There is NO requirement under the DPA that data over 6 years old be destroyed.

 

See my post no.34 up there somewhere ^.

 

If they tell you that is the case, then it's either downright ignorance or outright lies.

 

I will leave it to you to make up your mind.....

Julielouise- make a photocopy and send it to the Information Commissioner with an official complaint. You have to use the official complant form, downloadable from the ICO's website.

 

It would be interesting to read his comments.:D

i notice on bong's signature the RBS goes back 15 years. anyone got that? anyone got a letter to that effect from RBS that would be prepared to let me use it? thanks

Hi Bong

 

Not sure if this is what your're after but Lloyds/TSB stated in reply to my SAR

 

"Please find enclosed details of charges going back to the date you opened your account, or 1st September, whichever date is most recent."

 

It goes on to state

 

"if you feel you need futher statements, this will take longer to access archived data."

 

Then at the bottom of the letter, underneath the signiture there's this line

 

"Please send any remaining statements prior to 1st September 2001"

 

Ho btw when I was in my local branch and asked for a copy of a recent entry on my account notes I was given the whole lot, going back to Oct. 1995 when it was opened

hi lazybones, are you going to ask them for the older statements?

 

can't think what their comment about sending statements prior to 1/9/01 relates to - doesnt make sense - its them that needs to send them not you!!

Hi Bong

 

Didn't get any statement just list of acc fee charges int. charges & o/draft excess fees.

 

They said it went back to 1/9/01 but first on list is dated 3/8/01

 

I don't think the last line on the letter was ment for me as it had a* in front and there was no * anywhere else in the letter.

 

Does this make sence

i have received statements from 1992 - 2001 rom Nat West today. I am waiting to see if tomorrows mail brings the ones from 1997 to 1992, i will then have the full set.

 

i emailed Michael Duncan and complained that Penny Berryman was not fulfilling her obligations re the S.A.R - (Subject Access Request) and also put the relevant section of the Data Protection Act for him to read. if anyone wants a copy of my email to him - pm me.

 

it took 10 days for him to comply.

 

edit: Penny Berryman is actually with Lloyds, I got mixed up with the names it sis Lorraine Cassidy at Nat West. Sorry for the confusion.

Too true I am!!

 

What I want is what I asked, and paid, for. Namely a complete banking history, not a list of acc. fees and o/draft interest.

 

What do they think a S.A.R - (Subject Access Request) is, something they can treat with contempt.

 

Haven't they learnt anything yet?

Bong-

 

Just had letter from Adrian Ruffhead at Barclay's legal and compliance dept in connection with another case.

 

I asked for copy statements from microfiche from 1986, not through SAR but at £3 per sheet.

 

He has replied thus:

 

"Barclaycard's records do not go back to to 1986 as it will only store back statements for a period of 6 years"
