default notice containing all the info a default notice should have!!! Please advise: what is the quickest way to get it removed? (I.O.C said another 3/4 months!!) Should I go down the route of requesting a copy of default notice, paying the £1 fee etc.... Or would you suggest seeking legal advice? Thanks - FREDDIE
  18. Hello, Just range the Information Commissionaire for an update on my complaint against Next Directory - basically even tho' they have admitted they don't have signed C.C.A, they have recorded information on my credit file..... The I.O.C have said as long as I have recieved goods and started paying, I have entered into an agreement with them and they have the right to record information on my credit file!! I disputed this saying that I have never given them permission to record my personal details with anyone...according to the I.O.C tho' this doesn't matter... Any thoughts? Thanks - FREDDIE
  19. Hello, Any idea why my current account with Natwest (held for 20 years) and a Halifax account (held over 12 years) don't appear on my credit file? I thought they would judging by information on this site. Thanks - FREDDIE
  20. Hi Smel Any update on getting the default removed? Was the I.O.C able to help? I am waiting for them to make a ruling on my case against Next Thanks - FREDDIE
  21. Hi S-K, Very interesting thread on Next especially since something similar happened to me! Next insist that receiving goods and paying off each month is enough for them to record activity with the CRA's - I take it that this is false? Also they have written to me to say that they don't have a signed CCA - yet they will not remove the default notice. Again, it appears that I haven't had a proper default notice, only a letter similar to yours saying debt will be passed on! Even then the date of this letter is 2 weeks after the default date on my credit file! I have written to the I.O.C and will keep you posted....(just a shame that this takes months for an answer) Any update on what's happened to you? Were you able to get yours removed in the end? Is the fact that they have no signed CCA - enough reason not to have processed any data about me? Thanks - FREDDIE
  22. Thanks PT, Makes me feel a bit better - they have put a default on my credit file (the only bad thing) they refuse to remove it which is frustrating because hopefully the Information Commissionaire will remove it, but the whole process takes ages - but at least I know it will be removed. Thanks FREDDIE
  23. Hello, For everyone who has contributed to this thread - the one issue that hasn't appeared to be addressed is the fact that Next are recording all this activity on your credit file and the default as well. That's the problem I have and despite writing on many ocassions to get them to remove it they won't!!! Currently in the hands of the I.O.C - but this takes ages... Any thoughts? Thanks FREDDIE
  24. Hi, I took out a mortgage with First National Mortgage Company on 2001. I moved to another mortgage company in 2004. Does anyone know if I would be able to claim anything back on the Mortgage Exit Fee? The letter I received from them enquring about this was a load of waffle... Thanks - FREDDIE
  25. Hello, Just struggling at the moment and have fallen behind on my Scottish Power, not paid for 2 months. I received a letter from STERLING COLLECTIONS advising of court proceedings and a default. Am I able to be defaulted and recieve a CCJ on my credit file for this? Please advise as at the moment I have a clean file... Thanks FREDDIE
