Can anyone help. We bought a Fridge from a Comet Clearence Centre, slight dent on side of fridge but with £200 off it was a bargain. Anyway 10days after it was delivered it stoped cooling. The freezer was fine but the top of the fridge section was practically warm. Waited a week for the Engineer to come out (Who stuck his hand on the top shelf and said yeah it is not working) HARDLY ROCKET SCIENCE!! Anyway said go back to clearence centre and pick another one. Had to wait till the weekend to do that and when we got there they didn't have the same one and all the rest looked as if they had been chucked out a ten storey building.

 

I just want to know what our consumer rights are? Can we request the fridge to be repaired? Because it is from the Clearence centre can we not request a replacement of the same fridge?

 

Any advice would be much appreciated!!

I think - but not 100% - that your same statutory rights apply.

 

Providing that you didnt buy it for clearence that the current fault is - like durrrr, as if you would buy a fridge that didnt cool!!!!

 

Im also convinced that because it broke within 28 days you can demand a replacement and not for it to be repaired!!!!

You can't *demand* a replacement.

 

If you report the fault within a reasonable time you can reject for a full refund. After this reasonable time has passed (normally 2-3 weeks in most normal faulty goods cases) the trader is entitled to offer a repair or replacement, but they can choose which of these remedies to offer depending on which is most economical. Therefore if they offer a repair they are meeting their legal obligations.

I have given up with Comet. They were only offering an exchange or refund. We paid £200 for a £400 fridge because it had a scratch on it and when we went back to look at getting an alternative fridge they all looked as if they had been chucked out a tenament flat!! So we approached Samsung as the fridge comes with a 2 year manufacturers warranty. They have sent an engineer out 3 times and we are waiting for a replacement Heater which was what was causing it to stop cooling. Sounds weird but the heater wasn't going onto automatic defrost therefore the heater was freezing and not allowing the fridge fab to work properly.

 

Samsung have been great and said that if the problem was not solved on the 3rd visit they would replace the fridge like for like!!
