No, their Witness Statement to be sent to court and us by 4.00pm next Wednesday, with the hearing following on Friday.

Settled Claims:

Abbey: £4025 Claimed 27/02/06 - Paid in full 19/06/06

NatWest: £4529 Claimed 10/05/06 - Paid in full 1/08/06

Halifax: £1150 lba 18/05/06 - Paid in full 07/06/06

Natwest CC: £420 Initial letter 25/07/06 - Paid in full 08/06

Woolwich: £1100 Paid in full 28/2/07 + Default removed

NatWest Pt 2: £1700 Claimed 10/05/06 - Paid in full 7/2/07 + Defaults removed

 

Current Claims:

Abbey Pt 2: £2300 + adverse credit removal claimed 23/03/07

Alliance & Leicester: £1421 + adverse credit removal claimed 23/03/07

Well, I can tell you this much - the defaults (x4) have this morning GONE!! No surprise there......just the MONTH taken to do it from the date they registered them in breach of the injunction!

Even though the defaults have been removed think the judge is gonna have something to say.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

No word since Thursday....perhaps the late-minute full S.A.R. request from me threw a spanner in the works! Want to ensure whatever they put in their Witness Statement for court Friday is the TRUTH.... perjury would be a very serious offence!!

i know it couldn't have been easy for you, what with the house sale/purchase etc, but every cloud has a silver lining, as they say.

It is true though....sometimes it feels like all those banks, DCAs, CRAs have the law in such a disrespect, that it creeps me out. It feels like they open the post and say; look at this pathetic, pitiful, pompous Subject Access Request, or CCA request or whatever. Because their heads will not roll, their wages are safe, their bills will get paid...all they can possibly worry is a verbal warning. Nobody is going to sack a person who harasses you despite your protests and Administration of Justice Act quotations. Who do you think is going to get into ANY trouble from NatWest? Any real decisionmakers? policymakers? No. A penpusher is going to be called for a chat.

So it is great, when one of us can say to one of "them": caught you red-handed, ****!

I do hope that your action will ensure that those who are really responsible (not some undertrained, inexperienced worker) get a thrashing.

Depends on what the penalty is for breaching an injunction, and the severity which in this case i'd say the judge will take a very dim view on.

4.00pm court deadline has passed - phoned court & Natwest have NOT submitted a Witness Statement to either us or the court as ordered!

 

Boy, try not turning up Friday....think the judge will have their guts for garters!!!

 

Had to relay some additional serious info to the judge today too, so expect some MAJOR fireworks folks!!

I believe that a few days at one of Her Majesty's holiday camps is the usual penalty for Contempt of Court, which this appears to be at the very least.

 

Well thats what we would expect to happen to us mere mortals, no doubt its completely different for NatWest.
