OK, most of us are not going to agree to these clauses but...

We have all been posting on here about our experiences and our amounts etc... if one of us DOES decide to sign a confidentiality agreement (which some of us I believe have already done) then are they in breach of that agreement if they leave their posts about their cases on this forum? Or can these things not be applied retrospectively?

The agreement would have to start from the date of signing - anything before that is public domain anyway.

The issue, as I see it, is how much they are prepared to pay you to keep schtum.

I suspect that it's sometimes just part of their standard templated letter, and that they are not overly bothered if you shout it from the rooftops.

Not yet, anyway!

If you do agree to a confidentiality payment (don't sell out for peanuts) then you need to PM Dave/BF and let them know litigation is concluded. Then update your claim thread with 'case settled' and say no more about it.

You can be sure that banks are watching, and if they see you talking about the claim they could get shirty...

Yes, but if the sequence of events goes as follows:

Bank make an offer

Bank pay

You squeal on CAG forum

You agree to confidentiality one day later

They cannot say a bloody thing about it.

True - but that could be seen as provocative, and the last thing you want is the bank taking you to court for breach of contract.

If you want to shout to the world - and we all do - then don't sign the agreement. They are not likely to offer much anyway...
