Impatience.

Dear all

 

I have been through the painstaking process of writing to Nationwide for my statements to which they promptly requested £10 for them which I quickly sent away. A week later a package of statments arrived and I put in my claim for total charges of about £3,700.

 

That was 2 weeks ago today and I havenot heard a sausage. Now, I am impatient at the best of times but should I wait longer, or perhaps write to them again? any advice?

Did you send the Prelim letter with a 14 day deadline? If so send the LBA.

 

Work to YOUR timetable not theirs.

I did indeed give them 14 days. Thank you for pointing that out, I will get on the case right now and keep you all updated.

Well, just to keep you updated.

 

I sent them the letter before action stating they had a further 14 days or I would take legal action however, the next day I did eventually receive a reply from them, just outside of the 14 days. It said, as expected that the media hype is out of control and they cannot refund my fee's.

 

So I have written to them again retracting my last letter which was sent due to their late replay and that I would be pressing ahead with court action.

 

Which I also did online yesterday. £120 court charge, I am hoping this will be worth it.

You have to give them the 14 days from your LBA letter.

Otherwise they could argue that you gave them 14 days then issued court proceedings within this time, not giving them chance to respond.

 

I dont think it will matter, but it is a point worth bearing.

Its ok, I consulted a little legal advice that told me I should do that. I did give them 14 days, however they took 16. So hopefully they will pull there finger out. Court issued today so we shall see.

Got my letter from the court today. Issued on the 13th, serve to them on the 18th. They have until the 1st of April to reply.

Plus, good old nationwide have neglected to send me my statements for ALL teh accounts I had with them. An old credit card from years ago. So today I am requesting the statements from that.

Right then, now is the time to read up on the court process, AQs etc while you wait for their response.

Did you sent a DPA SAR request to them for your statements initially, if so they should have send ALL info they have relating to ALL accounts you have.

Yes I did. And I also phoned them just now to ask them for the account details on this old credit card. They said they couldnt give them to me as it was a closed account. I asked her how I would get them and she said I dont think you can, try your branch see if they have anything on file.

 

Fortunately, I had some old paperwork with the account number on it. She knew why I wanted it, I think she was just stalling.

YOu need to send them a letter regarding non complainance of your DPA request and then start proceeding for this.

I got my letter form the court on Friday. Telling me it was issued the 12 and would be deemed served on the 18th. they now have 14 days to respond. Its like waiting fro christmas.

no, infact its worse than waiting for christmas. I check my bank account every day just incase they have given in prematurely.

If it was up to the banks it would be in March, or april depending on how busy they are..

hi jarvis, i have recently won from nationwide and like you i checked the bank every day!! nationwide paid after three weeks of me filing at court, hope this gives you an idea of their timescale. best of luck x

Well it was acknowleged as of yesterday 22nd march. They now have 28 days from the day it was served (18th)

Dont panic, thats what they told me and 3 weeks and 1 day into it they have paid up!

That means I have to wait another 3 weeks!?! This waiting game is no good for me at all.
