I've read the FAQ and lots of other information today, but just want opinions.

 

Today I noticed a £125 on my statement and phoned the bank to enquire about it. I was told it was because I went overdrawn and then further payments were taking out over the next few days and £25's added.

 

Apparently it should have been £150, but there's a £125 limit. Nice.

 

I'm useless with keeping track of my account and so generally unaware that I don't have the funds, however since the ATM's & Switch machines let me (i remember when they didn't) the cash is taken anyway.

 

After seeing this £125 today I've looked back and have noticed these charges everywhere. In summary:

 

02/03/2006 - £125.00

30/12/2005 - £50.00

30/11/2005 - £12.00

30/08/2005 - £100.00

30/07/2005 - £100.00

30/06/2005 - £60.00

30/04/2005 - £60.00

30/03/2005 - £40.00

30/01/2005 - £40.00

30/12/2004 - £54.00

30/11/2004 - £18.00

30/10/2004 - £36.00

30/09/2004 - £54.00

30/08/2004 - £54.00

 

All are overdraft charges (though I'm not sure what the £12 is for!)

 

I aware I could keep track of my finances better and so am dubious I still have a case, do I?

so what they are saying is that the liquidated damages stop after the first 5 charges have been applied.

 

This does not seem to add up, it costs them 125 pound then nothing ?

 

I would ask how come it does not cost them after the first 5 charges, they will either have to say they are over charging on the first 5, or not costing them anything because after 5 they are not losing anything.

Might be worth sending the DPA letter and find out what you've been charged over the past few years

 

I've been through all my statements previous to these. I had a graduate/student bank account and they didn't charge me.

UPDATE:

 

I had a meeting with my business manager (I also have a business account with HSBC) and I brought this up. She spoke to the manager and the removed a further pending charge of £125, but said they couldn't refund any of the past ones. Interesting that they just removed it though.

 

Will be completing the relevant forms and attempting to get the rest back ASAP. Will keep you informed.

It'd be interesting to see the responses if we all asked why they could refund a recent/pending one but "can't" refund older charges.

 

The fact that they're perfectly willing to remove the odd charge here and there to me can only be further proof it doesn't cost them anything past a tiny amount for a breach of contract. If going over the agreed limit on an account or having a cheque, DD or S/O returned genuinely cost them £30+, do you reckon they'd even consider refunding charges 'as a gesture of goodwill' and actually make a loss out of it? B*LL*CKS would they! :evil:

I don't think that it is proof of anything much, I'm afraid, but it might suggest that some banks staff have consciences which prick them a little and they like to feel a little better when the meeting has finished.

iM glad there are other people as unorganised financially as me!!!

I have had similar problems with HSBC over recent years. Numerous £125 charges etc. ( it used to only be about £75, thieving gits put up the rates recently). I actually wrote a letter threatening to closes my account after the most recent charge. (I swapped jobs from weekly pay to monthly pay, and bills had to be paid in mean time. I advised them as such and assumed they would sympathise with the situation. Yeah right!!!) Anyway eventually I recieved half the amount back. But I will be so happy if this works and I can reclaim these charges because they have been kicking me when Im down for ages now, and it very difficult to to remain financially organised if you have a low dispposable income anyway and they are robbing me of it.

Received a reply to my "Preliminary approach for repayment" letter from the bank on Saturday:

 

Thank you for your recent letter, regarding charges applied to your account.

 

Before I can look into your request to refund charges, I do require you to provide me with a detailed breakdown of when the charges were applied. Once this has been received I will be able to review ytour request.

 

I trust this clarifies matters.

Note: I have also since been refunded £125 after a meeting with my business manager, who said that was all she could do.

Send them the same letter, ith a breakdown of the charges, and with a note saying that they have XX days left.

 

Do NOT start the "counter" again.

The general consensus seems to be that as they charged these amounts, they should know.

 

It's up to you really, you can be kind and list them or tell them to shove their request and they can question it in court if they wish to dispute.

I'm not a fan of allowing them to draw this out, hence asking for everyones advice!

UPDATE:

 

After receiving the letter asking for detailed charges and when they were made I sent a reply with the charges and gave them another 7 days.

 

Am now writing the second letter and will keep this updated.
