Hi all, 

 

I need some advice. My partner was diagnosed with cancer earlier this year and our income has reduced drastically due to her not working anymore. Unfortunately, I have not paid 3 instalments on my pcp and have Anglia UK trying to contact me.

 

I had not spoken to vauxhall finance as I have been extremely stressed with the whole situation and busy with hospital apppintments etc.

 

I recently had to move, and had not changed address with vauxhall finance. I have not got my default or termination notice due to this. However, I am assuming that due to length of time/ no contact I have been issued with both.

 

I currently have around £300 pounds of fees on my account, which is taking me below 1/3 payment but without these I would have paid over the 1/3 requiring them to get a court order.

 

Any advice on what I can do or action I should take?

Fees are unlawful.

 

Makes no odds

They will have  to get a court  return of goods order.

Do you want to keep the car?

 

You could vt but still owe upto the 50% mark.

Do NOT give them rhe car unless you VT, dont let them VS.

 

If you want to keep the car go do a time order monday

Dont faff around take control.

 

You should never be moving without informing ALL your creditors in WRITING and the DVLA (twice licence and v5c)

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi dx, and thanks for prompt response.


Just to clarify, does that mean they will definitely have to get a court order to repossess?

 

I would like to keep the car, it’s helpful with getting the mrs to and from appointments. I shall do the time order on Monday, definitely.

 

Lessons have been learned, especially with change of address stuff.

well you dont want backdoor CCJ's on old debts

never run from debt ...take control.

 

your only saving grace here is if they do snatch the car without a court order you get it back, or equiv monetary value today and all your payments back as that action as the car is protected goods will void the agreement.
