Ok, i have sent my first letter and got the normal sorry we can't refund you, our terms and conditions are perfectly clear etc.

 

Sent second letter still no joy same things again.

 

So i am now starting the bank claim against them.

 

I am owed £1141, i have added 8% interest and brings the total to £1222.40.

 

I already had all my statements, but have sent the £10 and the DPA Letter off aswell. I am going to start my claim today.

In the FAQ section, reads as follows:

 

 

N.B. The court fees range from £30 - £120 (120 being for a claim above 1500 I think, this also incurs another fee when a court is allocated of £100). You DO get this back as well. This is cheaper if you can do it on-line at their website rather than at the court.

Well i have filed my claim with money claim online, just got back from Cyprus with a letter from the courts saying they are going to defend the full amount.

 

They now have 28days to enter a defence.

 

Any advice would be greatfully received.

What you received is I presume the 'Acknowledgment of Service' where the defendant has to state how they wish to proceed.

 

They tick the 'I intend to defend all of this claim' box but they will pay up.

 

Don't worry it is just a standard reply to what must be numerous claims Mr Bacon has to defend of this kind.

UPDATE - well the 28days was up today to enter a defence, went online to see and they have. So now i assume i will have court paperwork arriving letting me know when the hearing is.

 

Or will i have to respond before there is a hearing.

 

Has anyone else got this far along before a refund was given?
