I have never heard of this case - if it is one that is binding - how come some courts and the merchantile cases appear to be going ahead .

 

Any helpers moderators out there who can help with this one???

 

 

If you dont get reply try posting a thread in the general section asking about this as it may be relevant to others just about to appeal against the stay.

Robertxc v. Clydesdale - £750 Settled in full

Nationwide v. Robertxc - £2000 overdraft wiped out, Default removed by order of the sheriff

Robertxc v. Style Card - Default removed by order of the sheriff

Robertxc v. Abbey (1) - Data Protection Act action. £750 compensation

This has also been quoted to another claimant MartyR and the judge told him to look it up on the internet - I can not find it yet ?

 

Anybody else found the relevance of this case above others on that day?

Just a thought...

 

I think they are quoting the Leeds Mercantile Court (High Court) Case Management Conference on 29/08/07 as the Judge granted stays on all cases where a stay had been applied for? All claimants and defendants were given the opportunity to put their cases forward and the Judge then made this decision. When the judge was asked if claimants could appeal he stated that they could but it would be highly unlikely that his desicion would be over-ruled. Because this was the High Court I suppose its set a precedence?

 

I wonder if you rang Leeds Mercantile Court (0113 3062461) they would send you a copy of the details relating to this 'carlisle & others v clydesdale bank & others' or if they could clarify the relevance to the hearing and the request for a stay to be lifted?

i am still here _ but have busy posting on other forums to try and get cases to send to the fsa to show banks are not

sticking to the pre_court ageement>

 

 

if you can think of anyone please point them in the direction of the announcement>

HI all

Since having my request for lifting the stay turned down i have wrote to my MP, oft and anyone one else i i could think of but nothing! not even an acknowledgment from anyone. Has anyone had any news about this test case as in a date or if it is going to run for years?

Hi again

 

the only success we have had at the moment is "hardship" cases getting some help from FOS.

For news and opinions on the stay - best to see the thread from CRFX250 in general - who has tried getting the stay lifted and a judicial review.

 

not worked yet but he is not giving up.

Hi all well not been on here for a while, between family and studying not sure where the time goes. I have been reading up on some of the threads and cannot seem to understand why some people are getting court dates when lots of others including myself are still blowing in the wind here!! Anyone know whats going on???????????????????????????????????????:(

The main people who are going to court are hardship cases. But these are very far and few between. You are like the rest of us, and still waiting. :rolleyes:

Thank you sea-side lady, i did think it must be that but my brain is so fried at the min i needed to check with someone else so thanks. I heard that thursday is the big day in the court case, well according to that Martin Lewis anyway, lets hope it goes our way for a change cus with all this credit crunching i'm sure we could all do with a little good luck right now!!!!

Hi all, from what i can make out we have all got to sit tight again until the 7th july then see what happens is that right??? Because A&L are not in that collection of bank does that mean that as the case has rejected some of the banks that we should start on at them again??

My case was started back early last year and i had been waiting for a court date for ages then had the letter that they were all stayed should i try to contact the court or maybe the bank or just wait?? really not sure:(

good point hun, ive been wondering that too, at court a&l said they would abide by the outcome so i dont know what to do either!!

hiya, ive just phoned my local court and they advised that we should hear from the courts as soon as the appeals have been finalised, i did say that with my case they should not be able to appeal but apparently the final outcome wont be til after the appeals...so still none the wiser....oo the waiting is annoying lol
