How can I be any surer though? I have no paperwork after that showing any further payments were ever made. I don't remember giving them any else since or having any dialogue with them since. -

Prior to that amount I last made a contractual payment at the beginning of July 09. I was then defaulted around September that year just noticed they added fees from between £10 and £50 (Collections fee?) over that period too. Would should my next step be? -

No the last contractual was way before then. I thought the last token payment was June 2009 but I've found an old loan statement which says payment received 05/01/2010. It would only have been about 1/4 of a contractual payment but interestingly it is for the exact same amount as they charged me for a letter a couple of months earlier. I'm wondering it is was a fee refund but it doesn't confirm either way. So that would make it SB on the 5/1/2016 wouldn't it? -

Yes. I assume I need the defence option as it definitely looks like this is SB. Or do I just acknowledge to get the 28 day option and then write to Restons stating its SB? -

I'm trying to do the MCOL but I don't know which response I need. Help! As far as I can see the default notice was served 2/9/2009 and the last payment was 05/1/2010 so there is no indication of any correspondence since then. So what is my next step? -

Possibly, I am trying to hunt down old paperwork Did you receive a Default Notice from the original creditor? I have marked on an old note default notice Sept 2009 but I need to find the original paperwork to confirm who sent it. Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No idea, I don't think so Why did you cease payments? New baby and hours cut at work made finances very tight What was the date of your last payment? According to the notes I've found June 2009 Was there a dispute with the original creditor that remains unresolved? I believe I disputed all the charges they were adding but it's hard to remember now Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? Yes. They weren't particularly supportive at the time I think.

I'll approach that route then, I know some people have had success with mortgage companies and for more things I wouldn't expected such as ERC so I thought if mine was purely down to £54 a month arrears charges I would stand a better chance. -

Sorry, I used to have a Mort PLC mortgage though I am now with another company. During my time with Mort PLC I incurred a few hundred pounds of late payment/arrears charges and contacted them asking for these back. They said no a couple of times and then sent me the above letter. So do I have a leg to stand on? Should I now go to the FOS? Are there many successes for these charges alone on that route or should I go for a court claim? -

I am paying the difference into a separate account now so that I feel as if I am paying a higher mortgage but will use this money to clear something else or make a capital payment. Only worry is that the LIBOR spiked recently is that a sign of something? -
Was it a letter of deadlock from Mrt PLC? I've just had one of them regarding arrears charges which I had never heard of before?

I have sent the LBA and they have come back with a letter which states: Thank you for your letter dated blah blah... ...As you are raising no new complaint points in this letter, I must once again adivse that you should now refer your complaint to the Financial Ombudsman Service if your remain dissatisfied, details of which are provided in my letter. Please treat this letter as a letter of deadlock as I regret I am unable to enter into further correspondence in relation to this matter. You have 6 months from our final response dated blah blah to refer your complaint to the FOS. The ombudsman with require a copy of this letter and of our previous letters. Yours... So what next do I go the FOS route or the court route? -

Yes, we are quids in at present mortgage wise which is lucky as our other circumstances are fairly dire! Not often we have any luck! -

Hi We had a NW account which I reclaimed charges on about 2 and a half years ago and got a settlement then. Since then we carried on using the account until recently when they kept taking so much in charges we just couldn't risk putting any more money in with them. As the account stands we have gone over the £2500 overdraft BUT NW charges add up to about £2300 since the time we had the last settlement. They are now sending us letters saying they will take us to court and tell the CRA. Should I now put in a claim for these charges, I mean I don't expect to actually get the money but it would clear the overdraft and therefore I would owe them about £100 in total possibly less which I could pay off now? By putting in a claim will the prevent them taking me to court now? Should I do it under the hardship scheme? We are currently a low income family due to reduction in work hours and do have some mortgage arrears, which we are paying off as much as we can?

I seem to remember having agreements in the past where you signed one copy and return it and then kept a copy for yourself. I have never yet remembered to sign mine, but that would still be a valid CCA wouldn't it? -

Well that was amusing. Phoned Mercers (Recorded it!) Asked what was going on and was told a load of old hogwash, I said you can't actually default me twice, he said, "Oh that isn't a default notice" Me: Says so on it, Default Notice served under section 87(1) etc etc Him (In a jokey aren't we good buddies you and I voice) : Oh, no it's not an actualy Default notice (from his tone I expected him to add 'you silly billy' here) It's not registered with a DCA. Me: What is it then, why bother sending it? Him: Well...Barclaycard... Me: - You are Barclaycard. Him: No, we are a limited company... Me: - Yes fully owned by Barclaycard! Him: Well....YEs but- Me: So you are owned by BC and this isn't a default notice? Him: Well yes and no... Me: Yes, yes to the first question and no to the second.. Him: Er...would you like me to set up a payment plan anyway. Me: No thank you, have a good weekend won't you. So this thing is dressed like a deafult notice but isn't. What kind of fishy business are they up to here? -
