Claiming more than £1500 in Scotland?

I have a claim of £2200 against the LLoydsTSB Bank.

Can I just split it into 3 separate claims between certain dates?

 

I know I can use the summary claims in Scotland, but that only goes up to £1500 - so what are my options?

i think the advice that Bigmac Versus has said is to go through the ombudsman as the courts do not seem to like multiple claims.

Would agree with nattie, the ombudsman is your best option. You will have to wait 8 weeks from initially kicking off the process of asking for your money back though before getting them involved.

It's worth remembering though that a lot of the threads here suggest that the FOS can't retrieve the interest.

Did you do it through FSO or Summary claims

I used the Summary Cause for my claim from Abbey £1311.44 + £39 court fee and they settled just before the court date. For amounts over £1500, you will need to take out a Civil Action against them, which the court office told me you will need a solicitor for that.

The Financial Ombudsman Service have a claim for me for Capital One as I didn't know that you can use their head office address in England if you live in Scotland, I only just realised that and have now submitted court papers for that £1475.84 + £39, the court will probably return my papers because the £39 will take me slightly over the £1500 threshold. I will just remove that last 2 charges though I think to bring it down a tad. I will keep you posted.

Just trying to find out if I need to claim my two accounts with HBOS in one go as they may throw out a futher claim also I have several HBOS credit cards. and if i need to claim them within the same claim, am thinking of using local lawyer. as its doin ma box in.

As they are individual accounts you can make seperate claims for them. However, to be safe you would need to start and finish one claim then move onto the next one. This would avoid giving the bank the opportunity to lump your claims together.
