I purchased new worktops using my credit card. The deposit was paid 147 days ago, the material cost a 119 days ago and fitting paid in cash.

 

The work tops are faulty and after alot if fobbing off by the company they have agreed to replace next year.

 

This has all been phone calls and i have nothing in writing (i dont think it will happen

 

I have raised a claim with the credit card company and initially they said the deposit wasnt covered as it was out of the 120 day claim period.

 

They will persue the materials claim but will not cover the cash part.

 

i thought the full cost of the item should be covered.

 

Any advice would be appreciated.

Are you sure you have done a section 75 claim and not a chargeback?? Which is 120 days.

 

This was paid by a credit card not a debit card?

 

There is no timelimits on section 75 other than the statute of limitations..6yrs..

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you for this information,  I think I have been miss informed by the bank and am on a call now to see what claim they have started.

 

I have had confirmation that a dispute has been raised. If a charge back fails or goes over the 120 days then section 75 can be used. They will be sending me forms and asking for some proof of the letters I have sent.

Just type no need to keep hitting quote.

 

So I guessed right, you've been put down the chargeback route, which is not anything to do with section 75 of the consumer credit act and does not give you all the consumer protection of sec 75.
