In theory you should but of course the bank is staffed by drones who will then use that as an excuse to deny your request.

Best to simply carry on trying to get the chargeback. However I would really caution you not to be tempted to get the money and to hold onto the item. That can only backfire on you at some point and it could be very serious.

You need the supplier to respond to you and arrange the return. If you get the chargeback then no doubt they will react furiously and they will contact you and that will give you an opportunity to tell them to supply you with the return label.

After that you can give the supplier a deadline and tell them that if they don't organise the return by XXX date – then you will consider that they have abandoned the item.

However keep us updated and keep us informed every step

Emailed the bank on Thursday and have sent multiple emails to supplier no response. The bank says 5 working days. I'm worried it will take so long I will go past the 14 days return policy. I've asked to return it but they are just ignoring me

no does not work like that.

thats the trouble with email.

you should always ring when doing a chargeback

After chasing the bank yesterday they said someone will be in touch and I just received a text saying they will refund me. I didn't tell them that I have received the item and they didn't ask. I know obviously I can't really keep it. Should I send it back? Am I going to have to pay the postage?

Edit: I have just noticed an email from the company I bought it from confirming the refund in reply to the email I originally sent a while back asking for them to cancel the order and refund me prior to receiving it. They haven't asked me to return the part which is odd. Looks like they are refunding it not the bank

if the sender wants it back then they will ask for it and should provide the means to do so at no cost to you.

OK thanks so I don't have any legal obligation to send it back? I never updated the bank to say I had received it I contacted them before it came? Don't want to end up in some sort of trouble. Mind you it's the sender who has refunded me not the bank so its not like I've got the money back from the bank and kept the item

as i said, if the retailer doesnt mention the item, then there is no issue.

however what date is this email from them please

i see you stated on 31st august the item had arrived. i will guess the retailer is not aware of this fact?

and ofcourse HAS the money now be refunded to your card now? go check

The date of the email from them confirming the refund was today.

I imagine the bank contacted them and put pressure on them.

You would think that the retailer would check if the item had been dispatched?

They are aware that it arrived as I sent an email when it arrived saying that I had tried to cancel and it has now arrived and I expect a full refund plus postage to send it back but they ignored me.

I haven't received the money yet but the email had an attachment showing proof of refund

ok await the refund to appear first.

then either email them asking for them to arrange a returns label for the eventually delivered part, or asking what are their intentions toward the parts that are their property but remain in your hands.

are these expensive? it might well be that the cost of returning etc this outweights any profit margins so they wont bother. quite often on low value items retailers just write them off.

I have emailed them saying what do you want to do about the part if you require me to send it back then you need to send a returns label but I haven't heard back from them. Legally is the part still theirs I assume?

yes it is, did you put any kind of time limit on the email?
ideally you should be writing by royal mail next.

email is not a recognised method of legal comms.

if you were to dispose or sell the item or use it or WHY, an email stating what you intent to do and when will not portect you in a court of law.

a written letter with proof of postage from any po counter will.

then you can do what you wish after your proposed date. typically 14 days.
